The Building Regulations (2009 Amendment Act) (Commencement No. 2) Order (Northern Ireland) 2012

This Order may be cited as the Building Regulations (2009 Amendment Act) (Commencement No. 2) Order (Northern Ireland) 2012.
Commencement
2.
The following provisions of the Building Regulations (Amendment) Act (Northern Ireland) 2009 shall come into operation on the 15th May 2012—
(a)
section 4(b) (Further provisions as to the making of building regulations, etc.);
(b)
section 5 (Guidance documents);
(c)
section 8 (Contravention notices); and
(d)
section 13 (Minor amendment).

The following provisions of the Building Regulations (Amendment) Act (Northern Ireland) 2009 shall come into operation on the 31st October 2012—
(a)
section 4(a) (Further provisions as to the making of building regulations, etc.); and
(b)
section 14 (Repeals).

This Order provides for the coming into operation on 15th May 2012 of sections 4(b), 5, 8 and 13 of the Building Regulations (Amendment) Act (Northern Ireland) 2009 (the 2009 Act).
Section 4(b) permits the Department to provide guidance in relation to compliance with the Building Regulations.
Section 5 sets out procedures under which guidance with respect to the requirements of building regulations is to be prepared and published.
Section 8 permits the Department to prescribe a period within which a district council may issue a contravention notice.
Section 13 removes the definition of “rack rent” from The Building Regulations (Northern Ireland) Order 1979 (the 1979 Order).
This Order also provides for the coming into operation on 31st October 2012 of sections 4(a) (removal of the deemed to satisfy provision) and 14 (Repeals) of the 2009 Act.
