Subject to sub-paragraph (2), a consent given under Article 9(3) of, and Schedule 1 to, the 1999 Order (as in force before the transfer date) which is effective immediately before the transfer date shall have effect on and after that date as if given under Article 7A(3)(a) of that Order (as amended by the 2006 Order).

Sub-paragraph (1) shall not apply to any consent that relates to a discharge in relation to which, and for so long as, Articles 280 and 291 of the 2006 Order do not apply by virtue of Part II of Schedule 1 to this Order, until such time as those Articles do apply in relation to it.
