The Disability Discrimination (2006 Order) (Commencement No. 3) Order (Northern Ireland) 2007

The Office of the First Minister and deputy First Minister makes the following Order in exercise of the powers conferred by Article 1(2) of the Disability Discrimination (Northern Ireland) Order 20061:

Citation and interpretation1.

(1)

This Order may be cited as the Disability Discrimination (2006 Order) (Commencement No.3) Order (Northern Ireland) 2007.

(2)

In this Order—

“the Order” means the Disability Discrimination (Northern Ireland) Order 2006; and

“the 1995 Act” means the Disability Discrimination Act 19952.

Appointed day2.

The day appointed for the coming into operation of the following provisions of the Order is 31st October 2007—

(a)

Article 18 (meaning of “disability”) to the extent that it is not already in operation;

(b)

paragraphs 2, 26, 27, 28, and 32 of Schedule 1 (minor and consequential amendments) and Article 19(1) in so far as it relates to those entries;

(c)

paragraph 3 of Schedule 1 (minor and consequential amendments) to the extent that it is not already in operation and Article 19(1) in so far as it relates to that entry;

(d)

the entries in Schedule 2 (repeals) in respect of paragraphs 1(1) of Schedule 1 and 2(1) of Schedule 8 to the 1995 Act and Article 19(2) in so far as it relates to those entries.

EXPLANATORY NOTE

(This note is not part of the Order)

This is the third Commencement Order to be made under the Disability Discrimination (Northern Ireland) Order 2006 (“the Order”). The Order extensively amends the Disability Discrimination Act 1995 (“the 1995 Act”).

Article 2 brings into operation the Order’s provisions on the meaning of disability, specified paragraphs of Schedule 1 (minor and consequential amendments) and specified entries in Schedule 2 (repeals).

The provisions of the Disability Discrimination (Northern Ireland) Order 2006 listed in the table below have been brought into operation by Commencement Orders made before the date of this Order.
