The Wildlife and Natural Environment (2011 Act) (Commencement No.3) Order (Northern Ireland) 2012

The Department of the Environment makes the following Order in exercise of the powers conferred by section 40 of the Wildlife and Natural Environment Act (Northern Ireland) 20111.

Citation and interpretation1.

(1)

This Order may be cited as the Wildlife and Natural Environment (2011 Act) (Commencement No.3) Order (Northern Ireland) 2012.

(2)

In this Order “the Act” means the Wildlife and Natural Environment Act (Northern Ireland) 2011.

Appointed days2.

(1)

30^th January 2012 is the day appointed for the coming into operation of section 11 (spring traps) of the Act, for the purpose only of enabling orders to be made by the Department of the Environment under Article 12A(2) or (3) of the Wildlife (Northern Ireland) Order 19852.

(2)

12^th March 2012 is the day appointed for the coming into operation of the following provisions of the Act—

(a)

section 11, so far as not already in operation; and

(b)

Part 1 of Schedule 3 (repeals: wildlife), so far as it relates to the Welfare of Animals Act (Northern Ireland) 1972 3.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order commences provisions of the Wildlife and Natural Environment Act (Northern Ireland) 2011 (“the Act”).

Article 2(1) appoints 30^th January 2012 for the coming into operation of section 11 of the Act for the purpose only of enabling the Department of the Environment to approve by order certain traps for the purpose of the destruction of certain wild animals.

Article 2(2) appoints 12^th March 2012 for the coming into operation of—

(a)

section 11 of the Act, so far as not already commenced by Article 2(1); and

(b)

Part 1 of Schedule 3, so far as it repeals section 21 of the Welfare of Animals Act (Northern Ireland) 1972.
