The Department of the Environment, being a Department designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to measures relating to the prevention, reduction and elimination of pollution caused by waste and of all other powers enabling it in that behalf, hereby makes the following Regulations:
1.—(1) These Regulations may be cited as the List of Wastes (Amendment) Regulations (Northern Ireland) 2005, and shall come into operation on 14 November 2005.
(2) The Interpretation Act (Northern Ireland) 1954(3) shall apply to these Regulations as it applies to an Act of the Northern Ireland Assembly.
2.—(1) The List of Wastes Regulations (Northern Ireland) 2005(4) shall be amended in accordance with paragraphs (2) and (3).
(2) In regulation 2 (interpretations) in sub-paragraph (b) for “Council Regulation (EC) No.807/2003” there shall be substituted “Commission Directive 2004/73/EC(5)”.
(3) In regulation 4(b) (properties and characteristics of dangerous substances classified as hazardous waste) for “R40 at a concentration = 1%.” there shall be substituted “R68 at a concentration = 1%”.
