Disregard of discretionary housing payments2There shall be added as—a. . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . .bparagraph 71 of Schedule 9 to the Income Support Regulations;cparagraph 67 of Schedule 6 to the Jobseeker’s Allowance Regulations,the following paragraph—Any discretionary housing payment paid pursuant to regulation 2(1) of the Discretionary Financial Assistance Regulations (Northern Ireland) 2001..2There shall be inserted as—a. . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . .bsub-paragraph (c) in paragraph 7 of Schedule 10 to the Income Support Regulations;csub-paragraph (d) in paragraph 12 of Schedule 7 to the Jobseeker’s Allowance Regulations,the following sub-paragraph—Any discretionary housing payment paid pursuant to regulation 2(1) of the Discretionary Financial Assistance Regulations (Northern Ireland) 2001,. These Regulations further amend the Housing Benefit (General) Regulations (Northern Ireland) 1987, the Income Support (General) Regulations (Northern Ireland) 1987 and the Jobseeker’s Allowance Regulations (Northern Ireland) 1996.

In particular, regulation 2 provides that discretionary housing payments paid pursuant to the Discretionary Financial Assistance Regulations (Northern Ireland) 2001 shall be disregarded as income in those benefits and that arrears of such payments shall be disregarded as capital for up to 52 weeks.

These Regulations make in relation to Northern Ireland only provision corresponding to provision contained in Regulations made by the Secretary of State for Work and Pensions in relation to Great Britain and accordingly, by virtue of section 149(3) of, and paragraph 10 of Schedule 5 to, the Social Security Administration (Northern Ireland) Act 1992, are not subject to the requirement of section 149(2) of that Act for prior reference to the Social Security Advisory Committee.

These Regulations do not impose a charge on business.
