the following Regulations:</p></formula></preamble><body eId="body"><hcontainer name="regulation" eId="regulation-1"><heading>Citation and commencement</heading><num>1.</num><content><p>These Regulations may be cited as the Social Security (Credits) (Amendment) Regulations (Northern Ireland) 2003 and shall come into operation on 6th April 2003.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>Amendment of the Social Security (Credits) Regulations</heading><num>2.</num><paragraph eId="regulation-2-1"><num>(1)</num><content><p>The Social Security (Credits) Regulations (Northern Ireland) 1975<authorialNote class="footnote" eId="f00003" marker="3"><p><ref eId="c00008" href="http://www.legislation.gov.uk/id/nisr/1975/113">S.R. 1975 No. 113</ref>; relevant amending Regulations are <ref eId="c00009" href="http://www.legislation.gov.uk/id/nisr/1988/105">S.R. 1988 Nos. 105</ref> and <ref eId="c00010" href="http://www.legislation.gov.uk/id/nisr/1988/326">326</ref>, <ref eId="c00011" href="http://www.legislation.gov.uk/id/nisr/1995/150">S.R. 1995 No. 150</ref> and <ref eId="c00012" href="http://www.legislation.gov.uk/id/nisr/1996/430">S.R. 1996 No. 430</ref></p></authorialNote> shall be amended in accordance with paragraphs (2) and (3).</p></content></paragraph><paragraph eId="regulation-2-2"><num>(2)</num><intro><p>In regulation 8B(2)<authorialNote class="footnote" eId="f00004" marker="4"><p>Regulation 8B was inserted by regulation 2(6) of <ref eId="c00013" href="http://www.legislation.gov.uk/id/nisr/1996/430">S.R. 1996 No. 430</ref></p></authorialNote> (which specifies weeks in respect of which a person is entitled to be credited with earnings for incapacity for work) –</p></intro><level class="para1" eId="regulation-2-2-a"><num><noteRef href="#key-aba8839ef4706fc29328ed2ff7ce5dac" uk:name="commentary" ukl:Name="CommentaryRef" class="footnote" eId="f00006" marker="6"><p>Definition of “Contributions and Benefits Act” was inserted by regulation 6(2) of <ref eId="c00016" href="http://www.legislation.gov.uk/id/nisr/1995/150">S.R. 1995 No. 150</ref></p></authorialNote>,</p></content></level><level class="para2"><num>(ii)</num><content><p>Article 18 of the Naval, Military and Air Forces Etc. to which there are amendments not relevant to these Regulations</p></authorialNote>.</p></content></level></level></quotedStructure><inline name="appendText">.</inline></mod></p></content></level></paragraph><paragraph eId="regulation-2-3"><num>(3)</num><content><p><mod>For regulation 9C<authorialNote class="footnote" eId="f00009" marker="9"><p>Regulation 9C was inserted by regulation 3 of <ref eId="c00019" href="http://www.legislation.gov.uk/id/nisr/1988/105">S.R. 1988 No. 105</ref> and amended by regulation 2(4) of <ref eId="c00020" href="http://www.legislation.gov.uk/id/nisr/1988/326">S.R. 1988 No. 326</ref></p></authorialNote> (credits for maternity pay period), there shall be substituted the following regulation –<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="nisr" ukl:TargetClass="secondary" ukl:TargetSubClass="regulation" ukl:Context="main" ukl:Format="default"><hcontainer name="regulation"><heading>Credits for adoption pay period and maternity pay period</heading><num>9C.</num><paragraph><num>(1)</num><intro><p>For the purposes of entitlement to any benefit by virtue of –</p></intro><level class="para1"><num>(a)</num><content><p>in the case of a person referred to in paragraph (2)(a), that person’s earnings or contributions;</p></content></level><level class="para1"><num>(b)</num><content><p>in the case of a woman referred to in paragraph (2)(b), her earnings or contributions,</p></content></level><wrapUp><p>that person or that woman, as the case may be, shall be entitled to be credited with earnings equal to the lower earnings limit then in force in respect of each week to which this regulation applies.</p></wrapUp></paragraph><paragraph><num>(2)</num><intro><p>Subject to paragraphs (3) and (4) this regulation applies to each week during –</p></intro><level class="para1"><num>(a)</num><content><p>the adoption pay period in respect of which statutory adoption pay was paid to a person, or</p></content></level><level class="para1"><num>(b)</num><content><p>the maternity pay period in respect of which statutory maternity pay was paid to a woman.</p></content></level></paragraph><paragraph><num>(3)</num><intro><p>A person or woman referred to in paragraphs (1) and (2) shall be entitled to be credited with earnings in respect of a week by virtue of this regulation only if he or she –</p></intro><level class="para1"><num>(a)</num><content><p>furnished to the Department notice in writing of his or her claim to be entitled to be credited with earnings, and</p></content></level><level class="para1"><num>(b)</num><intro><p>did so –</p></intro><level class="para2"><num>(i)</num><content><p>before the end of the benefit year immediately following the tax year in which that week began, or</p></content></level><level class="para2"><num>(ii)</num><content><p>within such further time as may be reasonable in the circumstances of his or her case.</p></content></level></level></paragraph><paragraph><num>(4)</num><content><p>This regulation shall not apply to a woman in respect of any week in any part of which she was a married woman in respect of whom an election made by her under regulations made under section 19(4) of the Contributions and Benefits Act had effect.</p></content></paragraph><paragraph><num>(5)</num><content><p>In this regulation “adoption pay period”, “maternity pay period”, “statutory adoption pay” and “statutory maternity pay” have the same meaning as in the Contributions and Benefits Act<authorialNote class="footnote" eId="f00010" marker="10"><p><i>See</i> Part XII (Statutory Maternity Pay) and Part XIIZB (Statutory Adoption Pay) of the Social Security Contributions and Benefits (Northern Ireland) Act 1992; Regulation 8B is also amended to provide for the award of credits in respect of any part of a week during which an unemployability allowance was payable under the Naval, Military and Air Forces Etc. (Disablement and Death) Service Pensions Order 1983 (<ref eId="c00002" href="http://www.legislation.gov.uk/id/uksi/1983/883">S.I. 1983/883</ref>) or the Personal Injuries (Civilians) Scheme 1983 (<ref eId="c00003" href="http://www.legislation.gov.uk/id/uksi/1983/686">S.I. 1983/686</ref>).</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 2(3) substitutes regulation 9C of the 1975 Regulations to provide for an award of credits in respect of any week during which a person was paid statutory adoption pay or statutory maternity pay.</p></blockContainer><blockContainer ukl:Name="P"><p>These Regulations correspond to provision contained in Regulations made by the Secretary of State for Work and Pensions in relation to Great Britain and accordingly, by virtue of section 149(3) of, and paragraph 10 of Schedule 5 to, the Social Security Administration (Northern Ireland) Act <ref eId="c00004" href="http://www.legislation.gov.uk/id/ukpga/1992/8">1992 (c. 8)</ref>, are not subject to the requirement of section 149(2) of that Act for prior reference to the Social Security Advisory Committee.</p></blockContainer><blockContainer ukl:Name="P"><p>These Regulations do not impose a charge on business.</p></blockContainer></blockContainer></conclusions></act></akomaNtoso>
