INSOLVENCY
On 30th May 1997 the United Nations Commission on International Trade Law (“UNCITRAL”) adopted the text of a model law on cross-border insolvency, which was approved by a resolution of the United Nations General Assembly on 15th December 1997. These Regulations give effect to the model law in Northern Ireland.

GENERAL PROVISION AS TO COURT PROCEDURE AND PRACTICE
Use of affidavit evidence35

In any proceedings evidence may be given by affidavit unless the court otherwise directs; but the court may, on the application of any party, order the attendance for cross-examination of the person making the affidavit.

Where, after such an order has been made, the person in question does not attend, his affidavit shall not be used in evidence without the permission of the court.
