The Pension Protection Fund (Eligible Schemes) Appointed Day Order (Northern Ireland) 2005

The Department for Social Development, in exercise of the powers conferred on it by Article 110(2) of the Pensions (Northern Ireland) Order 2005(1) and of all other powers enabling it in that behalf, hereby makes the following Order:

Citation

1.  This Order may be cited as the Pension Protection Fund (Eligible Schemes) Appointed Day Order (Northern Ireland) 2005.

Appointed day

2.  The day appointed by the Department for the purposes of paragraph (2) of Article 110 of the Pensions (Northern Ireland) Order 2005 (eligible schemes) is 6th April 2005.

Explanatory Note

(This note is not part of the Order.)

Article 110 of the Pensions (Northern Ireland) Order 2005 (“the Order”) makes provision in relation to which occupational pension schemes are to be eligible schemes for the purposes of Part III of the Order (Pension Protection Fund). This Order is made for the purposes of paragraph (2) of that Article. It appoints 6th April 2005 as the day on or after which an occupational pension scheme is not to be an eligible scheme if, immediately before that day, the scheme is being wound up.

The Pensions (2005 Order) (Commencement No. 1 and Consequential and Transitional Provisions) Order (Northern Ireland) 2005 (S.R. 2005 No. 48 (C. 5)) provides for the coming into operation of Article 110(2) of the Order, for the purpose of authorising the making of an order on 25th February 2005 and for all other purposes on 8th March 2005.
