That Part, which is inserted by Article 12 of the Road Traffic (Northern Ireland) Order 2007, provides that constables or vehicle examiners may impose a financial penalty deposit requirement on a person if the constable or vehicle examiner has reason to believe that the person is committing or has on that occasion committed an offence relating to a motor vehicle and the person, offence and circumstances in which the offence is committed are of a description specified in an order made by the Department of the Environment (“the Department”) (new Article 91B).</dc:description>

and</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-the-order">the Order</Term>” means the Road Traffic Offenders (Northern Ireland) Order 1996.</Text></Para></ListItem></UnorderedList></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2012-04-23"><Title>The specified person</Title><P1 DocumentURI="http://www.legislation.gov.uk/nisr/2012/17/article/2" IdURI="http://www.legislation.gov.uk/id/nisr/2012/17/article/2" id="article-2"><Pnumber>2</Pnumber><P1para><Text>The specified person for the purposes of Article 91B(2)(b) of the Order is the person in charge of the motor vehicle at the time at which the constable or vehicle examiner has reason to believe that a person is committing, or has on that occasion committed an offence specified in this Order relating to that vehicle.</Text></P1para></P1></P1group><P1group RestrictStartDate="2012-04-23"><Title>The specified offences</Title><P1 DocumentURI="http://www.legislation.gov.uk/nisr/2012/17/article/3" IdURI="http://www.legislation.gov.uk/id/nisr/2012/17/article/3" id="article-3"><Pnumber>3</Pnumber><P1para><Text>The specified offences for the purposes of Article 91B(2)(b) of the Order are set out in column one of the tables in the Schedule (the general nature of the offence is also indicated in column two).</Text></P1para></P1></P1group><P1group RestrictStartDate="2012-04-23"><Title>The specified circumstances</Title><P1 DocumentURI="http://www.legislation.gov.uk/nisr/2012/17/article/4" IdURI="http://www.legislation.gov.uk/id/nisr/2012/17/article/4" id="article-4"><Pnumber>4</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/nisr/2012/17/article/4/1" IdURI="http://www.legislation.gov.uk/id/nisr/2012/17/article/4/1" id="article-4-1"><Pnumber>1</Pnumber><P2para><Text>The specified circumstances for the purposes of Article 91B(2)(b) of the Order are that the offence is being committed, or has on that occasion been committed, on a road or other public place.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nisr/2012/17/article/4/2" IdURI="http://www.legislation.gov.uk/id/nisr/2012/17/article/4/2" id="article-4-2"><Pnumber>2</Pnumber><P2para><Text>In this Article,  “<Term id="term-road">road</Term>” has the meaning given in Article 2(2) of the Road Traffic (Northern Ireland) Order 1995 <CommentaryRef Ref="c21165751"/>.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2012-04-23"><Title>Manner of payment</Title><P1 DocumentURI="http://www.legislation.gov.uk/nisr/2012/17/article/5" IdURI="http://www.legislation.gov.uk/id/nisr/2012/17/article/5" id="article-5"><Pnumber>5</Pnumber><P1para><Text>Payment of the appropriate amount shall be made—</Text><P3 DocumentURI="http://www.legislation.gov.uk/nisr/2012/17/article/5/a" IdURI="http://www.legislation.gov.uk/id/nisr/2012/17/article/5/a" id="article-5-a"><Pnumber>a</Pnumber><P3para><Text>in person to the constable or vehicle examiner, by cash or credit or debit card, if the vehicle examiner or constable has the necessary means to accept payment in that manner;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nisr/2012/17/article/5/b" IdURI="http://www.legislation.gov.uk/id/nisr/2012/17/article/5/b" id="article-5-b"><Pnumber>b</Pnumber><P3para><Text>by telephone by credit or debit card, to the number on the document referred to in Article 91B(3) of the Order, if a number is so given; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nisr/2012/17/article/5/c" IdURI="http://www.legislation.gov.uk/id/nisr/2012/17/article/5/c" id="article-5-c"><Pnumber>c</Pnumber><P3para><Text>by any other means specified on the document referred to in Article 91B(3) of the Order.</Text></P3para></P3></P1para></P1></P1group><P1group RestrictStartDate="2012-04-23"><Title>Appropriate steps to make an appropriate refund</Title><P1 DocumentURI="http://www.legislation.gov.uk/nisr/2012/17/article/6" IdURI="http://www.legislation.gov.uk/id/nisr/2012/17/article/6" id="article-6"><Pnumber>6</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/nisr/2012/17/article/6/1" IdURI="http://www.legislation.gov.uk/id/nisr/2012/17/article/6/1" id="article-6-1"><Pnumber>1</Pnumber><P2para><Text>The appropriate steps to trace the person and to make an appropriate refund, for the purposes of Article 91D(9) of the Order are set out in paragraphs (2) and (3).</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nisr/2012/17/article/6/2" IdURI="http://www.legislation.gov.uk/id/nisr/2012/17/article/6/2" id="article-6-2"><Pnumber>2</Pnumber><P2para><Text>The Department shall—</Text><P3 DocumentURI="http://www.legislation.gov.uk/nisr/2012/17/article/6/2/a" IdURI="http://www.legislation.gov.uk/id/nisr/2012/17/article/6/2/a" id="article-6-2-a"><Pnumber>a</Pnumber><P3para><Text>attempt to contact the person (on whom the financial penalty requirement was imposed) at any address given in any response or in any document provided to a vehicle examiner or constable; but</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nisr/2012/17/article/6/2/b" IdURI="http://www.legislation.gov.uk/id/nisr/2012/17/article/6/2/b" id="article-6-2-b"><Pnumber>b</Pnumber><P3para><Text>if the attempt to contact that person is unsuccessful, and if a person other than that person made the payment, attempt to contact that other person, at any address or contact details given when the person made the payment.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nisr/2012/17/article/6/3" IdURI="http://www.legislation.gov.uk/id/nisr/2012/17/article/6/3" id="article-6-3"><Pnumber>3</Pnumber><P2para><Text>The means by which an appropriate refund can be made by the Department are—</Text><P3 DocumentURI="http://www.legislation.gov.uk/nisr/2012/17/article/6/3/a" IdURI="http://www.legislation.gov.uk/id/nisr/2012/17/article/6/3/a" id="article-6-3-a"><Pnumber>a</Pnumber><P3para><Text>by cheque;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nisr/2012/17/article/6/3/b" IdURI="http://www.legislation.gov.uk/id/nisr/2012/17/article/6/3/b" id="article-6-3-b"><Pnumber>b</Pnumber><P3para><Text>by refund to any credit or debit card used to make the financial penalty payment; That Part, which is inserted by Article 12 of the Road Traffic (Northern Ireland) Order 2007, provides that constables or vehicle examiners may impose a financial penalty deposit requirement on a person if the constable or vehicle examiner has reason to believe that the person is committing or has on that occasion committed an offence relating to a motor vehicle and the person, offence and circumstances in which the offence is committed are of a description specified in an order made by the Department of the Environment (“<Term>the Department</Term>”) (new Article 91B).</Text></Para></BlockText></P><P><BlockText><Para><Text>Articles 2 to 4<Emphasis>, </Emphasis>with the Schedule to this Order, specify the person, offences and circumstances in which a financial penalty deposit requirement can be imposed. Article 5 specifies the manner of payment.
