relating to the environment.</p><p>These Regulations make provision for a purpose mentioned in that section, and it appears to the Department that it is expedient for references to Annex I to the Regulations may be cited as the Ozone-Depleting Substances (Qualifications) Regulations (Northern Ireland) 2011, and shall come into operation on 31<sup>st</sup> July 2011.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>Interpretation</heading><num>2.</num><paragraph eId="regulation-2-1"><num>(1)</num><intro><p>In these Regulations—</p></intro><hcontainer name="definition"><content><p>“authorised person” means a person authorised under regulation 7(4);</p></content></hcontainer><hcontainer name="definition"><content><p>“competent” has the meaning given in regulation 3;</p></content></hcontainer><hcontainer name="definition"><content><p>“the EU Regulation” means Regulation <ref eId="c00001" href="http://www.legislation.gov.uk/european/regulation/2009/1005">(EC) No 1005/2009</ref> of the European Parliament and of the Council on substances that deplete the ozone layer<authorialNote class="footnote" eId="f00004" marker="4"><p>OJ No L286, 31.10.2009, p1, amended by Commission Regulation (EU) No 744/2010 (OJ No L 218, 19.08.2010, p2).</p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><content><p>“course of training” includes the training of an employee while that employee is engaged in work for which the employee is employed;</p></content></hcontainer><hcontainer name="definition"><content><p>“the Department” means the Department of the Environment;</p></content></hcontainer><hcontainer name="definition"><content><p>“employed” means employed under a contract of employment, and “employee” and “employer” shall be construed accordingly;</p></content></hcontainer><hcontainer name="definition"><content><p>“the enforcing authority” means the district council, or in a case where the Department makes a direction under regulation 7(2), the Department;</p></content></hcontainer><hcontainer name="definition"><content><p>“in-house qualification” means a qualification verified by a certificate of competence or other written confirmation issued by an employer to such of the employees of that employer who have successfully completed a course of training provided by that employer relating to relevant work; and</p></content></hcontainer><hcontainer name="definition"><content><p>“relevant work” has the meaning given in regulation 4.</p></content></hcontainer></paragraph><paragraph eId="regulation-2-2"><num>(2)</num><content><p>Expressions used in these Regulations and in the EU Regulation have the same meaning in these Regulations as they have in the EU Regulation.</p></content></paragraph><paragraph eId="regulation-2-3"><num>(3)</num><content><p>The Interpretation Act (Northern Ireland) 1954<authorialNote class="footnote" eId="f00005" marker="5"><p><ref eId="c00006" href="http://www.legislation.gov.uk/id/apni/1954/33">1954 c.33 (N.I.)</ref></p></authorialNote> shall apply to these Regulations as it applies to an Act of the Northern Ireland Assembly.</p></content></paragraph><paragraph eId="regulation-2-4"><num>(4)</num><content><p>References in these Regulations to “controlled substances” are references to those substances in 2018.</ins></p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-3"><heading>Meaning of “competent”</heading><num>3.</num><intro><p>For the purposes of these Regulations—</p></intro><level class="para1" eId="regulation-3-a"><num>(a)</num><content><p>a person is competent to carry out relevant work whilst performing a task specified in column 1 of the Table in the Schedule in respect of the equipment specified in the corresponding entry in column 2 of that Table if that person has obtained one of the qualifications specified in the corresponding entry in column 3 of that Table; and</p></content></level><level class="para1" eId="regulation-3-b"><num>(b)</num><content><p>a person is competent to carry out any other relevant work to which paragraph (a) does not apply, if that person has obtained an in-house qualification in respect of that other relevant work.</p></content></level></hcontainer><hcontainer name="regulation" eId="regulation-4"><heading>Meaning of “relevant work”</heading><num>4.</num><intro><p>In these Regulations, “relevant work” means any work which involves—</p></intro><level class="para1" eId="regulation-4-a"><num>(a)</num><content><p>recovering, recycling, reclaiming or destroying controlled substances; or</p></content></level><level class="para1" eId="regulation-4-b"><num>(b)</num><content><p>preventing and minimising the leakage of controlled substances.</p></content></level></hcontainer><hcontainer name="regulation" eId="regulation-5"><heading>Qualification and supervision</heading><num>5.</num><paragraph eId="regulation-5-1"><num>(1)</num><content><p>Subject to paragraph (3), no person may carry out any relevant work unless that person is competent to do so.</p></content></paragraph><paragraph eId="regulation-5-2"><num>(2)</num><content><p>The employer of a person employed to carry out relevant work must ensure that paragraph (1) is complied with.</p></content></paragraph><paragraph eId="regulation-5-3"><num>(3)</num><intro><p>A person who is not competent to carry out relevant work may carry out such work if the person does so—</p></intro><level class="para1" eId="regulation-5-3-a"><num>(a)</num><content><p>under the supervision of a person who is so competent; and</p></content></level><level class="para1" eId="regulation-5-3-b"><num>(b)</num><intro><p>with a view to obtaining—</p></intro><level class="para2" eId="regulation-5-3-b-i"><num>(i)</num><content><p>a qualification referred to in regulation 3(a); or</p></content></level><level class="para2" eId="regulation-5-3-b-ii"><num>(ii)</num><content><p>an in-house qualification.</p></content></level></level></paragraph><paragraph eId="regulation-5-4"><num>(4)</num><content><p>A person is guilty of an offence if the person fails to comply with paragraph (1), (2), or (3).</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-6"><heading>Training</heading><num>6.</num><paragraph eId="regulation-6-1"><num>(1)</num><content><p>A training employer must ensure that the course of training which the training employer provides will enable an employee who has been trained to carry out a relevant job satisfactorily.</p></content></paragraph><paragraph eId="regulation-6-2"><num>(2)</num><intro><p>In respect of each employee trained, a training employer must keep for the required period a record of—</p></intro><level class="para1" eId="regulation-6-2-a"><num>(a)</num><content><p>the name of the employee trained;</p></content></level><level class="para1" eId="regulation-6-2-b"><num>(b)</num><content><p>the training which the training employer provides;</p></content></level><level class="para1" eId="regulation-6-2-c"><num>(c)</num><content><p>the date the training employer provides such training; and</p></content></level><level class="para1" eId="regulation-6-2-d"><num>(d)</num><content><p>the date on which is issued the certificate of competence or other written confirmation that the course of training has been successfully completed.</p></content></level></paragraph><paragraph eId="regulation-6-3"><num>(3)</num><content><p>A training employer must provide a copy of the record referred to in paragraph (2) to the employee in question when requested to do so by that employee during the required period.</p></content></paragraph><paragraph eId="regulation-6-4"><num>(4)</num><content><p>A training employer commits an offence if the training employer fails to comply with paragraph (1), (2) or (3).</p></content></paragraph><paragraph eId="regulation-6-5"><num>(5)</num><intro><p>In this regulation—</p></intro><level class="para1" eId="regulation-6-5-a"><num>(a)</num><content><p>“relevant job” means relevant work not involving a task specified in column 1 of the Table in the Schedule in respect of the equipment specified in the corresponding entry in column 2 of that Table;</p></content></level><level class="para1" eId="regulation-6-5-b"><num>(b)</num><intro><p>“the required period” means both—</p></intro><level class="para2" eId="regulation-6-5-b-i"><num>(i)</num><content><p>the period during which the employee in question undergoes training provided by the training employer; and</p></content></level><level class="para2" eId="regulation-6-5-b-ii"><num>(ii)</num><content><p>the period during which the employee is employed by the training employer to carry out a relevant job; and</p></content></level></level><level class="para1" eId="regulation-6-5-c"><num>(c)</num><content><p>“training employer” means an employer who provides training leading to an in-house qualification.</p></content></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-7"><heading>Enforcement</heading><num>7.</num><paragraph eId="regulation-7-1"><num>(1)</num><content><p>Subject to paragraph (2), the district council must enforce these Regulations.</p></content></paragraph><paragraph eId="regulation-7-2"><num>(2)</num><intro><p>In relation to—</p></intro><level class="para1" eId="regulation-7-2-a"><num>(a)</num><content><p>cases of a particular description; or</p></content></level><level class="para1" eId="regulation-7-2-b"><num>(b)</num><content><p>a particular case,</p><p>the Department may direct that the duty imposed by paragraph (1) on the district council shall be discharged by it and not by the district council.</p></content></level></paragraph><paragraph eId="regulation-7-3"><num>(3)</num><content><p>The powers in article 72 (powers of enforcing authorities and persons authorised by them) of the Waste and Contaminated Land (Northern Ireland) Order 1997<authorialNote class="footnote" eId="f00006" marker="6"><p><ref eId="c00007" href="http://www.legislation.gov.uk/id/nisi/1997/2778">S.I. 1997/2778 (N.I. 19)</ref></p></authorialNote> apply in relation to these Regulations, and the powers of authorised persons in that article are exercisable by persons authorised by any enforcing authority.</p></content></paragraph><paragraph eId="regulation-7-4"><num>(4)</num><content><p>The enforcing authority may authorise in writing such persons as they consider appropriate to act for the purpose of enforcing these Regulations.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-8"><heading>Information notices</heading><num>8.</num><content><p>The enforcing authority may, by notice served on any person, require that person to furnish such information as is specified in the notice, in such form and within such period following the service of the notice or at such time as is so specified.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-9"><heading>Enforcement notices</heading><num>9.</num><paragraph eId="regulation-9-1"><num>(1)</num><content><p>If the enforcing authority is of the opinion that a person has contravened, is contravening or is likely to contravene these Regulations, the enforcing authority may serve on that person a notice (referred to in these Regulations as an “enforcement notice”).</p></content></paragraph><paragraph eId="regulation-9-2"><num>(2)</num><intro><p>An enforcement notice must—</p></intro><level class="para1" eId="regulation-9-2-a"><num>(a)</num><content><p>state that the enforcing authority is of that opinion;</p></content></level><level class="para1" eId="regulation-9-2-b"><num>(b)</num><content><p>specify the matters constituting the contravention or the matters making it likely that the contravention will arise, as the case may be;</p></content></level><level class="para1" eId="regulation-9-2-c"><num>(c)</num><content><p>specify the steps that must be taken to remedy the contravention or to remedy the matters making it likely that the contravention will arise, as the case may be; and</p></content></level><level class="para1" eId="regulation-9-2-d"><num>(d)</num><content><p>specify the period within which those steps must be taken.</p></content></level></paragraph><paragraph eId="regulation-9-3"><num>(3)</num><content><p>The period referred to in paragraph (2)(d) must not end earlier than the period within which an appeal may be brought under regulation 10.</p></content></paragraph><paragraph eId="regulation-9-4"><num>(4)</num><content><p>The enforcing authority may withdraw an enforcement notice at any time.</p></content></paragraph><paragraph eId="regulation-9-5"><num>(5)</num><content><p>A person on whom an enforcement notice is served must comply with that enforcement notice at that person’s own expense.</p></content></paragraph><paragraph eId="regulation-9-6"><num>(6)</num><intro><p>Where steps required by an enforcement notice have not been taken or not taken within the period allowed for compliance with the enforcement notice, the enforcing authority may—</p></intro><level class="para1" eId="regulation-9-6-a"><num>(a)</num><content><p>enter the land and take the steps specified in the enforcement notice; and</p></content></level><level class="para1" eId="regulation-9-6-b"><num>(b)</num><content><p>recover from the person who is then the owner, any expenses reasonably incurred by it in doing so and those expenses shall be a civil debt recoverable summarily.</p></content></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-10"><heading>Appeals against enforcement notices</heading><num>10.</num><paragraph eId="regulation-10-1"><num>(1)</num><content><p>A person who is aggrieved by an enforcement notice may appeal to a court of summary jurisdiction.</p></content></paragraph><paragraph eId="regulation-10-2"><num>(2)</num><content><p>The procedure on an appeal is by way of notice under Part VII of the Magistrates’ Courts (Northern Ireland) Order 1981<authorialNote class="footnote" eId="f00007" marker="7"><p><ref eId="c00008" href="http://www.legislation.gov.uk/id/nisi/1981/1675">S.I. 1981/1675 (N.I. 26)</ref></p></authorialNote>.</p></content></paragraph><paragraph eId="regulation-10-3"><num>(3)</num><content><p>The period within which an appeal may be brought is 28 days from the date upon which the enforcement notice was issued.</p></content></paragraph><paragraph eId="regulation-10-4"><num>(4)</num><intro><p>An enforcement notice must state—</p></intro><level class="para1" eId="regulation-10-4-a"><num>(a)</num><content><p>that the person on whom the notice in question is served has the right of appeal; and</p></content></level><level class="para1" eId="regulation-10-4-b"><num>(b)</num><content><p>the period in which the appeal may be brought.</p></content></level></paragraph><paragraph eId="regulation-10-5"><num>(5)</num><content><p>Where an appeal is brought against an enforcement notice, that notice must be of no effect pending the final determination or the withdrawal of the appeal.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-11"><heading>Enforcement by the High Court</heading><num>11.</num><content><p>If the enforcing authority is of the opinion that proceedings against a person for an offence under regulation 12(f) would afford an ineffectual remedy against that person, the enforcing authority may take proceedings in the High Court for the purpose of securing compliance with that notice.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-12"><heading>Additional offences</heading><num>12.</num><intro><p>A person commits an offence if that person—</p></intro><level class="para1" eId="regulation-12-a"><num>(a)</num><content><p>intentionally obstructs an authorised person acting in the implementation of these Regulations;</p></content></level><level class="para1" eId="regulation-12-b"><num>(b)</num><content><p>without reasonable cause, fails to give to an authorised person acting in the implementation of these Regulations any assistance or information that that person may reasonably require under these Regulations;</p></content></level><level class="para1" eId="regulation-12-c"><num>(c)</num><content><p>furnishes to an authorised person acting in the implementation of these Regulations any information, knowing it to be false or misleading;</p></content></level><level class="para1" eId="regulation-12-d"><num>(d)</num><content><p>fails to produce a document or record when required to do so to an authorised person acting in the implementation of these Regulations;</p></content></level><level class="para1" eId="regulation-12-e"><num>(e)</num><content><p>fails to comply with the requirements of an information notice;</p></content></level><level class="para1" eId="regulation-12-f"><num>(f)</num><content><p>fails to comply with the requirements of an enforcement notice;</p></content></level><level class="para1" eId="regulation-12-g"><num>(g)</num><content><p>intentionally prevents any other person from appearing before an authorised person to provide information, or to answer questions for which an authorised person may require an answer.</p></content></level></hcontainer><hcontainer name="regulation" eId="regulation-13"><heading>Offences by bodies corporate</heading><num>13.</num><paragraph eId="regulation-13-1"><num>(1)</num><content><p>For the purposes of these Regulations, section 20(2) of the Interpretation Act (Northern Ireland) 1954<authorialNote class="footnote" eId="f00008" marker="8"><p><ref eId="c00009" href="http://www.legislation.gov.uk/id/apni/1954/33">1954 c.33 (N.I.)</ref></p></authorialNote> applies with the omission of the words “the liability of whose members is limited”, and where affairs of a body corporate are managed by its members, applies in relation to acts or defaults of a member in connection with the functions of management as if that person were a Director of the body corporate.</p></content></paragraph><paragraph eId="regulation-13-2"><num>(2)</num><intro><p>If an offence committed by a partnership is shown—</p></intro><level class="para1" eId="regulation-13-2-a"><num>(a)</num><content><p>to have been committed with the consent or connivance of a partner; or</p></content></level><level class="para1" eId="regulation-13-2-b"><num>(b)</num><content><p>to be attributable to any neglect on the part of a partner,</p><p>the partner as well as the partnership is guilty of the offence and liable to be proceeded against and punished accordingly.</p></content></level></paragraph><paragraph eId="regulation-13-3"><num>(3)</num><content><p>Proceedings for an offence alleged to have been committed by an unincorporated association must be brought in the name of the association and not in the name of any of its members.</p></content></paragraph><paragraph eId="regulation-13-4"><num>(4)</num><content><p>A fine imposed on an unincorporated association on its conviction for an offence must be paid out of the funds of the association.</p></content></paragraph><paragraph eId="regulation-13-5"><num>(5)</num><intro><p>If an offence committed by an unincorporated association, other than a partnership, is shown—</p></intro><level class="para1" eId="regulation-13-5-a"><num>(a)</num><content><p>to have been committed with the consent or connivance of an officer of the association or a member of its governing body; or</p></content></level><level class="para1" eId="regulation-13-5-b"><num>(b)</num><content><p>to be attributable to any neglect on the part of such an officer or member,</p><p>the officer or member as well as the association is guilty of the offence and liable to be proceeded against and punished accordingly.</p></content></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-14"><heading>Penalties</heading><num>14.</num><intro><p>A person guilty of an offence under these Regulations is liable—</p></intro><level class="para1" eId="regulation-14-a"><num>(a)</num><content><p>on summary conviction, to a fine not exceeding the statutory maximum; or</p></content></level><level class="para1" eId="regulation-14-b"><num>(b)</num><content><p>on conviction on indictment, to a fine.</p></content></level></hcontainer><hcontainer name="regulation" eId="regulation-15"><heading>Application to the Crown</heading><num>15.</num><paragraph eId="regulation-15-1"><num>(1)</num><content><p>Subject to the provisions of this Regulation, these Regulations bind the Crown.</p></content></paragraph><paragraph eId="regulation-15-2"><num>(2)</num><content><p>No act or omission done or suffered by or on behalf of the Crown constitutes an offence under these Regulations, but the High Court may, on the application of the Department, declare unlawful any act or omission of the Crown which constitutes such contravention.</p></content></paragraph><paragraph eId="regulation-15-3"><num>(3)</num><content><p>Notwithstanding paragraph (2), these Regulations must apply to persons in the public service of the Crown as they apply to other persons.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-16"><heading>Revocation</heading><num>16.</num><content><p>The Ozone Depleting Substances (Qualifications) Regulations (Northern Ireland) 2006<authorialNote class="footnote" eId="f00009" marker="9"><p><ref eId="c00010" href="http://www.legislation.gov.uk/id/nisr/2006/321">S.R. 2006 No. class="explanatoryNote"><heading>EXPLANATORY NOTE</heading><subheading>(This note is not part of the Regulations)</subheading><blockContainer ukl:Name="P"><p>These Regulations give effect to the provisions in Articles 22.5 and 23.4, first paragraph, of Regulation (EU) No 1005/2009 of the European Parliament and of the Council on substances that deplete the ozone layer (OJ No L 286, 31.10.2009), as amended by Commission Regulation (EU) No 744/2010 (OJ No L 218, 19.8.2010, p2) (together “the EU Regulation”).</p></blockContainer><blockContainer ukl:Name="P"><p>These Regulations relate to minimum qualifications for those working on the recovery, recycling, reclamation or destruction of controlled substances and the prevention and minimising of leakages of controlled substances. The terms “controlled substances”, “recovery”, “recycling” and “reclamation” are defined in Article 3 of the EU Regulation.</p></blockContainer><blockContainer ukl:Name="P"><p>Under regulation 5, it is an offence for a person to carry out relevant work involving controlled substances unless that person is competent to do so. The terms “competent” and “relevant work” are defined in regulations 3 and 4 respectively. Details of the qualifications which a person needs in order to carry out certain types of relevant work are contained in the table in the Schedule.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 5 also contains provisions making it an offence for an employer to employ a person to carry out relevant work unless that person is competent to do so. Provisions about training are contained in regulation 6.</p></blockContainer><blockContainer ukl:Name="P"><p>Provision is made in regulation 7 for the appointment of persons (“authorised persons”) to enforce these Regulations. Provisions setting out the powers of authorised persons are also contained in regulation 7. Details of information notices and enforcement notices, which the enforcing authority can use to help ensure that the Regulations are complied with, are contained in Regulations 8 to 10.
