The Secretary of State, in exercise of the powers conferred on him by section 46(6)(a) and (7) of the Justice (Northern Ireland) Act 2002(1), hereby makes the following Order:
1. This Order may be cited as the Justice (Northern Ireland) Act 2002 (Amendment of section 46(1)) Order 2002 and shall come into force on the day after the day on which it is made.
2.—(1) Section 46(1) of the Justice (Northern Ireland) Act 2002 (organisations subject to inspection by the Chief Inspector of Criminal Justice in Northern Ireland) shall be amended as follows.
(2) At the end of paragraph (i) omit “and”.
(3) After paragraph (j) insert–
“(k)the Northern Ireland Child Support Agency,
(l)the Department of Enterprise, Trade and Investment,
(m)the Department of the Environment,
(n)the Health and Safety Executive for Northern Ireland,
(o)the Northern Ireland Tourist Board,
(p)the Police Ombudsman for Northern Ireland,
(q)the Royal Mail Group plc, and
(r)the Northern Ireland Social Security Agency.”.
3. In section 63(1) of the Police (Northern Ireland) Act 1998(2) (restriction on disclosure of information), after paragraph (c) there shall be inserted–
“(ca)for the purposes of an inspection of the Ombudsman carried out by the Chief Inspector of Criminal Justice in Northern Ireland under Part 3 of the Justice (Northern Ireland) Act 2002;”.

This Order adds to the list of organisations set out in section 46(1) of the Justice (Northern Ireland) Act 2002 (the “2002 Act”) which the Chief Inspector of Criminal Justice in Northern Ireland is under a duty to inspect. It also makes a consequential amendment to section 63(1) of the Police (Northern Ireland) Act 1998 (the “1998 Act”) which has the effect that disclosure of documents or information by the Ombudsman or a member of staff of the Ombudsman to an inspector under section 48 of the 2002 Act, in relation to an inspection of the Ombudsman will not constitute a criminal offence under section 63 of the 1998 Act.
