This Order brings the Disability Discrimination Code of Practice for Further and Higher Education into effect on 30th January 2006. The Code of Practice was issued by the Equality Commission for Northern Ireland under section 54A of the Disability Discrimination Act 1995.

The Code provides practical guidance for Further and Higher Education Institutions on how to avoid committing acts which are unlawful under, and other matters relating to, the operation of Part III Chapter II of the Special Educational Needs and Disability (Northern Ireland) Order 2005 which came into effect from 1^st September 2005.

Failure to observe any provision of this Code does not in itself make a person liable to any proceedings but, any provision of the Code which appears to a court to be relevant to any question arising in any proceedings must be taken into account in determining that question.
