<Title>Breeding flocks and hatcheries scheme</Title>

<Text>For the purposes of keeping poultry, so far as practicable, free from Salmonella and controlling and, so far as practicable, reducing the incidence of Salmonella, the Department makes the Scheme set out in the Schedule to this Order.</Text>

<Title>Interpretation and application</Title>

<P2para><Text>In this Scheme—</Text>
<UnorderedList Decoration="none" Class="Definition">
<ListItem>
<Para><Text>“<Term id="term-approved-laboratory">approved laboratory</Term>” means a laboratory approved by the Department for the purposes of this Order;</Text>
</Para>
</ListItem>
<ListItem>
<Para><Text>“<Term id="term-breeding-flock">breeding flock</Term>” means a flock kept for the production of eggs intended for incubation;</Text>
</Para>
</ListItem>
<ListItem>
<Para><Text>“<Term id="term-building">building</Term>” includes a shed and any part of a building that has its own ventilation system and is separated from other parts of the building by a solid partition;</Text>
</Para>
</ListItem>
<ListItem>
<Para><Text>“<Term id="term-chick">chick</Term>” means a bird less than 72 hours old that has not been fed;</Text>
</Para>
</ListItem>
<ListItem>
<Para><Text>“Commission Regulation” means <Citation URI="http://www.legislation.gov.uk/european/regulation/2005/1003" id="c00001" Class="EuropeanUnionRegulation" Year="2005" Number="1003">Commission Regulation (EC) No 1003/2005</Citation> implementing Regulation <Citation URI="http://www.legislation.gov.uk/european/regulation/2003/2160" id="c00002" Class="EuropeanUnionRegulation" Year="2003" Number="2160">(EC) No 2160/2003</Citation> as regards a Community target for the reduction of the prevalence of certain salmonella serotypes in breeding flocks of <Emphasis>Gallus gallus</Emphasis> and amending Regulation <Citation URI="http://www.legislation.gov.uk/european/regulation/2003/2160" id="c00003" Class="EuropeanUnionRegulation" Year="2003" Number="2160">(EC) No 2160/2003</Citation><FootnoteRef Ref="f00003"/>, as amended by <Citation URI="http://www.legislation.gov.uk/european/regulation/2006/1168" id="c00004" Class="EuropeanUnionRegulation" Year="2006" Number="1168">Commission Regulation (EC) No 1168/2006</Citation>;</Text>

<Para><Text>“<Term id="term-the-department">the Department</Term>” means the Department of Agriculture and Rural Development;</Text>
</Para>
</ListItem>
<ListItem>
<Para><Text>“<Term id="term-flock">flock</Term>” means poultry of the same health status kept on the same holding or in the same enclosure and constituting a single epidemiological unit and, in the case of housed poultry, includes all birds sharing the same airspace;</Text>
</Para>
</ListItem>
<ListItem>
<Para><Text>“<Term id="term-layer-breeder">layer breeder</Term>” means poultry kept for the production of eggs intended for the incubation and hatching of chicks—</Text>

</ListItem>
<ListItem>

<Para><Text>“<Term id="term-meat-breeder">meat breeder</Term>” means poultry kept for the production of eggs intended for the incubation and hatching of chicks—</Text>

<Title>Notification of hatcheries</Title>

<P2para><Text>The occupier of a poultry hatchery with a total incubator capacity of 1000 eggs or more must notify the Department of the information in Annex 1, paragraph 1—</Text>

<Text>in the case of a hatchery established after the date this Order comes into operation, within three months of the establishment of the hatchery; and</Text>

<Title>Notification of breeding flocks</Title>

<Pnumber>5</Pnumber>

<P2para><Text>The occupier of a holding on which one or more breeding flocks of at least 250 poultry of any single species are kept must notify the Department of the information in Annex 1, paragraph 2—</Text>

<Text>in the case of such a holding established after the coming into operation of this Order, within three months of the establishment of the holding; and</Text>

<Title>Notification of arrival of breeding flocks</Title>

<P><Text>This Order revokes and remakes the Poultry Breeding Flocks and Hatcheries Scheme Order (Northern Ireland) 1994 (<Citation URI="http://www.legislation.gov.uk/id/nisr/1994/118" id="c00010" Class="NorthernIrelandStatutoryRule" Year="1994" Number="0118">S.R. 1994 No. 118</Citation>).</Text></P>
<P><Text>The Order implements the national control programme for domestic fowl of the species <Emphasis>Gallus gallus</Emphasis><Strong>—</Strong></Text><P3>

No. L 325, 12.12.2003, p 1); and</Text>

<P><Text>The Order enforces <Citation URI="http://www.legislation.gov.uk/european/regulation/2005/1003" id="c00012" Class="EuropeanUnionRegulation" Year="2005" Number="1003">Commission Regulation (EC) No 1003/2005</Citation> implementing Regulation <Citation URI="http://www.legislation.gov.uk/european/regulation/2003/2160" id="c00013" Class="EuropeanUnionRegulation" Year="2003" Number="2160">(EC) No 2160/2003</Citation> as regards a Community target for the reduction of the prevalence of certain salmonella serotypes in breeding flocks of <Emphasis>Gallus gallus</Emphasis> and amending Regulation <Citation URI="http://www.legislation.gov.uk/european/regulation/2003/2160" id="c00014" Class="EuropeanUnionRegulation" Year="2003" Number="2160">(EC) No 2160/2003</Citation> (O.J. <P><Text>Article <InternalLink Ref="schedule-paragraph-4" IdURI="http://www.legislation.gov.uk/id/nisr/2007/209/schedule/paragraph/4" DocumentURI="http://www.legislation.gov.uk/nisr/2007/209/schedule/paragraph/4/made">4</InternalLink> requires the occupier of a poultry hatchery with a total incubator capacity of 1000 eggs or more to notify the Department. Article <InternalLink Ref="schedule-paragraph-5" IdURI="http://www.legislation.gov.uk/id/nisr/2007/209/schedule/paragraph/5" DocumentURI="http://www.legislation.gov.uk/nisr/2007/209/schedule/paragraph/5/made">5</InternalLink> requires the occupier of a holding on which breeding flocks of 250 poultry or more are kept to notify the Department.</Text></P>
<P><Text>Articles <InternalLink Ref="schedule-paragraph-6" IdURI="http://www.legislation.gov.uk/id/nisr/2007/209/schedule/paragraph/6" DocumentURI="http://www.legislation.gov.uk/nisr/2007/209/schedule/paragraph/6/made">6</InternalLink> to <InternalLink Ref="schedule-paragraph-12" IdURI="http://www.legislation.gov.uk/id/nisr/2007/209/schedule/paragraph/12" DocumentURI="http://www.legislation.gov.uk/nisr/2007/209/schedule/paragraph/12/made">12</InternalLink> apply to the occupier of a holding on which breeding flocks of domestic fowl of the species <Emphasis>Gallus gallus</Emphasis> are kept. Article <InternalLink Ref="schedule-paragraph-7" IdURI="http://www.legislation.gov.uk/id/nisr/2007/209/schedule/paragraph/7" DocumentURI="http://www.legislation.gov.uk/nisr/2007/209/schedule/paragraph/7/made">7</InternalLink> requires the occupier to notify the Department of the arrival of breeding flocks at the holding and Article <InternalLink Ref="schedule-paragraph-8" IdURI="http://www.legislation.gov.uk/id/nisr/2007/209/schedule/paragraph/8" DocumentURI="http://www.legislation.gov.uk/nisr/2007/209/schedule/paragraph/8/made">8</InternalLink> requires him to notify when those flocks will move to the laying phase or laying unit and reach the end of the production cycle. Article <InternalLink Ref="schedule-paragraph-9" IdURI="http://www.legislation.gov.uk/id/nisr/2007/209/schedule/paragraph/9" DocumentURI="http://www.legislation.gov.uk/nisr/2007/209/schedule/paragraph/9/made">9</InternalLink> requires him to take samples from those flocks and Article <InternalLink Ref="schedule-paragraph-10" IdURI="http://www.legislation.gov.uk/id/nisr/2007/209/schedule/paragraph/10" DocumentURI="http://www.legislation.gov.uk/nisr/2007/209/schedule/paragraph/10/made">10</InternalLink> requires him to submit those samples to an approved laboratory for testing for salmonella. Articles <InternalLink Ref="schedule-paragraph-11" IdURI="http://www.legislation.gov.uk/id/nisr/2007/209/schedule/paragraph/11" DocumentURI="http://www.legislation.gov.uk/nisr/2007/209/schedule/paragraph/11/made">11</InternalLink> and <InternalLink Ref="schedule-paragraph-12" IdURI="http://www.legislation.gov.uk/id/nisr/2007/209/schedule/paragraph/12" DocumentURI="http://www.legislation.gov.uk/nisr/2007/209/schedule/paragraph/12/made">12</InternalLink> impose record-keeping requirements on the occupier.</Text></P>
<P><Text>Article <InternalLink Ref="schedule-paragraph-13" IdURI="http://www.legislation.gov.uk/id/nisr/2007/209/schedule/paragraph/13" DocumentURI="http://www.legislation.gov.uk/nisr/2007/209/schedule/paragraph/13/made">13</InternalLink> sets out the duties of an approved laboratory to prepare and test the samples and report the results of tests to the occupier.</Text></P>
<P><Text>Article <InternalLink Ref="schedule-paragraph-14" IdURI="http://www.legislation.gov.uk/id/nisr/2007/209/schedule/paragraph/14" DocumentURI="http://www.legislation.gov.uk/nisr/2007/209/schedule/paragraph/14/made">14</InternalLink> prohibits the administering of any antimicrobial to domestic fowl of the species <Emphasis>Gallus Gallus</Emphasis>, other than in accordance with Article 2 of Commission Regulation 1177/2006. Article <InternalLink Ref="schedule-paragraph-15" IdURI="http://www.legislation.gov.uk/id/nisr/2007/209/schedule/paragraph/15" DocumentURI="http://www.legislation.gov.uk/nisr/2007/209/schedule/paragraph/15/made">15</InternalLink> prohibits the administering of any live salmonella vaccine to such species, other than in accordance with Article 3(1) of that Regulation.</Text></P>
<P><Text>Article <InternalLink Ref="schedule-paragraph-16" IdURI="http://www.legislation.gov.uk/id/nisr/2007/209/schedule/paragraph/16" DocumentURI="http://www.legislation.gov.uk/nisr/2007/209/schedule/paragraph/16/made">16</InternalLink> imposes record-keeping requirements on the occupier of a poultry hatchery.</Text></P>
<P><Text>Article 17 – 19 relates to production of records, tampering with of any samples taken which may affect the result except as specified in the Scheme and powers of the Department.</Text></P>
<P><Text>Failure to comply with this Order is an offence under Article 52 of the Diseases of Animals Order (Northern Ireland) 1981.</Text></P>
