<Text>These Regulations may be cited as the Plant Protection Products (Fees) Regulations (Northern Ireland) 2004 and shall come into operation on 21st October 2004.</Text>
</P2para>
</P2>

<Pnumber>2</Pnumber>

<Text>In these Regulations –</Text>

<Text>“<Abbreviation Expansion="Council Directive 91/414/EEC concerning the placing of plant protection products on the market amended as set out in the definition of 'the Directive' in the Plant Protection Products Regulations (Northern Ireland) 2004 (S.R. 2004/126)">1991 Directive</Abbreviation>” means Council Directive <Citation URI="http://www.legislation.gov.uk/european/directive/1991/0414" id="c00001" Class="EuropeanEconomicCommunityDirective" Year="1991" Number="414">91/414/<Acronym Expansion="European Economic Community">EEC</Acronym></Citation> concerning the placing of plant protection products on the market<FootnoteRef Ref="f00003"/> amended as set out in the definition of “the Directive” in the <Abbreviation Expansion="Plant Protection Products Regulations (Northern Ireland) 2004 (S.R. 2004/126)">2004 Regulations</Abbreviation>;</Text>

<Text>“the 2004 Regulations” means the Plant Protection Products Regulations (Northern Ireland) 2004<FootnoteRef Ref="f00004"/>;</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“data” means scientific evidence submitted in support of an application under the 2004 Regulations; and</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“<Abbreviation Expansion="the Department of Agriculture and Rural Development">the Department</Abbreviation>” means the Department of Agriculture and Rural Development.</Text>
</Para>
</ListItem>

<Text>The Interpretation Act (Northern Ireland) 1954<FootnoteRef Ref="f00005"/> shall apply to these Regulations as it applies to an Act of the Northern Ireland Assembly.</Text>
</P2para>
</P2>
</P1para>
</P1>
</P1group>
<P1group>
<Title>Fees in connection with applications under the Plant Protection Products Regulations (Northern Ireland) 2004</Title>
<P1 DocumentURI="http://www.legislation.gov.uk/nisr/2004/372/regulation/2/made" IdURI="http://www.legislation.gov.uk/id/nisr/2004/372/regulation/2" id="regulation-2">
<Pnumber>2</Pnumber>
<P1para>
<P2 DocumentURI="http://www.legislation.gov.uk/nisr/2004/372/regulation/2/1/made" IdURI="http://www.legislation.gov.uk/id/nisr/2004/372/regulation/2/1" id="regulation-2-1">
<Pnumber>1</Pnumber>
<P2para>
<Text>An applicant under regulation 4 (active substances) or 10 (extensions) of, or for an approval under, the 2004 Regulations shall pay a fee to the Department in accordance with this regulation.</Text>
</P2para>
</P2>
<P2 DocumentURI="http://www.legislation.gov.uk/nisr/2004/372/regulation/2/2/made" IdURI="http://www.legislation.gov.uk/id/nisr/2004/372/regulation/2/2" id="regulation-2-2">
<Pnumber>2</Pnumber>
<P2para>
<Text>The following persons shall also pay a fee in accordance with this regulation –</Text>
<P3 DocumentURI="http://www.legislation.gov.uk/nisr/2004/372/regulation/2/2/a/made" IdURI="http://www.legislation.gov.uk/id/nisr/2004/372/regulation/2/2/a" id="regulation-2-2-a">
<Pnumber>a</Pnumber>
<P3para>
<Text>a person making a request under regulation 13(7)(b) (modifications) of the 2004 Regulations,</Text>
</P3para>
</P3>
<P3 DocumentURI="http://www.legislation.gov.uk/nisr/2004/372/regulation/2/2/b/made" IdURI="http://www.legislation.gov.uk/id/nisr/2004/372/regulation/2/2/b" id="regulation-2-2-b">
<Pnumber>b</Pnumber>
<P3para>
<Text>a person making a request to the Department for initial or the renewed official recognition of a testing facility under paragraph 2.2 or 2.3 of Annex <Acronym Expansion="3">III</Acronym> to the 1991 Directive, and</Text>
</P3para>
</P3>
<P3 DocumentURI="http://www.legislation.gov.uk/nisr/2004/372/regulation/2/2/c/made" IdURI="http://www.legislation.gov.uk/id/nisr/2004/372/regulation/2/2/c" id="regulation-2-2-c">
<Pnumber>c</Pnumber>
<P3para>
<Text>a person covered by Note C in the Schedule,</Text>
</P3para>
</P3>
<Text>and for the purposes of these Regulations such persons shall be treated as applicants and their requests as applications.</Text>
</P2para>
</P2>
<P2 DocumentURI="http://www.legislation.gov.uk/nisr/2004/372/regulation/2/3/made" IdURI="http://www.legislation.gov.uk/id/nisr/2004/372/regulation/2/3" id="regulation-2-3">
<Pnumber>3</Pnumber>
<P2para>
<Text>The fee is the total of the amounts specified within the Table set out in the Schedule, as read with the notes, for each type of examination or related activity called for by the application, but if a lower sum (following consideration of actual work involved in examining any relevant application) is notified as the fee by the Department to the applicant then the fee is the lower sum.</Text>
</P2para>
</P2>
<P2 DocumentURI="http://www.legislation.gov.uk/nisr/2004/372/regulation/2/4/made" IdURI="http://www.legislation.gov.uk/id/nisr/2004/372/regulation/2/4" id="regulation-2-4">
<Pnumber>4</Pnumber>
<P2para>
<Text>Payment shall be made in accordance with any invoice for the fee (or the balance) sent to the applicant by the Department, and the Department shall be under no obligation to process the application so long as there is a failure to make any such payment.</Text>
</P2para>
</P2>
<P2 DocumentURI="http://www.legislation.gov.uk/nisr/2004/372/regulation/2/5/made" IdURI="http://www.legislation.gov.uk/id/nisr/2004/372/regulation/2/5" id="regulation-2-5">
<Pnumber>5</Pnumber>
<P2para>
<Text>On completion of all examinations and related activities involved in processing the application, any difference between what has been paid and the fee shall be paid or refunded.</Text>
</P2para>
</P2>
<P2 DocumentURI="http://www.legislation.gov.uk/nisr/2004/372/regulation/2/6/made" IdURI="http://www.legislation.gov.uk/id/nisr/2004/372/regulation/2/6" id="regulation-2-6">
<Pnumber>6</Pnumber>
<P2para>
<Text>Any amount due under this regulation but unpaid is recoverable upon a demand in writing being sent to the person from whom it is due.</Text>
</P2para>
</P2>

<Pnumber>7</Pnumber>

<Text>In any proceedings relating to an application under these Regulations, a certificate of the Department as to the amount payable in connection with the application shall be evidence of the amount in question.</Text>
</P2para>

<P1group>
<Title>Transitional provisions</Title>

<Pnumber>1</Pnumber>
<P2para>
<Text>Subject to paragraph (2) these Regulations shall not apply in respect of any application made before the date on which these Regulations come into operation.</Text>
</P2para>
</P2>

<Text>The amount of any fee relating to any activity carried out on or after the date on which these Regulations come into operation in connection with any application made before the date on which they come into operation is based on the fee specified in these Regulations.</Text>

<Title>Revocation</Title>

<Pnumber>1</Pnumber>

<Text>The Plant Protection Products (Fees) Regulations (Northern Ireland) 1995<FootnoteRef Ref="f00006"/> and the Plant Protection Products (Fees) (Amendment) Regulations 1997<FootnoteRef Ref="f00007"/> are hereby revoked.</Text>
</P2para>
</P2>
<P2 DocumentURI="http://www.legislation.gov.uk/nisr/2004/372/regulation/4/2/made" IdURI="http://www.legislation.gov.uk/id/nisr/2004/372/regulation/4/2" id="regulation-4-2">
<Pnumber>2</Pnumber>

<Text>The Regulations referred to in paragraph (1) shall continue to have effect in relation to any services provided or approvals granted by the Department (within the meaning of those Regulations) before the date on which these Regulations come into operation as if these Regulations had not been made.</Text>

<Text>These Regulations revoke and replace the Plant Protection Products (Fees) Regulations (Northern Ireland) 1995 and its 1997 amendment covering fees to be paid to the Department of Agriculture and Rural Development in connection with examinations for approval under the Plant Protection Products Regulations (Northern Ireland) 2004. The new 2004 Regulations continue to implement Council Directive <Citation URI="http://www.legislation.gov.uk/european/directive/1991/0414" id="c00002" Class="EuropeanEconomicCommunityDirective" Year="1991" Number="414">91/414/EEC</Citation> concerning the placing of plant protection products on the market, as amended, in relation to Northern Ireland.</Text>
</P>

<Text>These Regulations introduce a new fee structure largely based on a modular approach founded on component examination elements, depending on the extent of examination called for by the type of application as well as the statutory examination function involved. The fee modules (Item A in the Table within the Schedule) are categorised into a preliminary examination charge, miscellaneous application charges and charges for specialist evaluations.</Text>

<Text>This new approach is not however to be applied to fees related to applications for products containing new active substances under the Directive <Citation URI="http://www.legislation.gov.uk/european/directive/1991/0414" id="c00003" Class="EuropeanEconomicCommunityDirective" Year="1991" Number="414">91/414/EEC</Citation>, (Item B in the Table within the Schedule) where each such application requires examination of a full dossier of data and other information. Resubmission of such an application for approval where an earlier application has been unsuccessful involves a tiered, tapering fee dependent on the relevant percentage of the full data package required for the unsuccessful application. Similarly the new approach is not applied to fees in respect of recognition of testing facility under the Directive (Item C in the Table).</Text>

<Text>The Regulations introduce a new £10,000 fee (item B(5)) to cover the costs of acting as a co-rapporteur Member State for a new active substance following a specific request from a person involved and responsible as a notifier of that substance under Council Directive <Citation URI="http://www.legislation.gov.uk/european/directive/1991/0414" id="c00004" Class="EuropeanEconomicCommunityDirective" Year="1991" Number="414">91/414/EEC</Citation> for Annex I inclusion.</Text>
