EXPLANATORY NOTE

(This note is not part of the Order)

This Order revokes and remakes the Diseases of Animals (Importation of Machinery) Order (Northern Ireland) 1979 and prohibits the importation of any machinery or vehicles which have been in use on land in a third country or any member State outside Northern Ireland and the Republic of Ireland unless such machinery or vehicles have been thoroughly cleansed and disinfected as prescribed in the Schedule. Any machinery or vehicles used for the carriage of animals, poultry or eggs or by means of which disease may be carried or transmitted come under the control of this Order.

Where imported machinery or vehicles have not been satisfactorily cleansed and disinfected, an inspector may issue a notice requiring them to be exported, destroyed, or cleansed and disinfected (Article 3).

The use of disinfectant in a driver’s cab or a passenger compartment is not required (Article 4).

In a disease control situation the Department may require that machinery or vehicles be accompanied at the time of importation by a certificate signed on behalf of the competent authority of the exporting country to the effect that cleansing and disinfection have been carried out in accordance with this Order (Article 5).

Articles 3 and 5 of this Order do not apply to machinery or vehicles imported from the Republic of Ireland unless in the interest of preventing the introduction of disease, a direction is made by the Department (Article 6).

Revocations and savings are prescribed (Article 7).

Breach of the Order is an offence under Article 52 of the Diseases of Animals (Northern Ireland) Order 1981.
