href="http://www.legislation.gov.uk/id/ukpga/2006/51">2006(c.51)</ref></p></authorialNote>, makes the following Regulations.</p></formula></preamble><body eId="body"><part eId="part-1"><num>PART 1</num><heading>GENERAL</heading><hcontainer name="regulation" eId="regulation-1"><heading>Citation and commencement</heading><num>1.</num><content><p>These Regulations may be cited as the Alien and Locally Absent Species in Aquaculture Regulations (Northern Ireland) 2012 and come into operation on 15<sup>th</sup> October 2012.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>Interpretation</heading><num>2.</num><paragraph eId="regulation-2-1"><num>(1)</num><content><p>Subject to regulations 22(1) and 26(1), the Interpretation Act (Northern Ireland) 1954 <authorialNote class="footnote" eId="f00005" marker="5"><p><ref eId="c00012" href="http://www.legislation.gov.uk/id/apni/1954/33">1954 c.33 (N.I.)</ref></p></authorialNote> applies to these Regulations as it applies to an Act of the Assembly.</p></content></paragraph><paragraph eId="regulation-2-2"><num>(2)</num><intro><p>In these Regulations—</p></intro><hcontainer name="definition"><content><p>“an Annex IV species” means any species listed in Annex IV to Council Regulation 708/2007, as amended from time to time;</p></content></hcontainer><hcontainer name="definition"><content><p>“aquaculture facility” includes an open and a closed aquaculture facility;</p></content></hcontainer><hcontainer name="definition"><content><p>“contravention” includes a failure to comply;</p></content></hcontainer><hcontainer name="definition"><content><p>“Council Regulation 708/2007” means Council Regulation <ref eId="c00002" href="http://www.legislation.gov.uk/european/regulation/2007/0708">(EC) No 708/2007</ref> concerning use of alien and locally absent species in aquaculture, as last amended by Regulation (EU) No 304/2011 of the European Parliament and of the Council;</p></content></hcontainer><hcontainer name="definition"><content><p>“the Department” means the Department of Agriculture and Rural Development;</p></content></hcontainer><hcontainer name="definition"><content><p>“inspector” means a person appointed to be an inspector for the purposes of these Regulations by the Department;</p></content></hcontainer><hcontainer name="definition"><content><p>“Northern Ireland” has the meaning given in section 98(1) of the Northern Ireland Act 1998<authorialNote class="footnote" eId="f00006" marker="6"><p><ref eId="c00013" href="http://www.legislation.gov.uk/id/ukpga/1998/47">1998 c.47 (N.I.)</ref></p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><content><p>“notice” means notice in writing;</p></content></hcontainer><hcontainer name="definition"><content><p>“permit” means a permit granted by the Department under Council Regulation 708/2007.</p></content></hcontainer></paragraph><paragraph eId="regulation-2-3"><num>(3)</num><content><p>Expressions used in these Regulations which are also used in Council Regulation 708/2007 have the same meaning as they have in that Council Regulation.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-3"><heading>Designation of Department as competent authority</heading><num>3.</num><content><p>The Department is designated the competent authority for the purposes of Article 5 of Council Regulation 708/2007.</p></content></hcontainer></part><part eId="part-2"><num>PART 2</num><heading>MOVEMENTS</heading><hcontainer name="regulation" eId="regulation-4"><heading>Requirement for permit to introduce alien species or translocate locally absent species</heading><num>4.</num><paragraph eId="regulation-4-1"><num>(1)</num><content><p>It is an offence for a person to undertake the introduction of an alien species or the translocation of a locally absent species except under, and in accordance with the conditions of, a permit.</p></content></paragraph><paragraph eId="regulation-4-2"><num>(2)</num><intro><p>Paragraph (1) does not apply in relation to –</p></intro><level class="para1" eId="regulation-4-2-a"><num>(a)</num><content><p>the movement of an Annex IV species; or</p></content></level><level class="para1" eId="regulation-4-2-b"><num>(b)</num><content><p>the translocation of a locally absent species within Northern Ireland <noteRef href="#key-1e454e17924c466e9f1d95ec0683d19e" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>...if the Department has served notice under regulation 8(2) on the person undertaking the translocation that a permit is not required for the translocation.</p></content></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-5"><heading>Permits</heading><num>5.</num><paragraph eId="regulation-5-1"><num>(1)</num><content><p>A permit shall be in writing and may be granted subject to such conditions as the Department considers appropriate.</p></content></paragraph><paragraph eId="regulation-5-2"><num>(2)</num><intro><p>A permit shall specify -</p></intro><level class="para1" eId="regulation-5-2-a"><num>(a)</num><content><p>the unique reference number assigned to the permit;</p></content></level><level class="para1" eId="regulation-5-2-b"><num>(b)</num><content><p>the species to which it applies;</p></content></level><level class="para1" eId="regulation-5-2-c"><num>(c)</num><content><p>the aquaculture facility into which the movement is permitted;</p></content></level><level class="para1" eId="regulation-5-2-d"><num>(d)</num><content><p>the duration of the permit;</p></content></level><level class="para1" eId="regulation-5-2-e"><num>(e)</num><content><p>the monitoring period where the Department considers that a monitoring period longer than the period of two years laid down in Article 18.1 of Council Regulation 708/2007 is required.</p></content></level></paragraph><paragraph eId="regulation-5-3"><num>(3)</num><intro><p>If the Department refuses to grant a permit or grants it subject to conditions, it shall, by notice served on the applicant,</p></intro><level class="para1" eId="regulation-5-3-a"><num>(a)</num><content><p>give the reasons for its decision; and</p></content></level><level class="para1" eId="regulation-5-3-b"><num>(b)</num><content><p>inform the applicant of the right of appeal under regulation 20.</p></content></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-6"><heading>Notifying movement of Annex IV species or translocation of locally absent species</heading><num>6.</num><paragraph eId="regulation-6-1"><num>(1)</num><intro><p>This regulation applies in relation to—</p></intro><level class="para1" eId="regulation-6-1-a"><num>(a)</num><content><p>the proposed movement of an Annex IV species;</p></content></level><level class="para1" eId="regulation-6-1-b"><num>(b)</num><content><p>the proposed translocation of a locally absent species within Northern Ireland<noteRef href="#key-1ceec52d85aca6adc873d19eff0790f1" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>....</p></content></level></paragraph><paragraph eId="regulation-6-2"><num>(2)</num><content><p>Subject to paragraph (5), a person proposing to undertake a movement or translocation shall give notice of the proposed movement or translocation to the Department.</p></content></paragraph><paragraph eId="regulation-6-3"><num>(3)</num><content><p>An application for an authorisation to operate an aquaculture production business under the Aquatic Animal Health Regulations (Northern Ireland) 2009 <authorialNote class="footnote" eId="f00007" marker="7"><p><ref eId="c00014" href="http://www.legislation.gov.uk/id/nisr/2009/129">S.R. 2009 No. 129</ref>, as amended by <ref eId="c00015" href="http://www.legislation.gov.uk/id/nisr/2011/118">S.R. 2011 No. 118</ref></p></authorialNote> in respect of an Annex IV species or a locally absent species or an application for the amendment of such an authorisation in so far as it relates to the proposed movement of an Annex IV species or the translocation of a locally absent species is notice for the purposes of paragraph (2).</p></content></paragraph><paragraph eId="regulation-6-4"><num>(4)</num><content><p>A person who gives, or by virtue of paragraph (3) is deemed to have given, notice under paragraph (2) in respect of the proposed movement of an Annex IV species shall not undertake the movement except under, and in accordance with the conditions of, a notice served by the Department under regulation 7(2)(b) or (3)(b).</p></content></paragraph><paragraph eId="regulation-6-5"><num>(5)</num><intro><p>Paragraph (2) does not apply to subsequent movements of the same Annex IV species or translocations of the same locally absent species as notified to the Department under paragraph (2) which are undertaken by the same person to the same aquaculture facility if –</p></intro><level class="para1" eId="regulation-6-5-a"><num>(a)</num><content><p>the movements have previously been permitted by the Department by notice served under regulation 7(2)(b) or (3)(b); or</p></content></level><level class="para1" eId="regulation-6-5-b"><num>(b)</num><content><p>the Department has previously served notice under regulation 8(2) that a permit is not required for the translocations.</p></content></level></paragraph><paragraph eId="regulation-6-6"><num>(6)</num><content><p>It is an offence for a person to contravene paragraph (2) or (4).</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-7"><heading>Movement of Annex IV species</heading><num>7.</num><paragraph eId="regulation-7-1"><num>(1)</num><content><p>This regulation applies where the Department has received notice of the proposed movement of an Annex IV species under regulation 6(2).</p></content></paragraph><paragraph eId="regulation-7-2"><num>(2)</num><intro><p>The Department shall serve notice on the person proposing to undertake the movement —</p></intro><level class="para1" eId="regulation-7-2-a"><num>(a)</num><content><p>prohibiting the movement;</p></content></level><level class="para1" eId="regulation-7-2-b"><num>(b)</num><content><p>permitting the movement, and any subsequent movement of the same species undertaken by that person to the same aquaculture facility, subject to any conditions specified in the notice; or</p></content></level><level class="para1" eId="regulation-7-2-c"><num>(c)</num><content><p>requiring the person, at their own cost, to submit an environmental risk assessment carried out in accordance with Article 9(1) of Council Regulation 708/2007.</p></content></level></paragraph><paragraph eId="regulation-7-3"><num>(3)</num><intro><p>After considering any environmental risk assessment required under paragraph (2)(c), the Department shall serve notice on the person proposing to undertake the movement—</p></intro><level class="para1" eId="regulation-7-3-a"><num>(a)</num><content><p>prohibiting the movement; or</p></content></level><level class="para1" eId="regulation-7-3-b"><num>(b)</num><content><p>permitting the movement, and any subsequent movement of the same species undertaken by that person to the same aquaculture facility, subject to any conditions specified in the notice.</p></content></level></paragraph><paragraph eId="regulation-7-4"><num>(4)</num><intro><p>A notice served under paragraph (2)(b) or (3)(b) shall specify —</p></intro><level class="para1" eId="regulation-7-4-a"><num>(a)</num><content><p>the unique reference number assigned to the notice;</p></content></level><level class="para1" eId="regulation-7-4-b"><num>(b)</num><content><p>the species to which it applies;</p></content></level><level class="para1" eId="regulation-7-4-c"><num>(c)</num><content><p>the aquaculture facility into which the movement is permitted; and</p></content></level><level class="para1" eId="regulation-7-4-d"><num>(d)</num><content><p>the duration of the notice.</p></content></level></paragraph><paragraph eId="regulation-7-5"><num>(5)</num><intro><p>A notice served under paragraph (2)(a) or (b) or (3) shall –</p></intro><level class="para1" eId="regulation-7-5-a"><num>(a)</num><content><p>give the reasons for the decision; and</p></content></level><level class="para1" eId="regulation-7-5-b"><num>(b)</num><content><p>inform the person on whom the notice is served of the right of appeal under regulation 20.</p></content></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-8"><heading>Translocation of locally absent species</heading><num>8.</num><paragraph eId="regulation-8-1"><num>(1)</num><content><p>This regulation applies where the Department has received notice of the proposed translocation of a locally absent species under regulation 6(2).</p></content></paragraph><paragraph eId="regulation-8-2"><num>(2)</num><content><p>The Department shall serve notice on the person proposing to undertake the translocation informing the person whether, for the purposes of Article 2(2) of Council Regulation 708/2007, there are grounds for foreseeing environmental threats due to the proposed translocation.</p></content></paragraph><paragraph eId="regulation-8-3"><num>(3)</num><intro><p>A notice served under paragraph (2) shall —</p></intro><level class="para1" eId="regulation-8-3-a"><num>(a)</num><content><p>state whether a permit is required for the translocation; and</p></content></level><level class="para1" eId="regulation-8-3-b"><num>(b)</num><intro><p>if a permit is required –</p></intro><level class="para2" eId="regulation-8-3-b-i"><num>(i)</num><content><p>give the reasons for the decision; and</p></content></level><level class="para2" eId="regulation-8-3-b-ii"><num>(ii)</num><content><p>inform the person on whom the notice is served of the right of appeal under regulation 20.</p></content></level></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-9"><heading>Environmental risk assessment</heading><num>9.</num><content><p>An environmental risk assessment carried out under Article 9(1) of Council Regulation 708/2007 shall be produced at the applicant’s own cost.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-10"><heading>Contingency plan</heading><num>10.</num><paragraph eId="regulation-10-1"><num>(1)</num><intro><p>A contingency plan drawn up under Article 17 of Council Regulation 708/2007 shall be —</p></intro><level class="para1" eId="regulation-10-1-a"><num>(a)</num><content><p>produced at the applicant’s own cost; and</p></content></level><level class="para1" eId="regulation-10-1-b"><num>(b)</num><content><p>approved by the Department in writing.</p></content></level></paragraph><paragraph eId="regulation-10-2"><num>(2)</num><content><p>It is an offence for a person to fail to implement an approved contingency plan immediately upon the occurrence of an event specified in the plan.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-11"><heading>Monitoring</heading><num>11.</num><paragraph eId="regulation-11-1"><num>(1)</num><content><p>This regulation applies where monitoring is required under Article 18 or 22 of Council Regulation 708/2007.</p></content></paragraph><paragraph eId="regulation-11-2"><num>(2)</num><content><p>The applicant shall submit to the Department for approval a programme detailing how the monitoring will be carried out.</p></content></paragraph><paragraph eId="regulation-11-3"><num>(3)</num><content><p>A monitoring programme shall be approved by the Department in writing.</p></content></paragraph><paragraph eId="regulation-11-4"><num>(4)</num><intro><p>An approved monitoring programme shall be carried out, at the applicant’s own cost,—</p></intro><level class="para1" eId="regulation-11-4-a"><num>(a)</num><content><p>by the applicant; or</p></content></level><level class="para1" eId="regulation-11-4-b"><num>(b)</num><content><p>where the Department determines that the applicant does not have the expertise, by a person nominated by the applicant and approved in writing by the Department.</p></content></level></paragraph></hcontainer></part><part eId="part-3"><num>PART 3</num><heading>ENFORCEMENT, PENALTIES AND APPEALS</heading><hcontainer name="regulation" eId="regulation-12"><heading>Entry and inspection of premises</heading><num>12.</num><paragraph eId="regulation-12-1"><num>(1)</num><content><p>For the purposes of enforcing Council Regulation 708/2007 or these Regulations, an inspector may, on producing, if so required, some duly authenticated document showing the inspector’s authority, enter and inspect any premises at any reasonable hour.</p></content></paragraph><paragraph eId="regulation-12-2"><num>(2)</num><intro><p>But an inspector may not enter any premises which are used wholly or mainly as a private dwelling-house unless –</p></intro><level class="para1" eId="regulation-12-2-a"><num>(a)</num><content><p>24 hours’ notice of the intended entry has been given to the occupier; or</p></content></level><level class="para1" eId="regulation-12-2-b"><num>(b)</num><content><p>a lay magistrate has issued a warrant under this regulation authorising the inspector to enter the dwelling.</p></content></level></paragraph><paragraph eId="regulation-12-3"><num>(3)</num><intro><p>A lay magistrate may issue a warrant authorising an inspector to enter any premises, if necessary by reasonable force, if the lay magistrate is satisfied, on complaint on oath, -</p></intro><level class="para1" eId="regulation-12-3-a"><num>(a)</num><content><p>that there are reasonable grounds to enter the premises for a purpose mentioned in paragraph (1); and</p></content></level><level class="para1" eId="regulation-12-3-b"><num>(b)</num><content><p>that any of the conditions in paragraph (4) is met.</p></content></level></paragraph><paragraph eId="regulation-12-4"><num>(4)</num><intro><p>The conditions are –</p></intro><level class="para1" eId="regulation-12-4-a"><num>(a)</num><content><p>that admission to the premises has been, or is likely to be, refused and (in either case) notice of the intention to apply for a warrant has been given to the occupier;</p></content></level><level class="para1" eId="regulation-12-4-b"><num>(b)</num><content><p>that asking for admission to the premises, or the giving of such notice, would defeat the object of the entry;</p></content></level><level class="para1" eId="regulation-12-4-c"><num>(c)</num><content><p>that entry to the premises is required urgently; or</p></content></level><level class="para1" eId="regulation-12-4-d"><num>(d)</num><content><p>that the premises are unoccupied or the occupier is temporarily absent.</p></content></level></paragraph><paragraph eId="regulation-12-5"><num>(5)</num><content><p>A warrant issued under paragraph (3) shall continue in force for one month or, if sooner, until the purpose for which it was issued has been fulfilled.</p></content></paragraph><paragraph eId="regulation-12-6"><num><ins class="substitution first" ukl:ChangeId="key-3d0591e5ff45ea74b3edccb80090e295-1654082817803" ukl:CommentaryRef="key-3d0591e5ff45ea74b3edccb80090e295"><noteRef uk:name="commentary" href="#key-3d0591e5ff45ea74b3edccb80090e295" class="commentary"/>(6)</ins></num><content><p><ins class="substitution last" ukl:ChangeId="key-3d0591e5ff45ea74b3edccb80090e295-1654082817803" ukl:CommentaryRef="key-3d0591e5ff45ea74b3edccb80090e295">An inspector entering any premises may be accompanied by such persons, and may enter with such equipment or vehicle, as the inspector considers necessary for the purposes of these Regulations.</ins></p></content></paragraph><paragraph eId="regulation-12-7"><num>(7)</num><content><p>An inspector entering any premises which are unoccupied, or from which the occupier is temporarily absent, shall leave them as effectively secured against unauthorised entry as the inspector found them.</p></content></paragraph><paragraph eId="regulation-12-8"><num>(8)</num><intro><p>In this regulation “premises” includes any land or place and, in particular, includes—</p></intro><level class="para1" eId="regulation-12-8-a"><num>(a)</num><content><p>any vessel, vehicle or trailer;</p></content></level><level class="para1" eId="regulation-12-8-b"><num>(b)</num><content><p>any installation, container or receptacle.</p></content></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-13"><heading>Search and examination of items on premises</heading><num>13.</num><intro><p>Subject to regulation 16, an inspector entering any premises under regulation 12 may—</p></intro><level class="para1" eId="regulation-13-a"><num>(a)</num><content><p>search the premises for any item, including any aquatic organism or water;</p></content></level><level class="para1" eId="regulation-13-b"><num>(b)</num><intro><p>examine anything that is—</p></intro><level class="para2" eId="regulation-13-b-i"><num>(i)</num><content><p>on the premises;</p></content></level><level class="para2" eId="regulation-13-b-ii"><num>(ii)</num><content><p>attached to, or otherwise forms part of, the premises.</p></content></level></level></hcontainer><hcontainer name="regulation" eId="regulation-14"><heading>Production of documents</heading><num>14.</num><intro><p>Subject to regulation 16, an inspector entering any premises under regulation 12 may require any person on the premises to —</p></intro><level class="para1" eId="regulation-14-a"><num>(a)</num><content><p>produce any document or record that is in the person’s possession or control;</p></content></level><level class="para1" eId="regulation-14-b"><num>(b)</num><content><p>render any such document or record on a computer system into a visible and legible form, including requiring it to be produced in a form in which it may be taken away.</p></content></level></hcontainer><hcontainer name="regulation" eId="regulation-15"><heading>Seizure of items</heading><num>15.</num><paragraph eId="regulation-15-1"><num>(1)</num><content><p>Subject to regulation 16, this regulation applies where an inspector exercises a power conferred by regulation 13 or 14.</p></content></paragraph><paragraph eId="regulation-15-2"><num>(2)</num><intro><p>An inspector may—</p></intro><level class="para1" eId="regulation-15-2-a"><num>(a)</num><content><p>seize, detain or remove any item found on the premises;</p></content></level><level class="para1" eId="regulation-15-2-b"><num>(b)</num><content><p>take copies of, or extracts from, any document or record found on the premises.</p></content></level></paragraph><paragraph eId="regulation-15-3"><num>(3)</num><content><p>The power conferred by paragraph (2)(a) is to be construed as including power to take samples of any aquatic organism or water.</p></content></paragraph><paragraph eId="regulation-15-4"><num>(4)</num><intro><p>An inspector, to whom any document or record has been produced in accordance with a requirement imposed under regulation 14, may—</p></intro><level class="para1" eId="regulation-15-4-a"><num>(a)</num><content><p>seize, detain or remove that document or record;</p></content></level><level class="para1" eId="regulation-15-4-b"><num>(b)</num><content><p>take copies of, or extracts from, that document or record.</p></content></level></paragraph><paragraph eId="regulation-15-5"><num>(5)</num><content><p>If, in the opinion of the inspector, it is not for the time being practicable for the inspector to seize and remove any item, the inspector may require any person on the premises to secure that the item is not removed or otherwise interfered with until such time as the inspector may seize and remove it.</p></content></paragraph><paragraph eId="regulation-15-6"><num>(6)</num><content><p>Any aquatic organism or water seized by an inspector may be disposed of as the inspector sees fit.</p></content></paragraph><paragraph eId="regulation-15-7"><num>(7)</num><content><p>It is an offence for a person to fail to comply with a requirement imposed under paragraph (5).</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-16"><heading>Enforcement powers</heading><num>16.</num><intro><p>The powers conferred by regulations 13, 14 and 15 may only be exercised—</p></intro><level class="para1" eId="regulation-16-a"><num>(a)</num><content><p>for the purpose of determining whether an offence under these Regulations has been committed; or</p></content></level><level class="para1" eId="regulation-16-b"><num>(b)</num><content><p>in relation to an item, document or record which an inspector reasonably believes to be evidence of the commission of an offence under these Regulations.</p></content></level></hcontainer><hcontainer name="regulation" eId="regulation-17"><heading>Enforcement notices</heading><num>17.</num><paragraph eId="regulation-17-1"><num>(1)</num><content><p>The Department may serve an enforcement notice on any person who it considers has contravened Council Regulation 708/2007 or these Regulations.</p></content></paragraph><paragraph eId="regulation-17-2"><num>(2)</num><content><p>The Department may serve an enforcement notice on the operator of an aquaculture facility if it considers that any aquatic organism present in the aquaculture facility was moved in contravention of Council Regulation 708/2007 or these Regulations or any condition of a permit or a notice served under regulation 7(2)(a) or (b) or (3).</p></content></paragraph><paragraph eId="regulation-17-3"><num>(3)</num><intro><p>An enforcement notice shall—</p></intro><level class="para1" eId="regulation-17-3-a"><num>(a)</num><content><p>state the matters constituting the contravention;</p></content></level><level class="para1" eId="regulation-17-3-b"><num>(b)</num><content><p>specify the steps which the operator is required to take to remedy the contravention;</p></content></level><level class="para1" eId="regulation-17-3-c"><num>(c)</num><content><p>state the date by which those steps shall be taken; and</p></content></level><level class="para1" eId="regulation-17-3-d"><num>(d)</num><content><p>inform the operator of the right of appeal under regulation 20.</p></content></level></paragraph><paragraph eId="regulation-17-4"><num>(4)</num><intro><p>An enforcement notice may require the operator on whom it is served to—</p></intro><level class="para1" eId="regulation-17-4-a"><num>(a)</num><content><p>remove and dispose of any aquatic organism, at their own cost, in a manner and within the period specified in the notice; and</p></content></level><level class="para1" eId="regulation-17-4-b"><num>(b)</num><content><p>take steps to ensure that the aquaculture facility is, so far as possible, restored to its condition prior to the contravention.</p></content></level></paragraph><paragraph eId="regulation-17-5"><num>(5)</num><intro><p>If an enforcement notice is not complied with, the Department may—</p></intro><level class="para1" eId="regulation-17-5-a"><num>(a)</num><intro><p>take such steps as it considers necessary (including the removal and disposal of the aquatic organism) to —</p></intro><level class="para2" eId="regulation-17-5-a-i"><num>(i)</num><content><p>ensure compliance with the requirements of the notice; or</p></content></level><level class="para2" eId="regulation-17-5-a-ii"><num>(ii)</num><content><p>remedy the consequences of the failure to carry them out; and</p></content></level></level><level class="para1" eId="regulation-17-5-b"><num>(b)</num><content><p>recover any expenses reasonably incurred in so doing from the person who has failed to comply with the enforcement notice.</p></content></level></paragraph><paragraph eId="regulation-17-6"><num>(6)</num><content><p>An enforcement notice does not take effect until 21 days after it is served.</p></content></paragraph><paragraph eId="regulation-17-7"><num>(7)</num><intro><p>The Department may remove and dispose of any aquatic organisms without serving an enforcement notice —</p></intro><level class="para1" eId="regulation-17-7-a"><num>(a)</num><content><p>in an emergency; and</p></content></level><level class="para1" eId="regulation-17-7-b"><num>(b)</num><content><p>at the cost of the operator.</p></content></level></paragraph><paragraph eId="regulation-17-8"><num>(8)</num><content><p>Except where regulation 20 (7) applies, it is an offence for a person to fail to comply with an enforcement notice.</p></content></paragraph><paragraph eId="regulation-17-9"><num>(9)</num><content><p>In this regulation “operator” means any person who is responsible for the management of the aquaculture facility.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-18"><heading>Recovery of expenses of enforcement</heading><num>18.</num><paragraph eId="regulation-18-1"><num>(1)</num><content><p>This regulation applies where a court convicts a person of an offence under regulation 17(8) or 21 (b).</p></content></paragraph><paragraph eId="regulation-18-2"><num>(2)</num><content><p>The court may (in addition to any other order it may make as to costs or expenses) order the person to reimburse the Department for any expenditure which the Department has incurred under regulation 17(5) or (7).</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-19"><heading>Amendment, suspension or revocation of permit or notice</heading><num>19.</num><paragraph eId="regulation-19-1"><num>(1)</num><intro><p>This regulation applies in relation to –</p></intro><level class="para1" eId="regulation-19-1-a"><num>(a)</num><content><p>a permit; or</p></content></level><level class="para1" eId="regulation-19-1-b"><num>(b)</num><content><p>a notice served under regulation 7(2)(b) or (3)(b).</p></content></level></paragraph><paragraph eId="regulation-19-2"><num>(2)</num><intro><p>The Department may—</p></intro><level class="para1" eId="regulation-19-2-a"><num>(a)</num><content><p>amend a permit or notice, including any condition of a permit or notice; or</p></content></level><level class="para1" eId="regulation-19-2-b"><num>(b)</num><content><p>suspend or revoke a permit or notice if it is satisfied that any condition of the permit or notice or any provision of Council Regulation 708/2007 or these Regulations has been or is being contravened.</p></content></level></paragraph><paragraph eId="regulation-19-3"><num>(3)</num><intro><p>An amendment under paragraph (2)(a) may be made –</p></intro><level class="para1" eId="regulation-19-3-a"><num>(a)</num><content><p>on the initiative of the Department; or</p></content></level><level class="para1" eId="regulation-19-3-b"><num>(b)</num><content><p>on application in writing by the permit or notice holder in such form and containing such information as the Department may reasonably require.</p></content></level></paragraph><paragraph eId="regulation-19-4"><num>(4)</num><intro><p>Where the Department amends, suspends or revokes a permit or notice under paragraph (2)(a) or (b) or, in the case of an application under paragraph (3)(b), refuses an application for the amendment of a permit or notice, it shall, by notice served on the permit or notice holder —</p></intro><level class="para1" eId="regulation-19-4-a"><num>(a)</num><content><p>in the case of an amendment, specify the amendment;</p></content></level><level class="para1" eId="regulation-19-4-b"><num>(b)</num><content><p>give the reasons for the amendment, suspension, revocation or the refusal;</p></content></level><level class="para1" eId="regulation-19-4-c"><num>(c)</num><content><p>state the date on which the amendment, suspension or revocation is to take effect and, in the case of a suspension, the date or event on which the suspension will cease to have effect;</p></content></level><level class="para1" eId="regulation-19-4-d"><num>(d)</num><content><p>except in the case of an amendment made on the application of the permit or notice holder, inform the permit or notice holder of the right of appeal under regulation 20.</p></content></level></paragraph><paragraph eId="regulation-19-5"><num>(5)</num><content><p>In the case of a suspension or revocation, a notice served under paragraph (4) may make provision requiring the removal and disposal of any aquatic organism to which the permit or notice relates in such manner as may be specified in the notice.</p></content></paragraph><paragraph eId="regulation-19-6"><num>(6)</num><intro><p>Except where regulation 20(7) applies, it is an offence for a person to fail to comply with –</p></intro><level class="para1" eId="regulation-19-6-a"><num>(a)</num><content><p>a notice suspending a permit or notice served under paragraph (4); or</p></content></level><level class="para1" eId="regulation-19-6-b"><num>(b)</num><content><p>any requirement for the removal and disposal of any aquatic organism imposed by a notice served under paragraph (4).</p></content></level></paragraph><paragraph eId="regulation-19-7"><num>(7)</num><intro><p>Where the Department considers that any requirement imposed by a notice under paragraph (4) has not been complied with, the Department may, without prejudice to any proceedings under paragraph (6)—</p></intro><level class="para1" eId="regulation-19-7-a"><num>(a)</num><intro><p>take, or cause to be taken, such steps as the Department considers necessary to—</p></intro><level class="para2" eId="regulation-19-7-a-i"><num>(i)</num><content><p>ensure compliance with the requirement; or</p></content></level><level class="para2" eId="regulation-19-7-a-ii"><num>(ii)</num><content><p>remedy the consequences of the failure to comply with the requirement; and</p></content></level></level><level class="para1" eId="regulation-19-7-b"><num>(b)</num><content><p>recover any expenses reasonably incurred in so doing from the permit or notice holder.</p></content></level></paragraph><paragraph eId="regulation-19-8"><num>(8)</num><content><p>In this regulation “notice holder” means the person on whom the notice was served under regulation 7(2)(b) or (3)(b).</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-20"><heading>Appeals</heading><num>20.</num><paragraph eId="regulation-20-1"><num>(1)</num><intro><p>A person (“the appellant”) may appeal to the Department against any of the following notices —</p></intro><level class="para1" eId="regulation-20-1-a"><num>(a)</num><content><p>a notice served under regulation 5(3);</p></content></level><level class="para1" eId="regulation-20-1-b"><num>(b)</num><content><p>a notice served under regulation 7(2)(a), (2)(b) or (3);</p></content></level><level class="para1" eId="regulation-20-1-c"><num>(c)</num><content><p>a notice served under regulation 8(2);</p></content></level><level class="para1" eId="regulation-20-1-d"><num>(d)</num><content><p>an enforcement notice served under regulation 17(1) or (2);</p></content></level><level class="para1" eId="regulation-20-1-e"><num>(e)</num><content><p>a notice served under regulation 19(4).</p></content></level></paragraph><paragraph eId="regulation-20-2"><num>(2)</num><intro><p>An appellant may, within 21 days from the date on which the notice was issued,—</p></intro><level class="para1" eId="regulation-20-2-a"><num>(a)</num><content><p>make written representations to the Department; or</p></content></level><level class="para1" eId="regulation-20-2-b"><num>(b)</num><content><p>serve notice on the Department that the appellant wishes to appear before and be heard by an independent person appointed for the purpose by the Department.</p></content></level></paragraph><paragraph eId="regulation-20-3"><num>(3)</num><content><p>Where an appellant makes written representations under paragraph (2)(a) the Department shall appoint an independent person to consider the representations and report in writing to the Department.</p></content></paragraph><paragraph eId="regulation-20-4"><num>(4)</num><intro><p>Where an appellant serves notice under paragraph (2)(b)—</p></intro><level class="para1" eId="regulation-20-4-a"><num>(a)</num><content><p>the Department shall appoint an independent person to hear representations and specify a time limit within which representations to that person shall be made;</p></content></level><level class="para1" eId="regulation-20-4-b"><num>(b)</num><content><p>if the appellant so requests, the hearing before the appointed person shall be in public;</p></content></level><level class="para1" eId="regulation-20-4-c"><num>(c)</num><content><p>the appointed person shall consider the representations and report in writing to the Department.</p></content></level></paragraph><paragraph eId="regulation-20-5"><num>(5)</num><content><p>If the appellant so requests, the Department shall provide a copy of the appointed person’s report to the appellant.</p></content></paragraph><paragraph eId="regulation-20-6"><num>(6)</num><content><p>The Department shall, after considering the report, serve notice of its final decision and the reasons for it on the appellant.</p></content></paragraph><paragraph eId="regulation-20-7"><num>(7)</num><content><p>Where an appeal is made against any notice listed in paragraph (8), the notice shall not have effect pending the final decision of the Department or the withdrawal of the appeal.</p></content></paragraph><paragraph eId="regulation-20-8"><num>(8)</num><intro><p>The notices are —</p></intro><level class="para1" eId="regulation-20-8-a"><num>(a)</num><intro><p>a notice served under regulation 19(4) suspending or revoking –</p></intro><level class="para2" eId="regulation-20-8-a-i"><num>(i)</num><content><p>a permit; or</p></content></level><level class="para2" eId="regulation-20-8-a-ii"><num>(ii)</num><content><p>a notice served under regulation 7(2)(b) or (3)(b);</p></content></level></level><level class="para1" eId="regulation-20-8-b"><num>(b)</num><content><p>an enforcement notice served under regulation 17(1) or (2).</p></content></level></paragraph><paragraph eId="regulation-20-9"><num>(9)</num><content><p>But paragraph (7) does not apply where the notice includes a statement that in the opinion of the Department there is an imminent risk of adverse effects to biodiversity or an imminent threat to aquatic organisms, habitats or ecosystems.</p></content></paragraph><paragraph eId="regulation-20-10"><num>(10)</num><intro><p>The Department shall pay an amount equal to the loss suffered or expenditure reasonably incurred by the person on whom the notice was served if —</p></intro><level class="para1" eId="regulation-20-10-a"><num>(a)</num><content><p>a notice to which paragraph (7) does not apply by virtue of paragraph (9) is varied or withdrawn by the Department on appeal; and</p></content></level><level class="para1" eId="regulation-20-10-b"><num>(b)</num><content><p>that person has complied with the notice.</p></content></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-21"><heading>Offences</heading><num>21.</num><intro><p>It is an offence for a person —</p></intro><level class="para1" eId="regulation-21-a"><num>(a)</num><intro><p>for the purpose of procuring the grant or amendment of a permit, -</p></intro><level class="para2" eId="regulation-21-a-i"><num>(i)</num><content><p>to make a statement which that person knows or suspects is false or misleading in a material particular; or</p></content></level><level class="para2" eId="regulation-21-a-ii"><num>(ii)</num><content><p>intentionally to fail to disclose any material particular;</p></content></level></level><level class="para1" eId="regulation-21-b"><num>(b)</num><content><p>to abandon or allow to escape any aquatic organism, the movement of which took place under a permit or under a notice served under regulation 7(2)(b) or (3)(b) (movement of an Annex IV species) unless the person can show that all reasonable steps were taken and due diligence exercised to avoid the abandonment or escape;</p></content></level><level class="para1" eId="regulation-21-c"><num>(c)</num><content><p>to fail, without reasonable cause, to give an inspector any assistance or information which the inspector may reasonably require for the purposes of the inspector’s functions under these Regulations;</p></content></level><level class="para1" eId="regulation-21-d"><num>(d)</num><content><p>intentionally to obstruct an inspector; or</p></content></level><level class="para1" eId="regulation-21-e"><num>(e)</num><content><p>knowingly to give false or misleading information to an inspector.</p></content></level></hcontainer><hcontainer name="regulation" eId="regulation-22"><heading>Offences by corporate bodies, partnerships and unincorporated associations</heading><num>22.</num><paragraph eId="regulation-22-1"><num>(1)</num><intro><p>In its application to these Regulations, section 20 of the Interpretation Act (Northern Ireland) 1954 (offences by bodies corporate) has effect as if –</p></intro><level class="para1" eId="regulation-22-1-a"><num>(a)</num><content><p>in subsection (2) the words “the liability of whose members is limited” were omitted and where the affairs of a body corporate are managed by its members, as if, in relation to the acts or defaults of a member in connection with the member’s functions of management, the member were a director of the body corporate;</p></content></level><level class="para1" eId="regulation-22-1-b"><num>(b)</num><content><p>subsection (3) was omitted.</p></content></level></paragraph><paragraph eId="regulation-22-2"><num>(2)</num><content><p>If any offence under these Regulations committed by a partnership is proved to have been committed with the consent or connivance of, or to be attributable to any neglect on the part of, a partner, that partner as well as the partnership is guilty of the offence and liable to be proceeded against and punished accordingly.</p></content></paragraph><paragraph eId="regulation-22-3"><num>(3)</num><content><p>If any offence under these Regulations committed by an unincorporated association (other than a partnership) is proved to have been committed with the consent or connivance of, or to be attributable to any neglect on the part of, an officer of the association or a member of its governing body, that officer or member as well as the association is guilty of the offence and liable to be proceeded against and punished accordingly.</p></content></paragraph><paragraph eId="regulation-22-4"><num>(4)</num><content><p>In paragraph (2) “partner” includes a person purporting to act as a partner.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-23"><heading>Penalties</heading><num>23.</num><intro><p>A person guilty of an offence under these Regulations is liable—</p></intro><level class="para1" eId="regulation-23-a"><num>(a)</num><content><p>on summary conviction, to a fine not exceeding the statutory maximum;</p></content></level><level class="para1" eId="regulation-23-b"><num>(b)</num><content><p>on conviction on indictment, to a fine.</p></content></level></hcontainer></part><part eId="part-4"><num>PART 4</num><heading>MISCELLANEOUS</heading><hcontainer name="regulation" eId="regulation-24"><heading>Application to the Crown</heading><num>24.</num><paragraph eId="regulation-24-1"><num>(1)</num><content><p>Subject to the provisions of this regulation, these Regulations bind the Crown to the full extent authorised or permitted by the constitutional laws of Northern Ireland.</p></content></paragraph><paragraph eId="regulation-24-2"><num>(2)</num><content><p>No contravention by the Crown of any provision of these Regulations shall make the Crown criminally liable; but the High Court may, on the application of any person appearing to the Court to have an interest, declare unlawful any act or omission of the Crown which constitutes such a contravention.</p></content></paragraph><paragraph eId="regulation-24-3"><num>(3)</num><content><p>Notwithstanding anything in paragraph (2), these Regulations apply to a person in the public service of the Crown as they apply to any other person.</p></content></paragraph><paragraph eId="regulation-24-4"><num>(4)</num><content><p>In this regulation any reference to the Crown includes a reference to the Crown in right of Her Majesty’s Government in Northern Ireland.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-25"><heading>Disclosure of information</heading><num>25.</num><paragraph eId="regulation-25-1"><num>(1)</num><intro><p>For the purposes of Council Regulation 708/2007, these Regulations or the equivalent regulations in England, Scotland or Wales, the Department may disclose information received by it in the administration or enforcement of Council Regulation 708/2007 or these Regulations to –</p></intro><level class="para1" eId="regulation-25-1-a"><num>(a)</num><content><p>the equivalent competent authority in England, Scotland, Wales or  <ins class="substitution first last" ukl:ChangeId="key-7f4ca380ff58a383f68fb60bb279b6ca-1654082955823" ukl:CommentaryRef="key-7f4ca380ff58a383f68fb60bb279b6ca"><noteRef uk:name="commentary" href="#key-7f4ca380ff58a383f68fb60bb279b6ca" class="commentary"/>a</ins>  member State;</p></content></level><level class="para1" eId="regulation-25-1-b"><num>(b)</num><content><p>the Department of the Environment;</p></content></level><level class="para1" eId="regulation-25-1-c"><num>(c)</num><content><p>the Department of Culture, Arts and Leisure;</p></content></level><level class="para1" eId="regulation-25-1-d"><num>(d)</num><content><p>the Loughs Agency;</p></content></level><level class="para1" eId="regulation-25-1-e"><num>(e)</num><content><p>the Agri-Food and Biosciences Institute.</p></content></level></paragraph><paragraph eId="regulation-25-2"><num>(2)</num><content><p>In paragraph (1)(d) the “Loughs Agency” means the executive agency through which the Foyle, Carlingford and Irish Lights Commission exercises its functions under the Foyle Fisheries Act (Northern Ireland) 1952 <authorialNote class="footnote" eId="f00008" marker="8"><p><ref eId="c00016" href="http://www.legislation.gov.uk/id/apni/1954/5">c.5 (N.I.)</ref></p></authorialNote>.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-26"><heading>Service of notices</heading><num>26.</num><paragraph eId="regulation-26-1"><num>(1)</num><content><p>In its application to these Regulations, section 24(1) of the Interpretation Act (Northern Ireland) 1954 (service of documents by post) has effect as if the word “registering” were omitted.</p></content></paragraph><paragraph eId="regulation-26-2"><num>(2)</num><intro><p>Any notice required to be served under these Regulations may be served on a person by means of electronic communication if –</p></intro><level class="para1" eId="regulation-26-2-a"><num>(a)</num><content><p>the person has consented to the use of that form of communication and has provided an electronic address for that purpose;</p></content></level><level class="para1" eId="regulation-26-2-b"><num>(b)</num><content><p>the consent has not been withdrawn; and</p></content></level><level class="para1" eId="regulation-26-2-c"><num>(c)</num><content><p>the communication is sent to the address provided.</p></content></level></paragraph><paragraph eId="regulation-26-3"><num>(3)</num><content><p>Where electronic communication is used for the purpose of serving a notice, then, unless the contrary is proved, the notice is deemed to have been served on the day and at the time recorded by the transmitting apparatus as being the day and time of satisfactory completion of the transmission.</p></content></paragraph><paragraph eId="regulation-26-4"><num>(4)</num><content><p>In this regulation “electronic communication” has the meaning given in section 4(1) of the Electronic
