eId="regulation-1"><heading>Citation, commencement and interpretation</heading><num>1.</num><paragraph eId="regulation-1-1"><num>(1)</num><intro><p>These Regulations may be cited as the Social Security (Housing Costs Amendments) Regulations (Northern Ireland) 2004 and shall come into operation –</p></intro><level class="para1" eId="regulation-1-1-a"><num>(a)</num><content><p>except for the purposes of regulation 5(a), on 28th November 2004, and</p></content></level><level class="para1" eId="regulation-1-1-b"><num>(b)</num><content><p>for the purposes of regulation 5(a), on 28th November 2005.</p></content></level></paragraph><paragraph eId="regulation-1-2"><num>(2)</num><content><p>The Interpretation Act (Northern Ireland) 1954<authorialNote class="footnote" eId="f00005" marker="5"><p><ref eId="c00009" href="http://www.legislation.gov.uk/id/apni/1954/33">1954 c. 33 (N.I.)</ref></p></authorialNote> shall apply to these Regulations as it applies to an Act of the Assembly.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>Amendment of the Income Support (General) Regulations</heading><num>2.</num><intro><p>In Schedule 3<authorialNote class="footnote" eId="f00006" marker="6"><p>Schedule 3 was substituted by regulation 2 of, and Schedule 1 to, <ref eId="c00010" href="http://www.legislation.gov.uk/id/nisr/1995/301">S.R. 1995 No. 301</ref></p></authorialNote> to the Income Support (General) Regulations (Northern Ireland) 1987<authorialNote class="footnote" eId="f00007" marker="7"><p><ref eId="c00011" href="http://www.legislation.gov.uk/id/nisr/1987/459">S.R. 1987 No. 459</ref>; relevant amending Regulations are <ref eId="c00012" href="http://www.legislation.gov.uk/id/nisr/1995/301">S.R. 1995 Nos. 301</ref> and <ref eId="c00013" href="http://www.legislation.gov.uk/id/nisr/1995/434">434</ref>, <ref eId="c00014" (housing costs) –</p></intro><level class="para1" eId="regulation-2-a"><num>(a)</num><intro><p>in paragraph 1(2)<authorialNote class="footnote" eId="f00008" marker="8"><p>Paragraph 1(2) was amended by regulation 2(3)(a)(i) of <ref eId="c00016" href="http://www.legislation.gov.uk/id/nisr/1995/434">S.R. 1995 No. 434</ref></p></authorialNote> (interpretation) –</p></intro><level class="para2" . . . . . . . . . . . . . . . .</p></content></level><level class="para2" eId="regulation-2-a-ii"><num>(ii)</num><content><p>in the definition of “standard rate” for “specified in”, there shall be substituted “determined in accordance with”;</p></content></level></level><level class="para1" eId="regulation-2-b"><num>(b)</num><content><p>in paragraph 10<authorialNote class="footnote" eId="f00009" marker="9"><p>Paragraph 10 was substituted by regulation 2(1) of <ref eId="c00017" href="http://www.legislation.gov.uk/id/nisr/2001/406">S.R. 2001 No. 406</ref></p></authorialNote> (the calculation for loans), in the explanation of “B”, for “specified in respect of that loan under paragraph 12” there shall be substituted “applicable in respect of that loan”;</p></content></level><level class="para1" eId="regulation-2-c"><num>(c)</num><content><p><mod>for paragraph 12<authorialNote class="footnote" eId="f00010" marker="10"><p>Paragraph 12 was amended by <ref eId="c00018" href="http://www.legislation.gov.uk/id/nisr/2004/366">S.R. 2004 No. 366</ref></p></authorialNote> (the standard rate) there shall be substituted the following paragraph –<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><article><num>12.</num><paragraph><num>(1)</num><content><p>The standard rate is the rate of interest applicable per annum to a loan which qualifies under this Schedule.</p></content></paragraph><paragraph><num>(2)</num><intro><p>Subject to sub-paragraphs (3), (4) and (6), the standard rate shall be 1.58 per cent. plus –</p></intro><level class="para1"><num>(a)</num><content><p>the rate announced from time to time by the Monetary Policy Committee of the Bank of England as the official dealing rate, being the rate at which the Bank is willing to enter into transactions for providing short term liquidity in the money markets, or</p></content></level><level class="para1"><num>(b)</num><content><p>where an order under section 19 of the Bank of England Act 1998<authorialNote class="footnote" eId="f00011" marker="11"><p><ref eId="c00019" href="http://www.legislation.gov.uk/id/ukpga/1998/11">1998 c. 11</ref></p></authorialNote> (reserve powers) is in force, any equivalent rate determined by the Treasury under that section.</p></content></level></paragraph><paragraph><num>(3)</num><content><p>The Department shall determine the date from which the standard rate calculated in accordance with sub-paragraph (2) takes effect<authorialNote class="footnote" eId="f00012" marker="12"><p>The date determined by the Department and the amount of the standard rate are published on the Department for Social Development website: <a href="http://www.dsd.nigov.net">www.dsd.nigov.net</a></p></authorialNote>.</p></content></paragraph><paragraph><num>(4)</num><intro><p>Where –</p></intro><level class="para1"><num>(a)</num><content><p>the actual rate of interest charged on the loan which qualifies under this Schedule is less than 5 per cent. per annum on the day the housing costs first fall to be met, and</p></content></level><level class="para1"><num>(b)</num><content><p>that day occurs before 28th November 2004,</p></content></level><wrapUp><p>the standard rate shall be equal to that actual rate.</p></wrapUp></paragraph><paragraph><num>(5)</num><intro><p>Sub-paragraph (4) shall cease to apply in a particular case to any one or more loans which fall within that sub-paragraph on whichever of the following dates occurs first –</p></intro><level class="para1"><num>(a)</num><content><p>the date on which the actual rate of interest charged on such a loan is 5 per cent. per annum or higher,</p></content></level><level class="para1"><num>(b)</num><content><p>the anniversary of the date on which the housing costs first fell to be met, or</p></content></level><level class="para1"><num>(c)</num><content><p>where a supersession decision based on a change of circumstances arising on or after 28th November 2004 is made under Article 11 of the Social Security (Northern Ireland) Order 1998 (decisions superseding earlier decisions)<authorialNote class="footnote" eId="f00013" marker="13"><p><ref eId="c00020" href="http://www.legislation.gov.uk/id/nisi/1998/1506">S.I. 1998/1506 (N.I. 10)</ref>; Article 11 was amended by paragraph 17 of Schedule 6, and Part I of Schedule 9 to, the Social Security Contributions (Transfer of Functions, <abbr title="et cetera" xml:lang="la">etc.</abbr>) (Northern Ireland) Order 1999 (<ref eId="c00021" href="http://www.legislation.gov.uk/id/uksi/1999/671">S.I. which qualifies under this Schedule, the standard rate shall be 5.88 per cent. until the first date determined by the Department under sub-paragraph They also make minor consequential amendments to the Social Security (Claims and Payments) Regulations (Northern Ireland) 1987.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulations 2(a)(ii) and 3(a)(ii) amend Schedule 3 to the Income Support (General) Regulations (Northern Ireland) 1987 and Schedule 2 to the Jobseeker’s Allowance Regulations (Northern Ireland) 1996 respectively to provide the circumstances in which a claimant can remortgage and the standard rate will still be set by reference to the actual rate of interest on their loan.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulations 2(c), 3(c) and 4(c) substitute the same new provisions in the <abbr title="Income Support (General) Regulations (Northern Ireland) 1987 (S.R. 1987/459), the Jobseeker’s Allowance Regulations (Northern Ireland) 1996 and the State Pension Credit Regulations (Northern Ireland) 2003 (S.R. 2003/28)">principal sets of Regulations</abbr>. These new paragraphs set the standard rate which is used to calculate the amount of interest on a loan that will be met under those Regulations. The new sub-paragraphs (2) and (3) set the standard rate by reference to the Bank of England base rate from a date to be determined by the Department. The new sub-paragraph (4) applies to specified cases and sets the standard rate by reference to the actual rate of interest on a loan. By virtue of the new sub-paragraph (5) these specified cases will move onto the standard rate determined in accordance with the new sub-paragraph (2) during the year after these Regulations come into operation. The new sub-paragraph 6 sets the standard rate for a transitional period.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 5 makes consequential amendments to the Social Security (Claims and Payments) Regulations (Northern Ireland) 1987. Amendment (a) comes into operation a year after the other provisions in these Regulations by which time the wording omitted will be redundant.</p></blockContainer><blockContainer ukl:Name="P"><p>These Regulations make in relation to Northern Ireland only provision corresponding to provision contained in Regulations made by the Secretary of State for Work and Pensions in relation to Great Britain and accordingly, by virtue of section 149(3) of, and paragraph 10 of Schedule 5 to, the Social Security Administration (Northern Ireland) Act <ref eId="c00001" href="http://www.legislation.gov.uk/id/ukpga/1992/8">1992 (c. 8)</ref>, are not subject to requirement of section 149(2) of that Act for prior reference to the Social Security Advisory Committee.</p></blockContainer><blockContainer ukl:Name="P"><p>These Regulations do not impose a charge on business.</p></blockContainer></blockContainer></conclusions></act></akomaNtoso>
