The Smoke Control Areas (Exempted Fireplaces) (Amendment) Regulations (Northern Ireland) 2003

The Department of the Environment, in exercise of the powers conferred upon it by Article 17(7) of the Clean Air (Northern Ireland) Order 1981(1) and of every other power enabling it in that behalf, being satisfied that the classes of fireplace prescribed in column (1) of the Schedule can be used for burning fuel other than authorised fuels without producing a substantial quantity of smoke, hereby makes the following Regulations:

Citation, commencement and interpretation

1.  These Regulations may be cited as the Smoke Control Areas (Exempted Fireplaces) (Amendment) Regulations (Northern Ireland) 2003 and shall come into operation on 1st September 2003.

Amendment

2.  The classes of fireplace described in paragraphs 4(b) and 16(a) as listed in the Schedule to these Regulations shall be added to Schedule 1 to the Smoke Control Areas (Exempted Fireplaces) Regulations (Northern Ireland) 1999(2) after paragraphs 4(a) and 16 respectively.

Class of FireplaceConditions

4—(b). The B9 Energy Wood Chip Gasifier Unit manufactured by B9 Energy Biomass Limited.

1.  The fireplace shall be installed, maintained and operated in accordance with the manufacturers instructions dated 2002 and bearing the reference “001/B9ENERGY BIOMASS”.

2.  No fuel should be used other than untreated wood chips, shredded wood or small untreated pieces of wood.

16—(a). The Mawera Fu-ria models 110, 140, 180, 220, 280, and 350 manufactured by Mawera (UK) Limited.

1.  The fireplace shall be installed, maintained and operated in accordance with the manufacturers instructions dated 31 October 2002 and bearing the reference 098234-01.

2.  No fuel should be used other than natural wood or wood products, forest residues and forest thinnings, melamine coated or uncoated MDF chipboard, plywood and compound wood products.

Explanatory Note

(This note is not part of the Regulations.)

These Regulations further amend the Smoke Control Areas (Exempted Fireplaces) Regulations (Northern Ireland) 1999 by prescribing additional fireplaces, which are exempted from the provisions of Article 17 of the Clean Air (Northern Ireland) Order 1981.
