The Police (Northern Ireland) Act 2003 (Commencement No. 2) Order 2007

The Secretary of State, in exercise of the powers conferred upon him by Sections 42(6) and 44 of the Police (Northern Ireland) Act 2003(1), hereby makes the following Order:

1.  This Order may be cited as the Police (Northern Ireland) Act 2003 (Commencement No. 2) Order 2007.

2.  Section 42(1) to (5) of the Police (Northern Ireland) Act 2003 (Intimate Samples) shall come into operation on 1st March 2007.

Explanatory Note

(This note is not part of the Order)

This Order brings into operation on 1st March 2007 Section 42(1) to (5) of the Police (Northern Ireland) Act 2003.

Section 42 amends Article 62 of the Police and Criminal Evidence (Northern Ireland) Order 1989 (intimate samples) to provide that an intimate sample other than a sample of urine, or a dental impression (which may only be taken by a registered dentist) may be taken from a person by a registered health care professional as well as by a medical practitioner. Registered health care professional is defined as a registered nurse or a registered member of a health care profession designated by order made by the Secretary of State.
