ENVIRONMENTAL PROTECTION

The Deposits in the Sea (Amendment) Regulations (Northern Ireland) 2007

The Department of the Environment makes the following Regulations in exercise of the powers conferred by sections 7(1) and (2) and 25(3) of the Food and Environment Protection Act 1985(1).

Citation and commencement

1.—(1) These Regulations may be cited as the Deposits in the Sea (Amendment) Regulations (Northern Ireland) 2007, and shall come into operation on 29 January 2007.

(2) The Interpretation Act (Northern Ireland) 1954(2) shall apply to the Regulations as it applies to an Act of the Northern Ireland Assembly.

Amendment to Deposits in the Sea (Exemptions) Order (Northern Ireland) 1995

2.—(1) Article 4 of the Deposits in the Sea (Exemptions) Order (Northern Ireland) 1995(3) shall be amended as follows.

(2) In paragraph (1)(a)(ii),the word “and” shall be deleted.

(3) In paragraph (1) (b),for “interest.” there shall be substituted “interest; and”.

(4) After paragraph (1b),there shall be inserted the following sub-paragraph-

(c)that operation does not involve the recovery or disposal of hazardous waste as defined by regulations 2(1) and 6 of the Hazardous Waste Regulations (Northern Ireland) 2005(4)..

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Deposits in the Sea Exemptions Order (Northern Ireland) 1995 by inserting a further limitation on the application of the exemption viz the exemption shall only apply where the operation does not involve the recovery of disposal of hazardous waste as defined by regulations 2(1) and 6 of the Hazardous Waste Regulations (Northern Ireland 2005).
