The Department for Employment and Learning being a Department designated for the purposes of section 2(2) of the European Communities Act 1972(1) in relation to employment rights and duties(2), makes these Regulations—
(a)in exercise of the powers conferred by section 2(2) of the European Communities Act 1972 and Articles 17(1), (2) and (5), and 55(2) of, and paragraphs 6, 7 and 14(1) of Schedule 3 to, the Health and Safety at Work (Northern Ireland) Order 1978(3), (“the 1978 Order”); and
(b)independently of any proposals submitted by the Health and Safety Executive for Northern Ireland under Article 13(1A)(c) of the 1978 Order(4).
The Department for Employment and Learning has consulted the Health and Safety Executive for Northern Ireland and such other bodies as appear to the Department to be appropriate, as required by Article 46(1) of the 1978 Order(5).
