Code of Practice 2 1 Subject to paragraph (2), the Department of Higher and Further Education, Training and Employment hereby appoints 17th June 2001 as the day on which the Code of Practice on Access to Workers during Recognition and Derecognition Ballots, a draft of which was prepared and published by the Department on 28th February 2000 under Article 95(2) of the Industrial Relations (Northern Ireland) Order 1992, shall have effect. 2 The Code referred to in paragraph (1) shall not have effect in relation to any proceedings which were before a court, an industrial tribunal or the Industrial Court immediately before 17th June 2001. This Order brings into operation, on 17th June 2001, the Code of Practice on Access to Workers during Recognition and Derecognition Ballots, which is issued by the Department of Higher and Further Education, Training and Employment under Article 95(1) of the Industrial Relations (Northern Ireland) Order 1992.

The Code of Practice shall be admissible in evidence in any proceedings before a Court or Industrial Tribunal or the Industrial Court and any provision of the Code which appears to the Court, Industrial Tribunal or Industrial Court to be relevant to any question arising in those proceedings shall be taken into account in determining that question.
