The Northern Ireland Policing Board (Prescribed Period) Regulations 2001

In exercise of the powers conferred upon him by paragraph 7 of Schedule 1 to the Police (Northern Ireland) Act 20001, the Secretary of State hereby makes the following Regulations:

(1)

These Regulations may be cited as the Northern Ireland Policing Board (Prescribed Period) Regulations 2001 and shall come into force on 2nd February 2001.

(2)

The Interpretation Act (Northern Ireland) 19542 applies to these Regulations as it applies to an Act of the Northern Ireland Assembly.

(3)

The Northern Ireland Policing Board (Prescribed Period) Regulations 20003 are hereby revoked.

(1)

Subject to paragraph (2) below the prescribed period for the purposes of paragraph 7 of Schedule 1 to the Police (Northern Ireland) Act 2000 is 15 days.

(2)

For the purposes of paragraph 7(5) and (11) the prescribed period is three days.

(3)

The further period referred to in paragraph 7(11) is three days.

These Regulations, which revoke the Northern Ireland Policing Board (Prescribed Period) Regulations 2000, prescribe the period of 15 days as the period during which the process of appointing political members to the Northern ireland Policing Board should be completed. They also provide for a period of three days during which a political party’s nominating officer should make a nomination and the nominated person should take up office. Where a vacancy arises because of resignation or disqualification, the Regulations provide for a further period of three days during which the vacancy should be filled if the relevant nominating officer fails to nominate or the nominated person does not take up office.
