The Department of the Environment, in exercise of the powers conferred on it by Articles 55(1) and (2) and 110(2) of the Road Traffic (Northern Ireland) Order 1995(1) and of every other power enabling it in that behalf, hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Motor Vehicles (Construction and Use) (Amendment No. 5) Regulations (Northern Ireland) 2004 and shall come into operation on 18th November 2004.

Amendment of the Motor Vehicles (Construction and Use) Regulations (Northern Ireland) 1999

2.  In regulation 2(1) of the Motor Vehicles (Construction and Use) Regulations (Northern Ireland) 1999(2), in the definition of “heavy motor car”, for “3050 kg” there shall be substituted “2540 kg”.

Explanatory Note

(This note is not part of the Regulations.)

These Regulations further amend the Motor Vehicles (Construction and Use) Regulations (Northern Ireland) 1999 (“the 1999 Regulations”) in order to correct an anomaly between the definition of a “heavy motor car” in the 1999 Regulations and the definition of a “heavy motor car” in the Road Traffic (Northern Ireland) Order 1995.

In the 1999 Regulations the definition of a “heavy motor car” is amended to bring it into line with the Road Traffic (Northern Ireland) Order 1995 wherein a “heavy motor car” is defined as having an unladen weight exceeding 2540 kilograms.
