The Foyle Area and Carlingford Area (Close Seasons for Angling) (Amendment) Regulations 2005

Coming into operation
The Foyle, Carlingford and Irish Lights Commission, in exercise of the powers conferred on it by section 13(1) (amended by section 34(3) of the British-Irish Agreement Act 19991) and section 5(1) of the British-Irish Agreement (Amendment) Act 20021) and section 28(2) and (4) of the Foyle Fisheries Act 19521 which stand transferred to it under section 34(1) of the British-Irish Agreement Act 1999, and in exercise of the powers conferred on it by section 13(1) and section 27(2) and (4) of the Foyle Fisheries Act (Northern Ireland) 19522 and now vested in it3 and of all other powers enabling it in that behalf, with the approval of the Government of Ireland and the Government of the United Kingdom of Great Britain and Northern Ireland, under the agreement made between those Governments on 19th November 20024 and section 5(1) of the British-Irish Agreement (Amendment) Act 2002, hereby makes the following Regulations:

Citation and commencement1.

These Regulations may be cited as the Foyle Area and Carlingford Area (Close Seasons for Angling) (Amendment) Regulations 2005 and shall come into operation on 18th August 2005.

Amendment of the Foyle Area and Carlingford Area (Close Seasons for Angling) Regulations 20012.

For the Schedule to the Foyle Area and Carlingford Area (Close Seasons for Angling) Regulations 20015 there shall be substituted the Schedule set out in the Schedule to these Regulations.

Revocation3.

The Foyle Area and Carlingford Area (Close Seasons for Angling) (Amendment) Regulations 20046 are hereby revoked.

Description of Waters

Close Season

All rivers in the Foyle Area other than the River Foyle and the River Finn.

21st October to 31st March next following both dates inclusive.

River Foyle and River Finn including the loughs and tributaries of the River Finn.

16th September to the last day of February next following both dates inclusive.

All loughs in the Foyle Area other than the loughs of the River Finn system, Lough Foyle and Binevenagh Dam.

21st October to the last day of February next following both dates inclusive.

Binevenagh Dam.

1st January to 31st January next following both dates inclusive.

Lough Foyle.

16th September to the last day of February next following both dates inclusive.

All rivers in the Carlingford Area.

1st November to the last day of February next following both dates inclusive.

All loughs in the Carlingford Area.

1st November to the last day of February next following both dates inclusive.”

(This note is not part of the Regulations)

These Regulations amend the Foyle Area and Carlingford Area (Close Seasons for Angling) Regulations 2001 by bringing the beginning of the close season for salmon and trout in the River Strule and its tributaries upstream of its confluence with the River Owenkillew in line with the other rivers in the Foyle Area (except the Rivers Foyle and Finn), prescribing a close season running from the 21st October to 31st March next following, both dates inclusive. These Regulations also prescribe a close season for Binevenagh Dam.
