The Secretary of State in exercise of the powers conferred on him by section 56(2) of the Police (Northern Ireland) Act 19981 hereby makes the following amending Order.

Citation and commencement

This Order may be cited as the Police and Criminal Evidence (Application to the Police Ombudsman)(Amendment) Order (Northern Ireland) 2010 and shall come into operation on 24th March 2010.

The Police and Criminal Evidence (Application to the Police Ombudsman) Order (Northern Ireland) 20092 shall be amended as follows—

a

In Article 3(1) omit “by the police”;

b

In Article 3(2) omit “Part II”;

c

In Schedule 2 omit the introductory words “Where in the 1989 Order” to the end.

EXPLANATORY NOTE

This Order sets out amendments to The Police and Criminal Evidence (Application to the Police Ombudsman) Order (Northern Ireland) 2009, which came into operation on 18 May 2009. The amendments have been made to rectify drafting errors in three respects as reported by the Joint Committee on Statutory Instruments in its 16th report of Session 2008-09.

There is no change to the policy as provided for in the Order which came into operation in May 2009.
