Coming into operation

The Department of Agriculture and Rural Development is a department designated 1 for the purposes of section 2(2) of the European Communities Act 19722 in relation to the common agricultural policy of the European Community.

These Regulations make provision for a purpose mentioned in section 2(2) of that Act and it appears to the Department that it is expedient for references to Regulation (EC) No 2160/2003 of the European Parliament and of the Council on the control of salmonella and other specified food-borne zoonotic agents3 and for certain provisions of other Community instruments to be construed as references to that Regulation and those provisions as amended from time to time.

The Department of Agriculture and Rural Development makes the following Regulations in exercise of the powers conferred by section 2(2) of, as read with paragraph 1A of Schedule 24 to, the European Communities Act 1972 and section 56(1), (2) and (5) of the Finance Act 19735.

In accordance with section 56(1) and (5) of the Finance Act 1973, the Department of Finance and Personnel consents to the making of these Regulations.

Citation, commencement and interpretation1

These Regulations may be cited as the Zoonoses and Animal By-Products (Fees) (Amendment) Regulations (Northern Ireland) 2009 and shall come into operation on 22nd October 2009.

The Interpretation Act (Northern Ireland) 19546 applies to these Regulations as it applies to an Act of the Assembly.

Amendment of the Zoonoses and Animal By-Products (Fees) Regulations (Northern Ireland) 20082

The Zoonoses and Animal By-Products (Fees) Regulations 20087 are amended in accordance with paragraphs (2) to (4).

The fees specified in column (2) of the Schedule shall be paid to the Department by the person specified in column (3) in respect of the activities specified in column (1) and shall be paid within 14 days of demand.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations, which apply in Northern Ireland, amend the Zoonoses and Animal By-Products (Fees) Regulations (Northern Ireland) 2008.

They make provision for the Department to charge fees for activities required under Commission Regulation (EC) No 1003/2005, Commission Regulation (EC) No. 1168/2006, Commission Regulation (EC) No. 646/2007, Regulation (EC) No 2160/2003 and the Animal By-Products Regulations (Northern Ireland) 2003. The activities and the fees are listed in the Schedule.

A regulatory impact assessment, which includes compliance cost assessment of the effect that these Regulations are likely to have on business costs, has been placed in the Library of the Assembly.
