The Department of Agriculture and Rural Development(1), in exercise of the powers conferred on it by sections 3(3), 7(2) and 11(1) of the Marketing of Potatoes Act (Northern Ireland) 1964(2) and of every other power enabling it in that behalf, and with the approval of the Department of Finance and Personnel(3), hereby makes the following Regulations:
1. These Regulations may be cited as the Marketing of Potatoes (Amendment) Regulations (Northern Ireland) 2004 and shall come into operation on 1st September 2004.
2. The Marketing of Potatoes Regulations (Northern Ireland) 1989(4) shall be amended as follows –
(a)in paragraph (1) of regulation 7 (Fees for the inspection of ware potatoes sent out of Northern Ireland) for “£3·55” there shall be substituted “£3·75”;
(b)in regulation 8 (Fees for the examination of ware potatoes for sale in Northern Ireland) for “£3·55” there shall be substituted “£3·75”.
3. The Marketing of Potatoes (Amendment) Regulations (Northern Ireland) 2003(5) are hereby revoked.

These Regulations revoke and replace the Marketing of Potatoes (Amendment) Regulations (Northern Ireland) 2003.
The Regulations increase the fee payable for the inspection or examination of ware potatoes from £3·55 per tonne or part of a tonne to £3·75 per tonne or part of a tonne.
