PART 4RECALLED PRISONERS

Recalled life, indeterminate and extended custodial prisoners

25.  Where the Secretary of State refers a life prisoner’s case to the Commissioners under Article 9(4) of the 2001 Order or an indeterminate custodial or extended custodial prisoner’s case to the Commissioners under Article 28(4) of the 2008 Order, these rules shall apply subject to the following modifications:

(a)rules 6, 7(4), (7), (9) and (10), 8(1), 9(3), 10, 12(1), 13(1), (3) and (6), 14(3), (4), (5) and (7), 15(3) and (4), 18(3), (4), (5), (7)(b) and (10), 20(2), 21 and 24(2) shall apply as if for references to the periods of time specified there were substituted a reference to such period of time as the Commissioners, the single Commissioner or the chairman of the panel shall determine, taking account of both the desirability of reaching an early decision in the prisoner’s case and the need to ensure fairness to the prisoner; and

(b)rule 8(1) shall apply as if for the reference to the information and reports specified in Schedule 1 there were substituted a reference to the information and reports specified in Schedule 2.
