and</p></item><item><num>(d)</num><p>poultry farming,</p></item></blockList><p>and products of first-stage processing directly relating to such products;</p></item><item><p>“agricultural purpose” includes horticulture, fruit growing, seed growing, dairy farming and livestock breeding and keeping, the use of land as grazing land and meadow land, and the use of land for woodlands where that use is ancillary to the farming of land for other agricultural purposes;</p></item><item><p>“the <abbr title="Council Regulation (EEC) No. 3820/85 of 20th December 1985 on harmonisation of certain social legislation relating to road transport">Council Regulation</abbr>” means Council Regulation <ref eId="c00001" href="http://www.legislation.gov.uk/european/regulation/1985/3820">(<abbr class="acronym" title="European Economic Community">EEC</abbr>) <abbr title="Number">No.</abbr> 3820/85</ref> of 20th December 1985 on the harmonisation of certain social legislation relating to road transport<authorialNote class="footnote" eId="f00003" marker="3"><p>O.J. <abbr title="Number">No.</abbr> L370, 31.12.85, p. 1</p></authorialNote>;</p></item><item><p>“farm” means land which is occupied for agricultural purposes, including any dwelling-house or other building occupied by the same person for the purpose of farming the land;</p></item><item><p>“feeding stuff” means—</p><blockList class="ordered alpha parens" ukl:Name="OrderedList" ukl:Type="alpha" ukl:Decoration="parens"><item><num>(a)</num><p>a product of vegetable or animal origin in its natural state (whether fresh or preserved);</p></item><item><num>(b)</num><p>a product derived from the industrial processing of such a product; or</p></item><item><num>(c)</num><p>an organic or inorganic substance, used singly or in a mixture (and whether or not containing additives),</p></item></blockList><p>for oral feeding to animals which, or kinds of which, are in particular kept for the production of food, skins or fur or for the purpose of their use in the farming of land;</p></item><item><p>“fertiliser” means a fertiliser used for the cultivation of crops or plants of any description, including trees;</p></item><item><p>“fuel” includes any substance used as a source of heat or power;</p></item><item><p>“grain” includes wheat, maize, oats, rye, barley, rice, pulses, seeds and processed forms thereof;</p></item><item><p>“livestock” includes cattle, horses, asses, mules, hinnies, sheep, pigs, goats, poultry, deer and, while in captivity, pheasants, partridges and grouse;</p></item><item><p>“machinery” includes—</p><blockList class="ordered roman parens" ukl:Name="OrderedList" ukl:Type="roman" ukl:Decoration="parens"><item><num>(i)</num><p>digging machines;</p></item><item><num>(ii)</num><p>mobile cranes;</p></item><item><num>(iii)</num><p>generators and compressors;</p></item><item><num>(iv)</num><p>construction equipment, including wheel loaders, bulldozers, crawler tractors, crawler loaders, truck-type loaders, off-highway trucks and hydraulic excavators;</p></item><item><num>(v)</num><p>agricultural equipment;</p></item><item><num>(vi)</num><p>self-propelled agricultural vehicles including tractors; and</p></item><item><num>(vii)</num><p>fork-lift trucks.</p></item></blockList></item><item><p> <ins class="first" ukl:ChangeId="key-305a0cb2a9e33d7d11a900b4ac3b44a1-1773216110774" ukl:CommentaryRef="key-305a0cb2a9e33d7d11a900b4ac3b44a1"><noteRef uk:name="commentary" href="#key-305a0cb2a9e33d7d11a900b4ac3b44a1" class="commentary"/>“prescribed period” means the    </ins><ins ukl:ChangeId="key-305a0cb2a9e33d7d11a900b4ac3b44a1-1773216110774" ukl:CommentaryRef="key-305a0cb2a9e33d7d11a900b4ac3b44a1"><ins class="substitution first last" ukl:ChangeId="key-58f4a860bc6d87c6a69d898e60b652ff-1773221176588" ukl:CommentaryRef="key-58f4a860bc6d87c6a69d898e60b652ff"><noteRef uk:name="commentary" href="#key-58f4a860bc6d87c6a69d898e60b652ff" class="commentary"/>period of 30 days beginning on 4th October 2001</ins></ins><ins class="last" ukl:ChangeId="key-305a0cb2a9e33d7d11a900b4ac3b44a1-1773216110774" ukl:CommentaryRef="key-305a0cb2a9e33d7d11a900b4ac3b44a1">   ;</ins> </p></item><item><p>“vehicle”, whether laden or not, has the same meaning as “vehicles” in the <abbr title="Council Regulation (EEC) No. 3820/85 of 20th December 1985 on harmonisation of certain social legislation relating to road transport">Council Regulation</abbr>.</p></item></blockList></content></paragraph><paragraph eId="regulation-2-2"><num>(2)</num><content><p>The Interpretation Act (Northern Ireland) 1954<authorialNote class="footnote" eId="f00004" marker="4"><p><ref eId="c00006" href="http://www.legislation.gov.uk/id/apni/1954/33">1954 c. 33 (N.I.)</ref></p></authorialNote> shall apply to these Regulations as it applies to an Act of the Northern Ireland Assembly.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-3"><heading>Temporary exceptions</heading><num>3.</num><paragraph eId="regulation-3-1"><num>(1)</num><intro><p>Pursuant to Article 13(2) of the <abbr title="Council Regulation (EEC) No. 3820/85 of 20th December 1985 on harmonisation of certain social legislation relating to road transport">Council Regulation</abbr> <noteRef href="#key-a1198e3ec240da75a57a7f2859a9d126" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>..., and in order to meet the exceptional circumstances occasioned by the outbreak of foot-and-mouth disease in Northern Ireland, or the effects or consequences of such exceptional circumstances, any time spent driving a vehicle <ins class="first last" ukl:ChangeId="key-6a736cac23fad1a6ee5049ee95f68c07-1773216331647" ukl:CommentaryRef="key-6a736cac23fad1a6ee5049ee95f68c07"><noteRef uk:name="commentary" href="#key-6a736cac23fad1a6ee5049ee95f68c07" class="commentary"/>in the prescribed period</ins>  for the purpose of—</p></intro><level class="para1" eId="regulation-3-1-a"><num>(a)</num><content><p>the collection or delivery to or from a farm of agricultural products, machinery, fertiliser, fuel, disinfectants, herbicides and pesticides; or</p></content></level><level class="para1" eId="regulation-3-1-b"><num>(b)</num><content><p>the movement of livestock; or</p></content></level><level class="para1" eId="regulation-3-1-c"><num>(c)</num><content><p>the transport of feeding stuff and grain,</p></content></level><wrapUp><p>shall not be taken into account for the purposes of Article 6(2) of that Regulation.</p></wrapUp></paragraph><paragraph eId="regulation-3-2"><num>(2)</num><intro><p>In relation to the driving of a vehicle in the exceptional circumstances and for the purposes mentioned in paragraph (1), the <abbr title="Council Regulation (EEC) No. 3820/85 of 20th December 1985 on harmonisation of certain social legislation relating to road transport">Council Regulation</abbr> shall have effect as if—</p></intro><level class="para1" eId="regulation-3-2-a"><num>(a)</num><content><p>in Article 6, paragraph 1 first sentence, for the reference to “nine hours” there were substituted “ten hours” and the second sentence of that paragraph were deleted; and</p></content></level><level class="para1" eId="regulation-3-2-b"><num>(b)</num><content><p><mod>in Article 8, for paragraph 3 there were substituted the following—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="nisr" ukl:TargetClass="secondary" ukl:TargetSubClass="order" ukl:Context="main" ukl:Format="default"><article><num>3.</num><content><p>In the course of each week, one of the rest periods referred to in paragraphs 1 and 2 shall be extended, by way of weekly rest, to a total of 24 consecutive hours. The Commission has authorised the temporary exception provided for by these Regulations.</p></blockContainer><blockContainer ukl:Name="P"><p>The <ref eId="c00003" href="http://www.legislation.gov.uk/id/nisr/2001/103">Community Drivers' Hours (Foot-and-Mouth Disease) (Temporary Exception) Regulations (Northern Ireland) 2001 (S.R. 2001 No.103)</ref> applied a temporary exception for 30 days from 10th March to 8th April 2001. The present Regulations provide for a further temporary exception of 60 days and include the following changes—</p><blockList class="unordered dash" ukl:Name="UnorderedList" ukl:Decoration="dash"><item><p>the movement of machinery is added to regulation 3(1)(<i>a</i>); and</p></item><item><p>the reduced weekly rest of 24 consecutive hours is extended to 45 consecutive hours every third week (regulation 3(2)(<i>b</i>)).</p></item></blockList></blockContainer><blockContainer ukl:Name="P"><p>These Regulations provide that until 7th June 2001, any time spent driving vehicles for the purposes specified in regulation 3(1) to meet the exceptional circumstances occasioned by the outbreak of foot-and-mouth disease in Northern Ireland, or the effects or consequences of such exceptional circumstances, shall not be taken into account for the purposes of the application of Article 6(2) of the <abbr title="Council Regulation (EEC) No. 3820/85 of 20th December 1985 on harmonisation of certain social legislation relating to road transport">Council Regulation</abbr>.</p></blockContainer><blockContainer ukl:Name="P"><p>These Regulations also provide that in relation to the driving of such vehicles in the exceptional circumstances mentioned above, Articles 6(1) and 8(3) of the <abbr title="Council Regulation (EEC) No. 3820/85 of 20th December 1985 on harmonisation of certain social legislation relating to road transport">Council Regulation</abbr> shall have effect subject to certain modifications.</p></blockContainer></blockContainer></conclusions></act></akomaNtoso>
