Regulations may be cited as the Police Act 1997 (Criminal Records) (Amendment <abbr title="Number">No.</abbr> 2) Regulations (Northern Ireland) 2012, and shall come into operation on 10th September 2012.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>Amendment of the Police Act 1997 (Criminal Records) (Disclosure) Regulations (Northern Ireland) 2008</heading><num>2.</num><paragraph eId="regulation-2-1"><num>(1)</num><content><p>The Police Act 1997 (Criminal Records) (Disclosure) Regulations (Northern Ireland) 2008<authorialNote class="footnote" eId="f00003" marker="3"><p><ref eId="c00005" href="http://www.legislation.gov.uk/id/uksi/2008/542">S.I. 2008/542</ref> as amended by <ref eId="c00006" href="http://www.legislation.gov.uk/id/uksi/2009/1798">S.I. 2009/1798</ref>. <ref eId="c00007" href="http://www.legislation.gov.uk/id/uksi/2009/2495">S.I. 2009/2495</ref>, <ref eId="c00008" href="http://www.legislation.gov.uk/id/nisr/2010/229">S.R. 2010 No. 229</ref> and <ref eId="c00009" href="http://www.legislation.gov.uk/id/nisr/2012/86">S.R. 2012 No. 86</ref>; the Secretary of State’s functions under these regulations are transferred to the Department of Justice by article 17 of <ref eId="c00010" href="http://www.legislation.gov.uk/id/uksi/2010/976">S.I. 2010/976</ref>.</p></authorialNote> are amended in accordance with the following paragraphs.</p></content></paragraph><paragraph eId="regulation-2-2"><num>(2)</num><content><p><mod>For regulation 8(1)(a) substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="double"><level class="para1"><num>(a)</num><intro><p>the Police Service of Northern Ireland if—</p></intro><level class="para2"><num>(i)</num><content><p>it appears to the Department of Justice that information is held in relation to the applicant in the record of convictions in the Causeway System;</p></content></level><level class="para2"><num>(ii)</num><content><p>it appears to the Department of Justice that information is held by the Police Service of Northern Ireland in relation to the applicant other than in the Causeway System;</p></content></level><level class="para2"><num>(iii)</num><content><p>the applicant resides or has resided within a period of 5 years preceding the date of the application in the Republic of Ireland; or</p></content></level><level class="para2"><num>(iv)</num><content><p>the application involves any regulated work activity relating to children within the meaning of Part 1 of Schedule 2 to the Safeguarding Vulnerable Groups (Northern Ireland) Order 2007 which is taking or is to take place within Northern Ireland on domestic premises used wholly or mainly as a private dwelling including an application for the assessment of any person to have contact with children who are residing in those domestic premises at times when the regulated work activity is taking or is to take place.</p></content></level></level></quotedStructure><inline name="appendText">.</inline></mod></p></content></paragraph><paragraph eId="regulation-2-3"><num>(3)</num><content><p><mod>For regulation service created under any enactment or commissioned by an <abbr class="acronym" title="Health and Safety Commission">HSC</abbr> body within the meaning of Article 2(2) of the Safeguarding Vulnerable Groups (Northern Ireland) Order 2007, and is of such a kind as to enable a person, in the course of his normal duties in that position, to have access to such vulnerable adults when they are receiving Regulations</abbr>”) to give effect to the changes affecting regulated and controlled activity concerning children and vulnerable adults under the Safeguarding Vulnerable Groups (Northern Ireland) Order 2007 which were made by the Protection of Freedoms Act 2012 (“the <abbr title="Protection of Freedoms Act 2012 c. 9">2012 Act</abbr>”). The <abbr title="Protection of Freedoms Act 2012 c. 9">2012 Act</abbr> has reduced the scope of the definition of regulated activity and has abolished the concept of controlled activity.</p></blockContainer><blockContainer ukl:Name="P"><p>These Regulations also include an amendment setting out the circumstances where AccessNI may seek enhanced criminal record certificate information from the Police Service of Northern Ireland (“<abbr title="Police Service of Northern Ireland">PSNI</abbr>”).</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 2(2) amends the current address based searching procedures to permit AccessNI to use procedures similar in effect to those followed under Part 5 of the Police Act 1997 by the Criminal Records Bureau in England and Wales and by Disclosure Scotland. This amendment limits the occasions when an application for an enhanced criminal record certificate is made to <abbr title="Police Service of Northern Ireland">PSNI</abbr> to those where <abbr title="Police Service of Northern Ireland">PSNI</abbr> appears to hold relevant information, the applicant resides in or has resided within a period of 5 years preceding the date of the application in the Republic of Ireland, or the application relates to work with children at the applicant’s home address in Northern Ireland.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 2(3), (4), (5), and (6) makes provision for the continued eligibility of persons who were previously in regulated activities, which are no longer regulated work activities, or in controlled activities, which have been abolished, to apply for enhanced criminal record certificates in respect of those previous work activities.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 2(7) enables an application for an enhanced criminal record certificate to be made for the purpose of assessing the applicant’s suitability to work in regulated activity relating to the provision for the representation of or advocacy services for vulnerable adults.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 2(8) and (9) sets out the amended cases involving regulated work activities with children and vulnerable adults where applications can be made for suitability information.</p></blockContainer><blockContainer ukl:Name="P"><p>These Regulations come into operation on 10th September 2012.</p></blockContainer></blockContainer></conclusions></act></akomaNtoso>
