The Criminal Justice (2013 Act) (Commencement No.1) Order (Northern Ireland) 2013

The Department of Justice, in exercise of the power conferred by section 13(2) of the Criminal Justice Act (Northern Ireland) 20131 and, in accordance with section 13(5) of that Act with the approval of the First Minister and deputy First Minister acting jointly, and following a request from the Chief Constable, and after consultation with the Lord Chief Justice, makes the following Order:

Citation and Interpretation1.

(1)

This Order may be cited as the Criminal Justice (2013 Act) (Commencement No.1) Order (Northern Ireland) 2013.

(2)

In this Order, “the 2013 Act” means the Criminal Justice Act (Northern Ireland) 2013.

Appointed Day2.

The day for the coming into operation of section 13(1) of the 2013 Act is 8 June 2013.

EXPLANATORY NOTE
(This note is not part of the Order)

This Order brings into operation section 13(1) of the Criminal Justice Act (Northern Ireland) 2013 (c.7) (“the 2013 Act”).

Section 13(1) of the 2013 Act disapplies section 7 of the Sunday Observance Act (Ireland) 1695 to allow for a magistrates’ court, in the exercise of its criminal jurisdiction, to be held on a Sunday.

In accordance with section 13(2)(b) of the 2013 Act, this Order will cease to be in operation one month from the day appointed in Article 2 of this Order for the coming into operation of section 13(1) of the 2013 Act.
