The Corporate Manslaughter and Corporate Homicide (2007 Act) (Commencement) Order (Northern Ireland) 2012

The Department of Justice makes the following Order in exercise of the powers conferred by sections 24(9) and 27(1) and (1A) of the Corporate Manslaughter and Corporate Homicide Act 20071.

In accordance with section 24(9) of that Act a draft of this Order was laid before, and approved by a resolution of, the Assembly.

Citation1.

This Order may be cited as the Corporate Manslaughter and Corporate Homicide (2007 Act) (Commencement) Order (Northern Ireland) 2012.

Provisions coming into force on 3rd September 20122.

Section 2(1)(d) of the Corporate Manslaughter and Corporate Homicide Act 2007 (duty owed to a person in custody to be a relevant duty of care) shall come into force on 3rd September 2012.

EXPLANATORY NOTE
(This note is not part of the Order)

This Order brings into force on 3rd September 2012 section 2(1)(d) of the Corporate Manslaughter and Corporate Homicide Act 2007. Section 2 of that Act defines “relevant duty of care” for the purposes of the Act, and subsection (1)(d) states that a duty owed to a person in custody etc is to be such a relevant duty. This Order completes the bringing into force of that Act.
