The Department of the Environment, in exercise of the powers conferred by Article 13 of the Planning (Northern Ireland) Order 19911, makes the following Order:

Citation and commencement1.

This Order may be cited as the Planning (General Development) (Amendment No. 2) Order (Northern Ireland) 2011 and shall come into operation on 30th December 2011.

Amendment of the Planning (General Development) Order (Northern Ireland) 19932.

In Part 5 (caravan sites) of Schedule 1 to the Planning (General Development) Order (Northern Ireland) 19932, in paragraph A.2 (interpretation of Part 5) for “paragraphs 2, 3 and 6 to 10” substitute “paragraphs 2 to 10”.

EXPLANATORY NOTE
(This note is not part of the Order)

This Order amends Part 5 of Schedule 1 to the Planning (General Development) Order (Northern Ireland) 1993. The amendment has the effect of adding paragraphs 4 and 5 of the Schedule to the Caravans Act (Northern Ireland) 1963 to the circumstances in which use of land as a caravan site is permitted under Part 5.

Part 5 of Schedule 1 describes permitted development rights in respect of the use of land as a caravan site. Where such rights apply, no specific application for planning permission is needed as permission is granted by Article 3 of that Order.
