<Text>The Department for Social Development, in exercise of the powers conferred on it by sections 122(1)(a) and (d), 132(4)(b), 134(1)(a) and 171(1), (3) and (4) of the Social Security Contributions and Benefits (Northern Ireland) Act 1992<FootnoteRef Ref="f00001"/>, section 165(4) to (6) of the Social Security Administration (Northern Ireland) Act 1992<FootnoteRef Ref="f00002"/>, Article 14(4)(b) of the Jobseekers (Northern Ireland) Order 1995<FootnoteRef Ref="f00003"/> and Article 28(1) of, and paragraph 4 of Schedule 1 to, the Social Security (Recovery of Benefits) (Northern Ireland) Order 1997<FootnoteRef Ref="f00004"/> and now vested in it<FootnoteRef Ref="f00005"/>, and of all other powers enabling it in that behalf, with the consent of the Department of Finance and Personnel<FootnoteRef Ref="f00006"/> in so far as regulation 2(2) is concerned, and after agreement by the Social Security Advisory Committee that proposals in respect of that regulation should not be referred to it<FootnoteRef Ref="f00007"/>, hereby makes the following Regulations:</Text>

<Text>These Regulations may be cited as the Social Security (Capital Disregards and Recovery of Benefits Amendment) Regulations (Northern Ireland) 2001 and shall come into operation on 12th April 2001.</Text>

<Text>The Interpretation Act (Northern Ireland) 1954<FootnoteRef Ref="f00008"/> shall apply to these Regulations as it applies to an Act of the Assembly.</Text>

<P1group RestrictExtent="N.I." RestrictStartDate="2006-11-20"><Title>Capital to be disregarded</Title><P1 DocumentURI="http://www.legislation.gov.uk/nisr/2001/150/regulation/2" IdURI="http://www.legislation.gov.uk/id/nisr/2001/150/regulation/2" id="regulation-2"><Pnumber><CommentaryRef Ref="key-fc5f2f19ec32149db63f9c64d355e510"/>2</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/nisr/2001/150/regulation/2/1" IdURI="http://www.legislation.gov.uk/id/nisr/2001/150/regulation/2/1" id="regulation-2-1"><Pnumber>1</Pnumber><P2para><Text>There shall be added as paragraph 59 of Schedule 10 to the Income Support (General) Regulations (Northern Ireland) 1987<FootnoteRef Ref="f00009"/> and paragraph 52 of Schedule 7 to the Jobseeker’s Allowance Regulations (Northern Ireland) 1996<FootnoteRef Ref="f00010"/> (capital to be disregarded) the following paragraph—</Text><BlockAmendment TargetClass="unknown" TargetSubClass="unknown" Context="unknown" Format="default" NumberFormat="default"><P><Text>—</Text><P2><Pnumber>1</Pnumber><P2para><Text>Subject to sub-paragraph (2), the amount of any trust payment made to a claimant or a member of a claimant’s family who is—</Text><P3><Pnumber>a</Pnumber><P3para><Text>a diagnosed person;</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>the diagnosed person’s partner or the person who was the diagnosed person’s partner at the date of the diagnosed person’s death;</Text></P3para></P3><P3><Pnumber>c</Pnumber><P3para><Text>a parent of a diagnosed person, a person acting in the place of the diagnosed person’s parents or a person who was so acting at the date of the diagnosed person’s death, or</Text></P3para></P3><P3><Pnumber>d</Pnumber><P3para><Text>a member of the diagnosed person’s family (other than his partner) or a person who was a member of the diagnosed person’s family (other than his partner) at the date of the diagnosed person’s death.</Text></P3para></P3></P2para></P2><P2><Pnumber>2</Pnumber><P2para><Text>Where a trust payment is made to—</Text><P3><Pnumber>a</Pnumber><P3para><Text>a person referred to in sub-paragraph (1)(<Emphasis>a</Emphasis>) or (1)(<Emphasis>b</Emphasis>), that sub-paragraph shall apply for the period beginning on and including the date on which the trust payment is made and ending on the date on which that person dies;</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>a person referred to in sub-paragraph (1)(<Emphasis>c</Emphasis>), that sub-paragraph shall apply for the period beginning on and including the date on which the trust payment is made and ending two years after that date;</Text></P3para></P3><P3><Pnumber>c</Pnumber><P3para><Text>a person referred to in sub-paragraph (1)(<Emphasis>d</Emphasis>), that sub-paragraph shall apply for the period beginning on and including the date on which the trust payment is made and ending—</Text><P4><Pnumber>i</Pnumber><P4para><Text>two years after that date, or</Text></P4para></P4><P4><Pnumber>ii</Pnumber><P4para><Text>on the day before the day on which that person—</Text><P5><Pnumber>aa</Pnumber><P5para><Text>ceases receiving full-time education, or</Text></P5para></P5><P5><Pnumber>bb</Pnumber><P5para><Text>attains the age of 19,</Text></P5para></P5><Text>whichever is the latest.</Text></P4para></P4></P3para></P3></P2para></P2><P2><Pnumber>3</Pnumber><P2para><Text>Subject to sub-paragraph (4), the amount of any payment by a person to whom a trust payment has been made or of any payment out of the estate of a person to whom a trust payment had been made, which is made to a claimant or a member of a claimant’s family who is—</Text><P3><Pnumber>a</Pnumber><P3para><Text>the diagnosed person’s partner or the person who was the diagnosed person’s partner at the date of the diagnosed person’s death;</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>a parent of a diagnosed person, a person acting in the place of the diagnosed person’s parents or a person who was so acting at the date of the diagnosed person’s death, or</Text></P3para></P3><P3><Pnumber>c</Pnumber><P3para><Text>a member of the diagnosed person’s family (other than his partner) or a person who was a member of the diagnosed person’s family (other than his partner) at the date of the diagnosed person’s death,</Text></P3para></P3><Text>but only to the extent that such payments do not exceed the total amount of any trust payments made to that person.</Text></P2para></P2><P2><Pnumber>4</Pnumber><P2para><Text>Where a payment as referred to in sub-paragraph (3) is made to—</Text><P3><Pnumber>a</Pnumber><P3para><Text>a person referred to in sub-paragraph (3)(<Emphasis>a</Emphasis>), that sub-paragraph shall apply for the period beginning on and including the date on which that payment is made and ending on the date on which that person dies;</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>a person referred to in sub-paragraph (3)(<Emphasis>b</Emphasis>), that sub-paragraph shall apply for the period beginning on and including the date on which that payment is made and ending two years after that date;</Text></P3para></P3><P3><Pnumber>c</Pnumber><P3para><Text>a person referred to in sub-paragraph (3)(<Emphasis>c</Emphasis>), that sub-paragraph shall apply for the period beginning on and including the date on which that payment is made and ending—</Text><P4><Pnumber>i</Pnumber><P4para><Text>two years after that date, or</Text></P4para></P4><P4><Pnumber>ii</Pnumber><P4para><Text>on the day before the day on which that person—</Text><P5><Pnumber>aa</Pnumber><P5para><Text>ceases receiving full-time education, or</Text></P5para></P5><P5><Pnumber>bb</Pnumber><P5para><Text>attains the age of 19,</Text></P5para></P5><Text>whichever is the latest.</Text></P4para></P4></P3para></P3></P2para></P2><P2><Pnumber>5</Pnumber><P2para><Text>In this paragraph, a reference to a person—</Text><P3><Pnumber>a</Pnumber><P3para><Text>being the diagnosed person’s partner;</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>being a member of the diagnosed person’s family, or</Text></P3para></P3><P3><Pnumber>c</Pnumber><P3para><Text>acting in the place of the diagnosed person’s parents,</Text></P3para></P3><Text>at the date of the diagnosed person’s death shall include a person who would have been such a person or a person who would have been so acting, but for the diagnosed person being in residential accommodation, a residential care home or a nursing home on that date.</Text></P2para></P2><P2><Pnumber>6</Pnumber><P2para><Text>In this paragraph—</Text><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text>“diagnosed person” means a person who has been diagnosed as suffering from, or who, after his death, has been diagnosed as having suffered from, variant Creutzfeldt-Jakob disease;</Text></Para></ListItem><ListItem><Para><Text>“relevant trust” means a trust established out of funds provided by the Secretary of State in respect of persons who suffered, or who are suffering, from variant Creutzfeldt-Jakob disease for the benefit of persons eligible for payments in accordance with its provisions;</Text></Para></ListItem><ListItem><Para><Text>“trust payment” means a payment under a relevant <Text>In regulation 7(2) of the Social Fund (Maternity and Funeral Expenses) (General) Regulations (Northern Ireland) 1987<FootnoteRef Ref="f00014"/> (deductions from an award of a funeral payment), after “the Eileen Trust”, in the first place where those words appear, there shall be inserted “or under a trust established out of funds provided by the Secretary of State in respect of persons who suffered, or who are suffering, from variant Creutzfeldt-Jakob disease for the benefit of persons eligible for payments in accordance with its provisions”.</Text>

<Text>In regulation 2(1) of the Social Security (Recovery of Benefits) Regulations (Northern Ireland) 1997<FootnoteRef Ref="f00015"/> (exempted trusts and payments), after sub-paragraph (<Emphasis>d</Emphasis>) there shall be added the following sub-paragraphs—</Text>

<Text>These Regulations further amend the Housing Benefit (General) Regulations (Northern Ireland) 1987, the Income Support (General) Regulations (Northern Ireland) 1987, the Jobseeker’s Allowance Regulations (Northern Ireland) 1996, the Social Fund (Maternity and Funeral Expenses) (General) Regulations (Northern Ireland) 1987 and the Social Security (Recovery of Benefits) Regulations (Northern Ireland) 1997.</Text>

<Text>In particular, regulation 2 provides that payments under a trust established out of funds provided by the Secretary of State in respect of persons who suffered, or who are suffering, from variant Creutzfeldt-Jakob disease which are made to certain persons and payments made by, or out of the estate of, persons receiving such payments which are made to certain persons, shall be disregarded in housing benefit, income support and jobseeker’s allowance. That regulation also prescribes the extent of the disregard and the period in respect of which the disregard is to apply.</Text>

<Text>Regulation 3 provides that any payment from such a trust shall be disregarded for the purpose of any deduction to be made from a social fund funeral payment.</Text>
</P>

<Text>Regulation 4 amends regulation 2 of the Social Security (Recovery of Benefits) Regulations (Northern Ireland) 1997 by adding to the list of trusts exempted from the scope of the Social Security (Recovery of Benefits) (Northern Ireland) Order 1997, a trust established out of funds provided by the Secretary of State for the relief of persons who suffered, or who are suffering, from variant Creutzfeldt-Jakob disease.</Text>

<Text>In so far as these Regulations are required, for the purposes of regulation 2(2), to be referred to the Social Security Advisory Committee under section 149(2) of the Social Security Administration (Northern Ireland) Act 1992, (“the <Abbreviation Expansion="Social Security Administration (Northern Ireland) Act 1992 c. 8">1992 Act</Abbreviation>”), after agreement by the Social Security Advisory Committee, they have not been so referred by virtue of section 150(1)(b) of that Act. Otherwise they make in relation to Northern Ireland only provision corresponding to provision contained in Regulations made by the Secretary of State for Social Security in relation to Great Britain and accordingly, by virtue of section 149(3) of, and paragraph 10 of Schedule 5 to, the 1992 Act, are not subject to the requirement of section 149(2) of that Act for prior reference to the Social Security Advisory Committee.</Text>

<Text>These Regulations do not impose any charge on business.</Text>
