The Department for Social Development makes the following Order in exercise of the powers conferred by section 118(1) of the Pensions (No. 2) Act (Northern Ireland) 2008

Citation1.

This Order may be cited as the Pensions (2008 No. 2 Act) (Commencement No. 6) Order (Northern Ireland) 2011.

Commencement of provisions2.

The following provisions of the Pensions (No. 2) Act (Northern Ireland) 2008 shall come into operation on 3rd January 2012—

(a)

section 49 (monitoring of employers’ payments to personal pension schemes) in so far as it relates to the powers to make regulations under section 107A of the Pension Schemes Act

1993 c. 49; section 107A was inserted by Article 10 of the Welfare Reform and Pensions (Northern Ireland) Order 1999 (S.I. 1999/3147 (N.I. 11)) and amended by Article 245 of, and Schedule 11 to, the Pensions (Northern Ireland) Order 2005 (S.I. 2005/255 (N.I. 1)) and is amended by section 49 of the Pensions (No. 2) Act (Northern Ireland) 2008

, for the purposes only of making regulations;

(b)

section 83 (additional State Pension etc.: minor and consequential amendments) in so far as it relates to the provisions listed in paragraph (c), and

(c)

in Schedule 3 (additional State Pension etc.: minor and consequential amendments)—

(i)

paragraph 1 in so far as it relates to the provisions listed in sub-paragraphs (ii) to (xii) of this paragraph;

(ii)

paragraphs 2 and 3;

(iii)

paragraph 4(1) in so far as it relates to the provisions listed in sub-paragraph (iv) of this paragraph;

(iv)

paragraph 4(2) and (3), except for sub-paragraphs (2)(b) and (3)(b) in so far as they relate to Schedule 4C to the Contributions and Benefits Act

1992 c. 7; Schedule 4C is inserted by Schedule 2 to the Pensions (No. 2) Act (Northern Ireland) 2008

(additional pension consolidation);

(v)

paragraph 5;

(vi)

paragraph 6(1) in so far as it relates to paragraph 6(2);

(vii)

paragraph 6(2);

(viii)

paragraph 7, except for sub-paragraph (a);

(ix)

paragraph 8, except for sub-paragraph (a);

(x)

paragraph 9(1) in so far as it relates to the provisions listed in sub-paragraph (xi) of this paragraph;

(xi)

paragraph 9(2) and (3), except for sub-paragraph (2)(c), and

(xii)

paragraphs 11 and 12.

This Order brings section 49 of the Pensions (No. 2) Act (Northern Ireland) 2008 (“the Act”) into operation on 3rd January 2012, for the purpose only of conferring power to make regulations under section 107A of the Pension Schemes (Northern Ireland) Act 1993. Section 49 amends section 107A so that the term “employee” includes a “jobholder”.

The Order also brings into operation certain provisions of Schedule 3 to the Act (and section 83 in so far as it relates to those provisions) on 3rd January 2012. Those provisions make minor and consequential amendments to the Social Security Contributions and Benefits (Northern Ireland) Act 1992 in relation to retirement pensions under Part II of that Act.
