The Department of Agriculture and Rural Development is a Department designated for the purposes of section 2(2) of the European Communities Act 1972 as read with paragraph 1A of Schedule 2 to that Act, in relation to the common agricultural policy of the European Community, and to measures in the veterinary and phytosanitary fields for the protection of public health.

These Regulations make provision for a purpose mentioned in that section and it appears to the Department of Agriculture and Rural Development that it is expedient for the reference to Council Directive 91/414/EEC concerning the placing of plant protection products on the market, to be construed as a reference to that Directive as amended from time to time.

 The Department of Agriculture and Rural Development makes the following Regulations in exercise of the powers conferred by that section. Citation, commencement and interpretation 1 1 These Regulations may be cited as the Plant Protection Products (Amendment No 2) Regulations (Northern Ireland) 2008 and shall come into operation on 12th January 2009. 2 The Interpretation Act (Northern Ireland) 1954 shall apply to these Regulations as it applies to an Act of the Northern Ireland Assembly. Amendment of the Plant Protection Products Regulations (Northern Ireland) 2005 2 1 The Plant Protection Products Regulations (Northern Ireland) 2005 shall be amended in accordance with paragraphs (2) and (3). 2 In regulation 2(1) (interpretation), for the definition of “the Directive” substitute— “the Directive” means Council Directive 91/414/EEC concerning the placing of plant protection products on the market, as amended from time to time; 3 Schedule 1 (instruments amending Council Directive 91/414/EEC) is revoked. Revocation 3 The Plant Protection Products (Amendment) Regulations (Northern Ireland) 2008 are revoked. These Regulations amend the Plant Protection Products Regulations (Northern Ireland) 2005 (S.R. 2005 No. 526) (“the principal Regulations”) which implement in Northern Ireland Council Directive 91/414/EEC (O.J. No. L230, 19.8.91, p1) to be read with the Corrigenda published in O.J. No. L170, 25.6.92, p. 40) concerning the placing of plant protection products on the market (“the Directive”), as amended.

A new definition of the Directive is substituted to the effect that references to the Directive are references to it as amended from time to time (regulation 2(2)). Schedule 1 to the principal Regulations, which sets out the instruments that amend the Directive, is revoked (regulation 2(3)). Regulation 3 revokes the Plant Protection Products (Amendment) Regulations (Northern Ireland) 2008, the main purpose of which was to amend the definition of “the Directive” in the principal Regulations so as to implement specified Commission Directives.
