The Avian Influenza (Miscellaneous Amendments) Regulations (Northern Ireland) 2008

The Department of Agriculture and Rural Development, being designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the common agricultural policy of the European Community, makes the following Regulations in exercise of the powers conferred on it by that section.

Citation commencement and interpretation

1.—(1) These Regulations may be cited as the Avian Influenza (Miscellaneous Amendments) Regulations (Northern Ireland) 2008 and come into operation on 29th May 2008.

(2) The Interpretation Act (Northern Ireland) 1954(3) shall apply to these Regulations as it applies to an Act of the Assembly.

Amendment

2.—(1) After Regulation 15(2)(j) of The Avian Influenza (H5N1 in Poultry) Regulations (Northern Ireland) 2007(4) insert—

(ja)raw petfood, within the meaning of paragraph 48 of Annex I to Regulation (EC) No. 1774/2002, which complies with the requirements in Part B of Chapter II of Annex VIII to that Regulation;.

(2) After paragraph 1(2)(j) of Part IV of Schedule 1 to The Avian Influenza (H5N1 in Wild Birds) Regulations (Northern Ireland) 2007(5) insert—

(ja)raw petfood, within the meaning of paragraph 48 of Annex I to Regulation (EC) No. 1774/2002, which complies with the requirements in Part B of Chapter II of Annex VIII to that Regulation;.

(3) In regulation 5 of The Avian Influenza (Preventive Measures) Regulations (Northern Ireland) 2007(6)—

(a)After paragraph (1) insert—

(1A) The keeper of poultry on any premises shall notify the Department, in writing, details of the particulars referred to in paragraph (1) within 30 days of the Department requesting such information by notice..

(b)In paragraph (2) for the words “ paragraphs (1), (3) and (4)” substitute the words—

paragraphs (1), (1A), (3) and (4).

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Avian Influenza (H5N1 in Poultry) Regulations (Northern Ireland) 2007 (S.R. 2007 No. 207) and the Avian Influenza (H5N1 in Wild Birds) Regulations 2007 (S.R. 2007 No. 208) to add raw petfood to the lists of by-products which can be moved under the authority of a licence issued by the Department under these Regulations. The Regulations also amend the Avian Influenza (Preventive Measures) Regulations 2007 (S.R. 2007 No. 70) to require that the keeper of poultry notifies the Department in writing of details of the particulars notified to the Department under regulation 5(1) within 30 days of any request by notice from the Department.

A Regulatory Impact Assessment has not been produced for this rule as no additional impact on the private or voluntary sectors are foreseen.
