Citation, commencement and interpretation1These Regulations may be cited as the Student Fees (Qualifying Courses and Persons) Regulations (Northern Ireland) 2007 and shall come into operation on 1st ChangeId="key-843ac557f76a16924e99255490803bd6-1740995573644" CommentaryRef="key-843ac557f76a16924e99255490803bd6">the standard of which is not higher than a first degree which leads to qualification as a veterinary surgeon, and</Addition></Text></Para></ListItem><ListItem><Para><Text><Addition ChangeId="key-843ac557f76a16924e99255490803bd6-1740995573644" CommentaryRef="key-843ac557f76a16924e99255490803bd6">where a first degree or equivalent qualification would normally be required for entry to the course;</Addition> </Text></Para></ListItem></OrderedList></Para></ListItem><ListItem><Para><Text>“previous Regulations” has the meaning given in regulation 2 (1) of the Student Support Regulations;</Text></Para></ListItem><ListItem><Para><Text>“publicly-funded” has the meaning given in regulation 2 (1) of the Student Support Regulations;</Text></Para></ListItem><ListItem><Para><Text>“single course” means a course to which regulation 6(4) of the Student Support Regulations applies and which falls within the description of a course in that regulation.</Text></Para></ListItem><ListItem><Para><Text> <Addition ChangeId="M_F_44d8c278-6bd2-4380-efff-2da658a92de4-1712230015395" CommentaryRef="M_F_44d8c278-6bd2-4380-efff-2da658a92de4">“the Islands” means the Channel Islands and the Isle of Man</Addition> </Text></Para></ListItem></UnorderedList></P1para></P1></P1group><P1group RestrictExtent="N.I." RestrictStartDate="2007-09-01"><Title>Revocation3The Student Fees (Qualifying Courses and Persons) Regulations (Northern Ireland) 2006 are revoked.Prescribed description of a qualifying course41A qualifying course which is prescribed for the purposes of Article 4 of the Order is a course of higher education which, subject to paragraph (3), is a course which is designated for the purposes of Article 3 of the Education (Student Support) (Northern Ireland) Order 1998 on the first day of an academic year which begins during the grant period and is provided by an institution in Northern Ireland.2For the purposes of paragraph (1) the reference to an institution in Northern Ireland means an institution whose activities are carried out in Northern Ireland.3A course is not a qualifying course if at the time the qualifying person received an offer of a place on that course the institution providing it was not publicly-funded.Prescribed description of a qualifying person51A qualifying person who is prescribed for the purposes of Article 4 of the Order is a person who falls within the Schedule on the first day of an academic year which begins during the grant period, other than—aa person who is not eligible for support under the Student Support Regulations by reason of regulation 5(3)(c), (d), (e), (f) or (g) of those Regulations, orba person mentioned in paragraph (2) or (6); orca person who is ordinarily resident in England, Wales, Scotland or the Islands and does not fall within paragraph 4, 4A 4B, 4C, 4D, 4E, 4F, 4G, 4H, 4I, 5, 6, 6A, 6B, 7, 7A, 10, 10A, 11 or 12 of the Schedule.1ZASubject to paragraphs (1) and (1C), a qualifying person is a person who—afalls within a settled category or a protected category—ion the course start date, where the relevant academic year is the first academicyear of the person’s course, oriiotherwise, on the first day of a relevant academic year;bfalls within a prescribed category on the first day of a relevant academic year.1ZBParagraph (1ZA) includes a person who undertakes a qualifying course in an academic year which began before 1st September 2024 but who nevertheless falls within a settled category, a protected category or a prescribed category on the first day of an academic year commencing on or after that date.1AIn this regulation, subject to paragraph (1C), “prescribed category” means any category of person described—ain paragraphs 2, ... 3, ... 6A, 6B, 7A, ... 9ZA, 9ZB, 9ZC, 9ZD, 9B, 10A, 12 or 13 in ... the Schedule; orbin paragraphs 6, 7, 8, 9, 9A, 10 or 11 in ... the Schedule where paragraph (1B) applies.1BThis paragraph applies—awhere in connection with a qualifying course beginning before 1st August 2021, a person (“A”) was a qualifying person by virtue of falling within any category of persons described in paragraphs 6, 7, 8, 9, 9A, 10 or 11 in ... the Schedule in relation to an academic year beginning before 1st August 2021; andbA is undertaking an academic year of that qualifying course, or of a qualifying course to which A transfers from that qualifying course.1CIn relation to a qualifying course which begins on or after 1st January 2028, paragraph (1A)(a) has effect as if paragraphs 8A and 9ZB were omitted.1DFor the purposes of this regulation, where—aa person becomes, after the course start date or on the first day of an academic year of the course, a person who no longer falls within a paragraph of the Schedule as a result of that person’s leave to remain, or the leave to remain of that person’s spouse, civil partner or parent, as the case may be, having expired; andbfurther leave to remain has been granted or the person whose leave to remain has expired has become a British or Irish citizen,the person who would otherwise no longer fall within a paragraph of the Schedule is to be treated as falling within the paragraph of the Schedule in which they previously fell for the remainder of the duration of the course.2Subject to the exception in paragraphs (3) to (5), a person is not a qualifying person if—ahe has an honours degree from an institution in the United Kingdom; orbhe has an honours degree from an institution in the Republic of Ireland,for which he received financial support under previous Regulations for some or all of the academic years during which he took the course leading to the award of the honours degree.3Paragraph (2) does not apply where—athe qualifying course is a course for the initial training of teachers;bthe duration of the course does not exceed two years (the duration of a part-time course being expressed as its full-time equivalent); andcthe qualifying person is not a qualified teacher.3AParagraph (2) does not apply where the qualifying course is a graduate entry course.4Paragraph (2) does not apply in respect of any part of a single course where—athe single course leads to an honours degree being conferred on the qualifying person from an institution in the United Kingdom or a relevant institution of higher education in the Republic of Ireland before the final degree or equivalent qualification; andbthe qualifying person only has an honours degree which was received as part of that single course.5Paragraph (2) does not apply where the qualifying course is a course leading to a degree in social work at an educational institution in Northern Ireland6 Subject to paragraphs 8 to 10 where an event occurs in the course of an academic year and as a result a person falls within the Schedule in the course of an academic year, he is not a qualifying person in respect of the academic year in which the relevant event occurred or any previous academic year.7In this regulation “a relevant institution of higher education in the Republic of Ireland” has the same meaning as in the Student Support Regulations.8Where a protected category event occurs in relation to a person after the course start date, paragraph (9) applies for the purposes of determining whether the person falls within a protected category on the first day of the relevant academic year.9The person is, for the purposes of determining whether they satisfy any requirement in the Schedule that they are ordinarily resident in the United Kingdom on the course start date, to be treated as if the person was, on the course start date, lawfully residing in the place where the person was residing on that date.10For the purposes of this regulation—“protected category” means any category of persons described in paragraph 4, 4A, 4B, 4C, 4D, 4E, 4F, 4G, 4H,4I or 5 of the Schedule;“protected category event” means —athe student or the student’s spouse, civil partner or parent is recognised as a refugeeor becomes a person granted humanitarian protection or becomes a person grantedstateless leave or becomes a person with leave to enter or remain on the grounds ofdiscretionary leave;bthe student becomes a person granted section 67 leave;cthe student becomes a person granted Calais leave;dthe student or the student’s parent becomes a person granted indefinite leave to remain as a bereaved partner;ethe student or the student’s parent becomes a person granted indefinite leave to enter or remain as a victim of domestic violence or domestic abuse;fthe student or the student’s spouse, civil partner or parent becomes a person granted leave under one of the Afghan Schemes; orgthe student or the student’s spouse, civil partner or parent becomes a person granted leave under one of the Ukraine Schemes.“relevant academic year” means an academic year beginning on or after 1st September 2024;“settled category” means any category of persons described in paragraph 2A or 8A of the Schedule.Transitional Cases61Where a qualifying person, disregarding any intervening vacation, begins an end-on course within the meaning of regulation 2(1) of the Education (Student Support) Regulations (Northern Ireland) 2006 immediately after a qualifying course (“the relevant course”) in a case where paragraph (3) or (4) applies, the end-on course shall be treated as if the offer for it had been received on the same date as the offer for the relevant course.2In a case where paragraph (3) or (4) applies, where a qualifying person undertakes a qualifying course (“the relevant course”) which is a single course, an offer received for any part of the relevant course shall be treated as if it had been received on the same date as the offer for the first part of the relevant course.3This paragraph applies where—athe qualifying person had on or before 1st August 2005 received an offer, whether conditional on obtaining specified qualifications or not, of a place on the relevant course, or a similar course, andbthe first academic year of the relevant course begins before 1st September 2007.4This paragraph applies where—athe qualifying person had received an offer of a place on a qualifying course (whether or not at the same institution as the relevant course) the first academic year of which began before 1st September 2006,bhe was unable to take up the offer because a specified qualification or grade was not awarded to him,che appealed against the decision not to award him the qualification or grade,dthe appeal was allowed after the last date on which he could have taken up the offer,eas a result he was offered a place on the relevant course, andfthe first academic year of the relevant course begins after 31st August 2006 but before 1st September 2007.5For the purpose of paragraph (3)(a) a course (“the original course”) is similar to the relevant course if—ait appears to the governing body of the institution providing the relevant course that the subject matter of the course is in whole or in part the same as the subject matter of the original course, andbexcept where the Rights Regulations” means the Citizens’ Rights (Application Deadline and Temporary Protection) (EU Exit) Regulations 2020; “academic year” means the period of twelve months beginning on 1st January, 1st April, 1st July or 1st September of the calendar year in which the academic year of the course in question begins according to whether that academic year begins on or after 1st January and before 1st April, on or after 1st April and before 1st July, on or after 1st July and before 1st August or on or after 1st August and on or before 31st December, respectively;“Directive 2004/38” means Directive 2004/38/EC of the European Parliament and of the Council of 29th April 2004 on the rights of citizens of the Union and their family members to move and reside freely in the territory of the Member States;“ EU national” means a national of a Member State of the European Community;“EEA Agreement” means the Agreement on the European Economic Area signed at Oporto on 2nd May 1992 as adjusted by the Protocol signed at Brussels on 17th March 1993; “EEA EFTA separation agreement” has the meaning given by section 39(1) of the European Union (Withdrawal Agreement) Act 2020; “EEA frontier self-employed person” means an EEA national who—is a self-employed person in the United Kingdom; andresides in Switzerland or the territory of an EEA State... and returns to his residence in Switzerland or that EEA State daily or at least once a week;“EEA frontier worker” means an EEA national who—is a worker in the United Kingdom; andresides in Switzerland or the territory of an EEA State ...and returns to his residence in Switzerland or that EEA State daily or at least once a week;“EEA migrant worker” means an EEA national who is a worker, other than an EEA frontier worker, in the United Kingdom;“EEA national” means a national of an EEA State ...;“EEA self-employed person” means an EEA national who is a self-employed person, other than an EEA frontier self-employed person, in the United Kingdom;“employed person” means an employed person with the meaning of Annex 1 to the Swiss Agreement;“employment” means full-time or part-time employment;“European Community” means the territory comprised by the Member States of the European Community as constituted from time to time;“European Economic Area” means the area comprised by the EEA States; “evacuated or assisted British national from Afghanistan” means a person—who is a British citizen, a British overseas territories citizen, a British National (Overseas), a British Overseas citizen, a British subject under the British Nationality Act 1981 or a British protected person within the meaning of that Act;who was either—evacuated from Afghanistan by or on behalf of the United Kingdom, a North Atlantic Treaty Organisation member state, Pakistan, Uzbekistan, Tajikistan, Iran or Qatar during the period of the operation known as Operation Pitting, which began on 14th August 2021 and ended on 28th August 2021; orassisted by or on behalf of the United Kingdom, after 28th August 2021 and before 6th January 2022, to leave Afghanistan; andwho has been ordinarily resident in the United Kingdom and Islands since they were evacuated from or otherwise left Afghanistan; “family member” means—in relation to an EEA frontier worker, an EEA migrant worker, an EEA frontier self-employed person , an EEA self-employed person, or a relevant person of Northern Ireland who is treated as an EEA migrant worker or an EEA self-employed person by virtue of paragraph 6A(3) —his spouse or civil partner;direct descendants of the person or of the person’s spouse or civil partner who are—under the age of 21; ordependants of the person or the person’s spouse or civil partner; ordependent direct relatives in his ascending line or that of his spouse or civil partner;in relation to a Swiss employed person, a Swiss frontier employed person, a Swiss frontier self-employed person or a Swiss self-employed person—his spouse or civil partner; orhis child or the child of his spouse or civil partner;in relation to an EU national who falls within Article 7(1)(c) of Directive 2004/38 or, for the purposes of paragraph 9ZA, in relation to a relevant person of Northern Ireland who would fall within article 7(1)(c) of Directive 2004/38 if that person were an EU national or solely an EU national —his spouse or civil partner; ordirect descendants of his or of his spouse or civil partner who are—under the age of 21; ordependants of his or his spouse or civil partner;in relation to an EU national who falls within Article 7(1)(b) of Directive 2004/38 or, for the purposes of paragraph 9ZA, in relation to a relevant person of Northern Ireland who would fall within article 7(1)(b) of Directive 2004/38 if that person were an EU national or solely an EU national —his spouse or civil partner;direct descendants of his or of his spouse or civil partner who are—under the age of 21; ordependants of his or his spouse or civil partner; ordependent direct relatives in his ascending line or that of his spouse or civil partner;in relation to a United Kingdom national, for the purposes of paragraphs 9, 9ZB, 9ZD or for the purposes of paragraph 9ZC in relation to a person settled in the United Kingdom—his spouse or civil partner; ordirect descendants of his or of his spouse or civil partner who are—under the age of 21; ordependants of his or his spouse or civil partner; “immigration rules” has the meaning given in section 33(1) of the Immigration Act 1971; “the Islands” means the Channel Islands and the Isle of Man;“overseas territories” means Anguilla; Aruba; Bermuda; British Antarctic Territory; British Indian Ocean Territory; British Virgin Islands; Cayman Islands; Falkland Islands; Faroe Islands; French Polynesia; French Southern and Antarctic Territories; Gibraltar; Mayotte; Greenland; Montserrat; Netherlands Antilles (Bonaire, Curaçao, Saba, Sint Eustatius and Sint Maarten); Pitcairn, Henderson, Ducie & Oeno Islands; South Georgia and the South Sandwich Islands; St-Barthélemy ; St Helena and Dependencies (Ascension Island and Tristan de Cunha); St Pierre et Miquelon; the Territory of New Caledonia and Dependencies; Turks and Caicos Islands and Wallis and Futuna; “persons granted humanitarian protection” means a person—who, on the grounds of humanitarian protection, has been granted leave to remain under the immigration rules ...;whose leave to remain is extant, or in respect of whose leave to remain an appeal is pending (within section 104 of the Nationality, Immigration and Asylum Act 2002);who has been ordinarily resident in the United Kingdom and Islands throughout the period since the person was granted such leave to remain. “person granted indefinite leave to remain as a bereaved partner” means a person—granted indefinite leave to remain in the United Kingdom under any of the following provisions of the immigration rules...— paragraph BP 11.1 of Appendix Bereaved Partner; or where such leave was granted before the coming into force of Appendix Bereaved Partner—paragraph 288, as a person in relation to whom the requirements in paragraph 287(b) of those rules were met (bereaved partners);paragraph 295N, as a person in relation to whom the requirements in paragraph 295M of those rules were met (bereaved partners);paragraph D-BPILR.1.1 of Appendix FM (bereaved partners); orparagraph 36 of Appendix Armed Forces (bereaved partner of a member of HM Forces); andwho has been ordinarily resident in the United Kingdom and Islands since the person was granted such leave; “person granted indefinite leave to enter or remain as a victim of domestic violence or domestic abuse” means a person—granted indefinite leave to enter or remain in the United Kingdom under any of the following provisions of the immigration rules...— paragraph VDA 9.1 of the Appendix Victim of Domestic Abuse; or where such leave was granted before the coming into force of the Appendix Victim of Domestic Abuse, paragraph 289B (victims of domestic violence), paragraph D-DVILR.1.1. of Appendix FM (victims of domestic abuse) or paragraph 40 of Appendix Armed Forces (victims of domestic violence: partners of members of the armed forces); andwho has been ordinarily resident in the United Kingdom and Islands since the person was granted such leave; “person granted leave under one of the Afghan Schemes” means a person granted leave under the Afghan Citizens Resettlement Scheme or a person granted leave under the Afghan Relocations and Assistance Policy Scheme; “person granted leave under one of the Ukraine Schemes” means a person granted leave under the Homes for Ukraine Sponsorship Scheme, a person granted leave under the Ukraine Extension Scheme , a person granted leave under the Ukraine Permission Extension Scheme or a person granted leave under the Ukraine Family Scheme; “person granted leave under the Afghan Citizens Resettlement Scheme” means a person— who has indefinite leave to enter or remain in the United Kingdom, outside the immigration rules, on the basis of the Afghan Citizens Resettlement Scheme; and who has been ordinarily resident in the United Kingdom and Islands throughout the period since the person was granted such leave; person granted leave under the Afghan Relocations and Assistance Policy Scheme” means a person—who has—indefinite leave to enter the United Kingdom under paragraph 276BA2, or has indefinite leave to remain under paragraph 276BS2 of the immigration rules, having been relocated to the United Kingdom pursuant to paragraph 276BB1(iii)(a) of the immigration rules; indefinite leave to enter or indefinite leave to remain in the United Kingdom under paragraph ARAP 6.1 of Appendix Afghan Relocation and Assistance Policy of the immigration rules; leave to enter the United Kingdom on the basis of the Afghan Relocations and Assistance Policy Scheme; or indefinite leave to enter or remain, outside those rules, on the basis of the Afghan Relocations and Assistance Policy Scheme; and ... andwho has been ordinarily resident in the United Kingdom and Islands throughout the period since the person was granted such leave; “person granted leave under the Homes for Ukraine Sponsorship Scheme” means a person—who has leave to enter or remain in the United Kingdom—under paragraph UKR 19.1 of Appendix Ukraine Scheme of the immigration rules; oroutside the immigration rules where the person—was residing in Ukraine immediately before 1st January 2022; andleft Ukraine in connection with the Russian invasion which took place on 24th February 2022; andwho has been ordinarily resident in the United Kingdom and Islands throughout the period since the person was granted such leave;“person granted leave under the Ukraine Extension Scheme” means a person—who has leave to remain in the United Kingdom under paragraph UKR 27.1 of Appendix Ukraine Scheme of the immigration rules; andwho has been ordinarily resident in the United Kingdom and Islands throughout the period since the person was granted such leave;“person granted leave under the Ukraine Family Scheme” means a person—who has leave to enter or remain in the United Kingdom—under paragraph UKR 9.1 of Appendix Ukraine Scheme of the immigration rules; oroutside the immigration rules where the person—was residing in Ukraine immediately before 1st January 2022; andleft Ukraine in connection with the Russian invasion which took place on 24th February 2022; andwho has been ordinarily resident in the United Kingdom and Islands throughout the period since the person was granted such leave; “person granted leave under the Ukraine Permission Extension Scheme” means a person—who has leave to remain in the United Kingdom under the Ukraine Permission Extension Scheme; andwho has been ordinarily resident in the United Kingdom and Islands throughout the period since the person was granted such leave; “person granted stateless leave” means a person who—has extant leave to remain as a stateless person under the immigration rules ...; andhas been ordinarily resident in the United Kingdom and Islands throughout the period since the person was granted such leave. “person with protected rights” means—a person within the personal scope of the citizens’ rights provisions who—has leave to enter or remain in the United Kingdom granted by virtue of residence scheme immigration rules;is an Irish citizen who, pursuant to section 3ZA of the Immigration Act 1971, does not require leave to enter or remain in the United Kingdom; ...is an applicant for the purposes of regulation 4 of the 2020 Citizens’ Rights Regulations where the relevant period has not expired; or otherwise has rights deemed to apply by virtue of any citizens’ rights deeming provisions; or a family member of a relevant person of Northern Ireland for the purposes of residence scheme immigration rules, where that family member has leave to enter or remain in the United Kingdom granted by virtue of residence scheme immigration rules; In paragraph (1)(iv) “citizens’ rights deeming provisions” means— Article 18(2) and (3) (issuance of residence documents) of the EU withdrawal agreement;Article 17(2) and (3) (issuance of residence documents) of the EEA EFTA separation agreement (as defined in section 39(1) of the European Union (Withdrawal Agreement) Act 2020); orArticle 16(2) and (3) (issuance of residence documents) of the Swiss citizens’ rights agreement. “person with leave to enter or remain on the grounds of discretionary leave” means a person (“P”)—who has—applied for refugee status but has, as a result of that application, been informed in writing by a person acting under the authority of the Secretary of State for the Home Department that, although P is considered not to qualify for recognition as a refugee it is thought right to allow P to enter or remain in the United Kingdom on the grounds of discretionary leave, ornot applied for refugee status but has been informed in writing by a person acting under the authority of the Secretary of State for the Home Department that it is thought right to allow P to enter or remain in the United Kingdom on the grounds of discretionary leave,who has been granted leave to enter or to remain accordingly,whose period of leave to enter or remain has not expired or has been renewed and the period for which it was renewed has not expired or in respect of whose leave to enter or remain an appeal is pending (within the meaning of section 104 of the Nationality, Immigration and Asylum Act 2002), andwho has been ordinarily resident in the United Kingdom and Islands throughout the period since P was granted leave to enter or remain. “refugee” means a person who is recognised by Her Majesty’s government as a refugee within the meaning of the United Nations Convention relating to the Status of Refugees done at Geneva on 28th July 1951 as extended by the Protocol thereto which entered into force on 4th October 1967; relevant period” has the meaning given by regulation 4 of the 2020 Citizens’ Rights Regulations;” “relevant person of Northern Ireland” has the meaning given by residence scheme immigration rules; “residence scheme immigration rules” has the meaning given by section 17(1) of the European Union (Withdrawal Agreement) Act 2020; ... “self-employed person” means—in relation to an EEA national, a person who is self-employed within the meaning of Article 7 of Directive 2004/38 or the EEA Agreement, as the case may be; orin relation to a Swiss national, a person who is a self-employed person within the meaning of Annex 1 to the Swiss Agreement;“settled” has the meaning given by section 33(2A) of the Immigration Act 1971;“Swiss Agreement” means the Agreement between the European Community and its Member States, of the one part, and the Swiss Confederation, of the other, on the Free Movement of Persons signed at Luxembourg on 21st June 1999 and which came into force on 1st June 2002; “Swiss citizens’ rights agreement” has the meaning given by section 39(1) of the European Union (Withdrawal Agreement) Act 2020; “Swiss employed person” means a Swiss national who is an employed person, other than a Swiss frontier employed person, in the United Kingdom;“Swiss frontier employed person” means a Swiss national who—is an employed person in the United Kingdom; andresides in Switzerland or in the territory of an EEA State ...and returns to his residence in Switzerland or that EEA State daily or at least once a week;“Swiss frontier self-employed person” means a Swiss national who—is a self-employed person in the United Kingdom; andresides in Switzerland or in the territory of an EEA State ...and returns to his residence in Switzerland or that EEA State daily or at least once a week;“Swiss self-employed person” means a Swiss national who is a self-employed person, other than a Swiss frontier self-employed person, in the United Kingdom;“Turkish worker” means a Turkish national who—is ordinarily resident in the United Kingdom; andis, or has been lawfully employed in the United Kingdom; “United Kingdom national” has the meaning given by Article 2(d) of the EU withdrawal agreement; “worker” means a worker within the meaning of Article 7 of Directive 2004/38 or the EEA Agreement as the case may be.1AFor the purposes of this Schedule, a reference to a “Member State” or “State” in Article 7 of Directive 2004/38 is to be read as including the United Kingdom.1BFor the purposes of this Schedule, a person is within the personal scope of the citizens’ rights provisions if that person falls within—aArticle 10 (personal scope) of the EU withdrawal agreement;bArticle 9 (personal scope) of the EEA EFTA separation agreement; orcArticle 10 (personal scope) of the Swiss citizens’ rights agreement.2For the purposes of this Schedule, “parent” means a parent, guardian or any other person having parental responsibility for a child and “child” is to be construed accordingly.2AFor the purposes of this Schedule, a person is not to be treated as ordinarily resident in a place unless that person lawfully resides in that place.3For the purposes of this Schedule, a person is to be treated as ordinarily resident in the United Kingdom, the United Kingdom and Islands, in the territory comprising the United Kingdom, Gibraltar, the European Economic Area and Switzerland , in the territory comprising the United Kingdom, the European Economic Area, Switzerland and the overseas territories , or in the territory comprising the United Kingdom, the European Economic Area, Switzerland, Turkey and the overseas territories if he would have been so resident but for the fact that—ahe;bhis spouse or civil partner;chis parent; ordin the case of a dependent direct relative in the ascending line, his child or child’s spouse or civil partner,is or was temporarily employed outside the area in question.4For the purposes of paragraph (3), temporary employment includes—ain the case of members of the regular naval, military or air forces of the Crown, any period which they serve outside the United Kingdom as members of such forces;bin the case of members of the regular armed forces of an EEA State or Switzerland, any period which they serve outside the territory comprising the United Kingdom, Gibraltar, the European Economic Area and Switzerland as members of such forces; andcin the case of members of the regular armed forces of Turkey, any period which they serve outside the territory comprising the United Kingdom, Gibraltar, the European Economic Area, Switzerland and Turkey as members of such forces.5For the purposes of this Schedule an area other than the United Kingdom or Gibraltar which—awas previously not part of the European Community or the European Economic Area; butbat any time before or after these Regulations come into operation has become part of one or the other or both of these areas,is to be considered to have always been a part of the European Economic Area.6For the purposes of this Schedule a person who is ordinarily resident in the United Kingdom as a result of having moved from the Islands for the purpose of undertaking a course is to be considered to be ordinarily resident in the Islands;7For the purposes of this Schedule a person who is ordinarily resident in Northern Ireland as a result of having moved from England, Wales, Scotland or the Islands for the purpose of undertaking a course is to be considered as ordinarily resident in England, Wales, Scotland or the Islands as the case may be.Persons who are settled in the United Kingdom21A person who ...—ais settled in the United Kingdom, and does not fall within paragraph 3;bis ordinarily resident in the United Kingdom on the first day of the first academic year of the course;chas been ordinarily resident in the United Kingdom and Islands throughout the three-year period preceding the first day of the first academic year of the course; anddsubject to sub-paragraph (2), whose residence in the United Kingdom and Islands has not during any part of the period referred to in paragraph (c) been wholly or mainly for the purpose of receiving full-time education.2Paragraph (d) of sub-paragraph (1) does not apply to a person who is treated as being Article 4 of the Higher Education (Northern Ireland) Order 2005 requires the Department to impose a condition on grants given to the governing body of higher and further education institutions. This condition requires the governing bodies to secure that the qualifying fees payable in respect of any qualifying course by a qualifying person do not exceed the basic or higher fee amounts applicable to that course. The fee amounts are prescribed by The Student Fees (Amounts) (Amendment) Regulations (Northern Ireland) 2006 (S.R. 2006 No. 455).

These Regulations revoke previous Regulations. They prescribe the qualifying courses and class of qualifying persons for the purposes of the Higher Education (Northern Ireland) Order 2005. The qualifying courses prescribed by regulation 4 are those courses which are designated under Article 3 of the Education (Student Support) (Northern Ireland) Order 1998 and which are provided by institutions in Northern Ireland.

The class of qualifying persons prescribed in regulation 5 are those persons who, on the first day of the relevant academic year, fall within the Schedule, save for those persons who are not eligible for student support under the Education (Student Support) Regulations (Northern Ireland) 2007 (S.R. 2007 No. 195) by reason of certain paragraphs of regulation 5 of those Regulations, or who already have an honours degree from a publicly-funded institution. There is an exception in respect of a previous honours degree for a person undertaking a course of initial teacher training or a degree in social work in Northern Ireland or who has obtained the honours degree only as part of a single course they are currently undertaking.

Regulation 6 re-enacts provision for transitional cases made in the revoked Student Fees (Qualifying Courses and Persons) Regulations (Northern Ireland) 2006.
