RestrictStartDate="2004-03-31"><P1group RestrictStartDate="2004-03-31" RestrictExtent="N.I."><Title>Citation and commencement</Title><P1 DocumentURI="http://www.legislation.gov.uk/nisr/2004/65/regulation/1" IdURI="http://www.legislation.gov.uk/id/nisr/2004/65/regulation/1" id="regulation-1"><Pnumber><CommentaryRef Ref="key-be31096627772078022ac1c7b39ef731"/>1</Pnumber><P1para><Text>These Regulations may be cited as the Motor Vehicles (Approval) (Fees) Regulations (Northern Ireland) 2004 and shall come into operation on 31st March 2004.</Text></P1para></P1></P1group><P1group RestrictStartDate="2004-03-31" RestrictExtent="N.I."><Title>Interpretation</Title><P1 DocumentURI="http://www.legislation.gov.uk/nisr/2004/65/regulation/2" IdURI="http://www.legislation.gov.uk/id/nisr/2004/65/regulation/2" id="regulation-2"><Pnumber><CommentaryRef Ref="key-7a544789b22209006d55c4a620c0248d"/>2</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/nisr/2004/65/regulation/2/1" IdURI="http://www.legislation.gov.uk/id/nisr/2004/65/regulation/2/1" id="regulation-2-1"><Pnumber>1</Pnumber><P2para><Text>In these Regulations –</Text><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text>“the <Abbreviation Expansion="Motor Vehicles (Approval) Regulations (Northern Ireland) 2001 (S.R. 2001/172)">Approval Regulations</Abbreviation>” means the Motor Vehicles (Approval) Regulations (Northern Ireland) 2001<FootnoteRef Ref="f00003"/>;</Text></Para></ListItem><ListItem><Para><Text>“the Directive” means Council Directive <Citation URI="http://www.legislation.gov.uk/european/directive/1970/0156" id="c00001" Class="EuropeanEconomicCommunityDirective" Year="1970" Number="156">70/156/<Acronym Expansion="European Economic Community">EEC</Acronym></Citation><FootnoteRef Ref="f00004"/> as amended by Council Directive <Citation URI="http://www.legislation.gov.uk/european/directive/1987/0403" id="c00002" Class="EuropeanEconomicCommunityDirective" Year="1987" Number="403">87/403/EEC</Citation><FootnoteRef Ref="f00005"/> and Council Directive <Citation URI="http://www.legislation.gov.uk/european/directive/1992/0053" id="c00003" Class="EuropeanEconomicCommunityDirective" Year="1992" Number="53">92/53/EEC</Citation><FootnoteRef Ref="f00006"/>;</Text></Para></ListItem><ListItem><Para><Text>“<Acronym Expansion="European Community">EC</Acronym> certificate of conformity” means any certificate of conformity issued by a manufacturer under regulation 5 of the Motor Vehicles (EC Type Approval) Regulations 1998<FootnoteRef Ref="f00007"/>, or under any provision of the law of a member State other than the United Kingdom giving effect to Article 6 of the Directive;</Text></Para></ListItem><ListItem><Para><Text>“EC type approval” means –</Text><OrderedList Decoration="parens" Type="alpha"><ListItem><Para><Text>vehicle type approval in relation to a passenger vehicle or goods vehicle granted pursuant to the Directive, and</Text></Para></ListItem><ListItem><Para><Text>system, component or separate technical unit type approval granted pursuant to a separate Directive;</Text></Para></ListItem></OrderedList></Para></ListItem><ListItem><Para><Text>“exceptional circumstances” means an accident, a fire, a failure in the supply of essential services or other unexpected happening (excluding a breakdown or mechanical defect in a vehicle or non-delivery of spare parts for that vehicle);</Text></Para></ListItem><ListItem><Para><Text>“further application” means an application made in accordance with regulation 5(6) of the Approval Regulations;</Text></Para></ListItem><ListItem><Para><Text>“goods vehicle” means a motor vehicle of a kind referred to in regulation 3(A)(2)<FootnoteRef Ref="f00008"/> of the Approval Regulations;</Text></Para></ListItem><ListItem><Para><Text>“model report” means a collection of data and information about a vehicle which is not a Schedule 1 vehicle that has been submitted by an applicant for the purposes of approval of other vehicles of the same model under regulation 4(1)(b)<FootnoteRef Ref="f00009"/> of the Approval Regulations and which demonstrates to the satisfaction of the Department compliance with the relevant provisions of Schedule 3 to the Approval Regulations;</Text></Para></ListItem><ListItem><Para><Text>“original application” means an application made in accordance with regulation 5(1) to (3) of the Approval Regulations, not being a further application;</Text></Para></ListItem><ListItem><Para><Text>“passenger vehicle” means a motor vehicle to which the Motor Vehicles (Type Approval) Regulations (Northern Ireland) 1985<FootnoteRef Ref="f00010"/> apply;</Text></Para></ListItem><ListItem><Para><Text>“same model” means, in relation to two or more vehicles, vehicles that are the same as each other in all the aspects of their technical specification relevant to the subject matter of Schedule 3 to the Approval Regulations; and</Text></Para></ListItem><ListItem><Para><Text>“Schedule 1 vehicle” has the same meaning as in Schedule 1 to the Approval Regulations.</Text></Para></ListItem></UnorderedList></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nisr/2004/65/regulation/2/2" IdURI="http://www.legislation.gov.uk/id/nisr/2004/65/regulation/2/2" id="regulation-2-2"><Pnumber>2</Pnumber><P2para><Text>For the purposes of these Regulations, a vehicle is to be regarded as being manufactured on or after a particular date if it is first assembled on or after that date, even if it includes one or more parts which were manufactured before that date.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2004-03-31" RestrictExtent="N.I."><Title>Application</Title><P1 DocumentURI="http://www.legislation.gov.uk/nisr/2004/65/regulation/3" IdURI="http://www.legislation.gov.uk/id/nisr/2004/65/regulation/3" id="regulation-3"><Pnumber><CommentaryRef Ref="key-5f3a22b71a0311259c8a09b9e289c9ed"/>3</Pnumber><P1para><Text>These Regulations apply to every motor vehicle to which Part II of the Approval Regulations applies.</Text></P1para></P1><P1 DocumentURI="http://www.legislation.gov.uk/nisr/2004/65/regulation/4" IdURI="http://www.legislation.gov.uk/id/nisr/2004/65/regulation/4" id="regulation-4"><Pnumber><CommentaryRef Ref="key-a0311b61958709ec28a79b3565091926"/><CommentaryRef Ref="key-5f3a22b71a0311259c8a09b9e289c9ed"/>4</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/nisr/2004/65/regulation/4/1" IdURI="http://www.legislation.gov.uk/id/nisr/2004/65/regulation/4/1" id="regulation-4-1"><Pnumber>1</Pnumber><P2para><Text>Subject to paragraph (2), the fee prescribed for the purposes of regulation 5(3)(b) of the Approval Regulations, in respect of an original application, is –</Text><P3 DocumentURI="http://www.legislation.gov.uk/nisr/2004/65/regulation/4/1/a" IdURI="http://www.legislation.gov.uk/id/nisr/2004/65/regulation/4/1/a" id="regulation-4-1-a"><Pnumber>a</Pnumber><P3para><Text>£200 in the case of any passenger vehicle which is a Schedule 1 vehicle;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nisr/2004/65/regulation/4/1/b" IdURI="http://www.legislation.gov.uk/id/nisr/2004/65/regulation/4/1/b" id="regulation-4-1-b"><Pnumber>b</Pnumber><P3para><Text>£85 in the case of any goods vehicle which is a Schedule 1 vehicle;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nisr/2004/65/regulation/4/1/c" IdURI="http://www.legislation.gov.uk/id/nisr/2004/65/regulation/4/1/c" id="regulation-4-1-c"><Pnumber>c</Pnumber><P3para><Text>£265 in the case of any passenger vehicle which is not a Schedule 1 vehicle but which is the subject of a model report;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nisr/2004/65/regulation/4/1/d" IdURI="http://www.legislation.gov.uk/id/nisr/2004/65/regulation/4/1/d" id="regulation-4-1-d"><Pnumber>d</Pnumber><P3para><Text>£255 in the case of any passenger vehicle which is not a Schedule 1 vehicle and is not the subject of a model report;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nisr/2004/65/regulation/4/1/e" IdURI="http://www.legislation.gov.uk/id/nisr/2004/65/regulation/4/1/e" id="regulation-4-1-e"><Pnumber>e</Pnumber><P3para><Text>£125 in the case of any goods vehicle which is not a Schedule 1 vehicle but which is the subject of a model report;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nisr/2004/65/regulation/4/1/f" IdURI="http://www.legislation.gov.uk/id/nisr/2004/65/regulation/4/1/f" id="regulation-4-1-f"><Pnumber>f</Pnumber><P3para><Text>£115 in the case of any goods vehicle which is not a Schedule 1 vehicle and is not the subject of a model report;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nisr/2004/65/regulation/4/1/g" IdURI="http://www.legislation.gov.uk/id/nisr/2004/65/regulation/4/1/g" id="regulation-4-1-g"><Pnumber>g</Pnumber><P3para><Text>£50 in the case of a goods vehicle which is of a type that has EC Type Approval but which does not have an EC certificate of conformity and where the Department is satisfied that the vehicle has been driven no more than 3000km since the date of manufacture; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nisr/2004/65/regulation/4/1/h" IdURI="http://www.legislation.gov.uk/id/nisr/2004/65/regulation/4/1/h" id="regulation-4-1-h"><Pnumber>h</Pnumber><P3para><Text>£50 in the case of any passenger vehicle which is of a type that has EC Type Approval but which does not have an EC certificate of conformity and where the Department is satisfied that the vehicle has been driven no more than 3000km since the date of manufacture.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nisr/2004/65/regulation/4/2" IdURI="http://www.legislation.gov.uk/id/nisr/2004/65/regulation/4/2" id="regulation-4-2"><Pnumber>2</Pnumber><P2para><Text>Where the condition specified in regulation 4(7)(c) of the Approval Regulations applies, the fee prescribed for the purposes of regulation 5(3)(b) of those Regulations is –</Text><P3 DocumentURI="http://www.legislation.gov.uk/nisr/2004/65/regulation/4/2/a" IdURI="http://www.legislation.gov.uk/id/nisr/2004/65/regulation/4/2/a" id="regulation-4-2-a"><Pnumber>a</Pnumber><P3para><Text>in the case of any Schedule 1 vehicle, £80;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nisr/2004/65/regulation/4/2/b" IdURI="http://www.legislation.gov.uk/id/nisr/2004/65/regulation/4/2/b" id="regulation-4-2-b"><Pnumber>b</Pnumber><P3para><Text>in the case of any vehicle which is not a Schedule 1 vehicle but which is the subject of a model report, £120; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nisr/2004/65/regulation/4/2/c" IdURI="http://www.legislation.gov.uk/id/nisr/2004/65/regulation/4/2/c" id="regulation-4-2-c"><Pnumber>c</Pnumber><P3para><Text>in the case of any vehicle which is not a Schedule 1 vehicle and which is not the subject of a model report, £110.</Text></P3para></P3></P2para></P2></P1para></P1><P1 DocumentURI="http://www.legislation.gov.uk/nisr/2004/65/regulation/5" IdURI="http://www.legislation.gov.uk/id/nisr/2004/65/regulation/5" id="regulation-5"><Pnumber><CommentaryRef Ref="key-1fab3b51d9f7eda737770e8e6c8d56fb"/><CommentaryRef Ref="key-5f3a22b71a0311259c8a09b9e289c9ed"/>5</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/nisr/2004/65/regulation/5/1" IdURI="http://www.legislation.gov.uk/id/nisr/2004/65/regulation/5/1" id="regulation-5-1"><Pnumber>1</Pnumber><P2para><Text>The fee prescribed for the purposes of regulation 5(7)(d) of the Approval Regulations, in respect of a further application, is –</Text><P3 DocumentURI="http://www.legislation.gov.uk/nisr/2004/65/regulation/5/1/a" IdURI="http://www.legislation.gov.uk/id/nisr/2004/65/regulation/5/1/a" id="regulation-5-1-a"><Pnumber>a</Pnumber><P3para><Text>£10 in the case of a goods vehicle which is of a type which has EC Type Approval but which does not have an EC certificate of conformity and where the Department is satisfied that the vehicle has been driven no more than 3000km since the date of manufacture;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nisr/2004/65/regulation/5/1/b" IdURI="http://www.legislation.gov.uk/id/nisr/2004/65/regulation/5/1/b" id="regulation-5-1-b"><Pnumber>b</Pnumber><P3para><Text>£21 in the case of any other goods vehicle;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nisr/2004/65/regulation/5/1/c" IdURI="http://www.legislation.gov.uk/id/nisr/2004/65/regulation/5/1/c" id="regulation-5-1-c"><Pnumber>c</Pnumber><P3para><Text>£10 in the case of any passenger vehicle which is of a type which has EC Type Approval but which does not have an EC certificate of conformity and where the Department is satisfied that the vehicle has been driven no more than 3000km since the date of manufacture; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nisr/2004/65/regulation/5/1/d" IdURI="http://www.legislation.gov.uk/id/nisr/2004/65/regulation/5/1/d" id="regulation-5-1-d"><Pnumber>d</Pnumber><P3para><Text>£45 in the case of any other passenger vehicle.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nisr/2004/65/regulation/5/2" IdURI="http://www.legislation.gov.uk/id/nisr/2004/65/regulation/5/2" id="regulation-5-2"><Pnumber>2</Pnumber><P2para><Text>Any fee which would otherwise be payable by virtue of regulation 5(7)(d) of the Approval Regulations, in respect of a further application, shall not be payable if, by agreement, the vehicle is submitted for examination at the place at which it was previously examined before the end of the fifth day following that examination on which the Department will accept vehicles for examination and –</Text><P3 DocumentURI="http://www.legislation.gov.uk/nisr/2004/65/regulation/5/2/a" IdURI="http://www.legislation.gov.uk/id/nisr/2004/65/regulation/5/2/a" id="regulation-5-2-a"><Pnumber>a</Pnumber><P3para><Text>the requirements of paragraph (3) are met in the case of any passenger vehicle; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nisr/2004/65/regulation/5/2/b" IdURI="http://www.legislation.gov.uk/id/nisr/2004/65/regulation/5/2/b" id="regulation-5-2-b"><Pnumber>b</Pnumber><P3para><Text>the requirements of paragraph (4) are met in the case of any goods vehicle.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nisr/2004/65/regulation/5/3" IdURI="http://www.legislation.gov.uk/id/nisr/2004/65/regulation/5/3" id="regulation-5-3"><Pnumber>3</Pnumber><P2para><Text>The requirements of this paragraph are that the further application must be due only to a failure to comply with –</Text><P3 DocumentURI="http://www.legislation.gov.uk/nisr/2004/65/regulation/5/3/a" IdURI="http://www.legislation.gov.uk/id/nisr/2004/65/regulation/5/3/a" id="regulation-5-3-a"><Pnumber>a</Pnumber><P3para><Text>the requirements of one or more items of the Table in Schedule 2 to the Approval Regulations in respect of which sufficient documentary evidence is produced to the Department before the examination to satisfy it as to compliance with those requirements; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nisr/2004/65/regulation/5/3/b" IdURI="http://www.legislation.gov.uk/id/nisr/2004/65/regulation/5/3/b" id="regulation-5-3-b"><Pnumber>b</Pnumber><P3para><Text>the requirement in item 11 of the Table in Schedule 3 to the Approval Regulations to display a child restraint warning label,</Text></P3para></P3><Text>or any combination of sub-paragraphs (a) and (b).</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nisr/2004/65/regulation/5/4" IdURI="http://www.legislation.gov.uk/id/nisr/2004/65/regulation/5/4" id="regulation-5-4"><Pnumber>4</Pnumber><P2para><Text>The requirements of this paragraph are that the further application must be due only to a failure to comply with the requirements of –</Text><P3 DocumentURI="http://www.legislation.gov.uk/nisr/2004/65/regulation/5/4/a" IdURI="http://www.legislation.gov.uk/id/nisr/2004/65/regulation/5/4/a" id="regulation-5-4-a"><Pnumber>a</Pnumber><P3para><Text>one or more items of the Table in Schedule 2 to the Approval Regulations in respect of which sufficient documentary evidence is produced to the Department before the examination to satisfy it as to compliance with the requirements of those items; RestrictStartDate="2004-03-31"><Comment><Para><Text>(This note is not part of the Regulations.)</Text></Para></Comment><P><Text>The Motor Vehicles (Approval) Regulations (Northern Ireland) 2001 (“the Approval Regulations”) as amended by the Motor Vehicles (Approval) (Amendment) Regulations (Northern Ireland) 2004 (<Citation URI="http://www.legislation.gov.uk/id/nisr/2004/30" id="c00004" Class="NorthernIrelandStatutoryRule" Year="2004" Number="0030">S.R. 2004 No. 30</Citation>) established a statutory system for approving the construction of single vehicles before they enter into service.</Text></P><P><Text>These Regulations revoke and replace the Motor Vehicles (Approval) (Fees) Regulations (Northern Ireland) 2001 (<Citation URI="http://www.legislation.gov.uk/id/nisr/2001/170" id="c00005" Class="NorthernIrelandStatutoryRule" Year="2001" Number="0170">S.R. 2001 No. 170</Citation>). They prescribe the fees payable in connection with applications made in accordance with the Approval Regulations.</Text></P><P><Text>In particular, they introduce fees payable for the basic single vehicle approval (“<Abbreviation Expansion="single vehicle approval">SVA</Abbreviation>”) test in respect of goods vehicles and for the enhanced SVA test in respect of both goods vehicles and passenger vehicles.</Text></P><P><Text>The enhanced SVA test applies to passenger vehicles and light goods vehicles imported by a commercial importer and requires compliance with more demanding standards covering important safety, security (anti-theft) and environmental aspects of vehicle design and construction, such as emissions, noise, brakes and steering.</Text></P><P><Text>The Regulations also prescribe the fee payable in connection with applications made to test passenger vehicles and light goods vehicles that have been driven for no more than 3000km since their date of manufacture and which have EC type approval but which do not have an EC certificate of conformity.
