The Welfare Reform and Pensions (1999 Order) (Commencement No. 10) Order (Northern Ireland) 2002

The Department for Social Development, in exercise of the powers conferred by Article 1(2) of the Welfare Reform and Pensions (Northern Ireland) Order 19991, and now vested in it2, and of all other powers enabling it in that behalf, hereby makes the following Order:

Citation and interpretation1.

(1)

This Order may be cited as the Welfare Reform and Pensions (1999 Order) (Commencement No. 10) Order (Northern Ireland) 2002.

(2)

In this Order any reference to a numbered Article or Schedule is to the Article of, or the Schedule to, the Welfare Reform and Pensions (Northern Ireland) Order 1999 bearing that number.

Appointed day2.

The day appointed for the coming into operation of—

(a)

Articles 12 to 15 (pensions and bankruptcy) in so far as not already in operation;

(b)

paragraph 5 of Schedule 2 (miscellaneous amendments), in so far as not already in operation, and Article 17 in so far as it relates to that paragraph;

(c)

paragraphs 53 and 54 of Schedule 9 (consequential amendments) and Article 74(1) in so far as it relates to those paragraphs; and

(d)

the following repeals in Part I of Schedule 10 (repeals) and Article 76 in so far as it relates to them—

(i)

section 155(5) of the Pension Schemes (Northern Ireland) Act 19933, and

(ii)

in the Pensions (Northern Ireland) Order 19954

(aa)

Article 89(3),

(bb)

in Article 90(2), sub-paragraph (b) and the word “or” preceding it, and

(cc)

Article 93,

is 6th April 2002.

Amendment of the Welfare Reform and Pensions (1999 Order) (Commencement No. 9) Order3.

Article 2(b) of the Welfare Reform and Pensions (1999 Order) (Commencement No. 9) Order (Northern Ireland) 20015 shall be omitted.

This Order provides for the coming into operation on 6th April 2002 of Articles 12 to 15 of the Welfare Reform and Pensions (Northern Ireland) Order 1999 (which concern the effect of bankruptcy on an individual’s pension rights) and related consequential amendments and repeals in Schedules 9 and 10 to that Order.

Article 3 amends the Welfare Reform and Pensions (1999 Order) (Commencement No. 9) Order (Northern Ireland) 2001 to revoke the day previously appointed for the coming into operation of provision in relation to occupational pension schemes for certificates etc. relating to minimum funding requirement.
