employment-related training:</p><p>And whereas it appears to the Department of Higher and Further Education, Training and Employment that these arrangements make provision for persons using facilities provided in pursuance of them to receive payments in connection with their use of those facilities:</p><formula name="enactingText"><p>Now, therefore, the Department of Higher and Further Education, Training and Employment, in exercise of the powers conferred on it by Article 4 of the Employment and Training (Amendment) (Northern Ireland) Order 1988<authorialNote class="footnote" eId="f00003" the following Order:—</p></formula></preamble><body eId="body"><article eId="article-1"><heading>Citation, commencement and interpretation</heading><num>1.</num><paragraph eId="article-1-1"><num>(1)</num><content><p>This Order may be cited as the New Deal (Miscellaneous Provisions) Order (Northern Ireland) 2001 and shall come into operation on 9th April 2001.</p></content></paragraph><paragraph eId="article-1-2"><num>(2)</num><intro><p>In this Order—</p></intro><hcontainer name="definition"><content><p>“facilities” means facilities provided for the participant in pursuance of the Preparation for Employment Programme or the Preparation for Employment Programme for 50 plus.</p></content></hcontainer><hcontainer name="definition"><content><p>“the Preparation for Employment Programme” means the arrangements known by that name and made under section 1 of the <abbr title="Employment and Training Act (Northern Ireland) 1950 c. 29 (N.I.)">1950 Act</abbr> for which only persons who are aged 25 years or over and less than 50 years on the day of entry are eligible and which are designed to help participants to obtain work or to improve their prospects of obtaining work;</p></content></hcontainer><hcontainer name="definition"><content><p>“the Preparation for Employment Programme for 50 plus” means the arrangements known by that name and made under section 1 of the <abbr title="Employment and Training Act (Northern Ireland) 1950 c. 29 (N.I.)">1950 Act</abbr> for which only persons who are aged 50 years or over on the day of entry are eligible and which are designed to help participants to obtain work or to improve their prospects of obtaining work;</p></content></hcontainer><hcontainer name="definition"><content><p>“training allowance” means a payment made directly by the Department of Higher and Further Education, Training and Employment to a participant in the Preparation for Employment Programme or the Preparation for Employment Programme for 50 plus in connection with his participation.</p></content></hcontainer></paragraph></article><article eId="article-2"><heading>Treatment of persons and payments for the purposes of the Social Security Contributions and Benefits (Northern Ireland) Act 1992, the Jobseekers (Northern Ireland) Order 1995 and specified subordinate legislation</heading><num>2.</num><paragraph eId="article-2-1"><num>(1)</num><intro><p>The provisions of this Article apply for the purposes of—</p></intro><level class="para1" eId="article-2-1-a"><num>(a)</num><content><p>Part I of the Social Security Contributions and Benefits (Northern Ireland) Act 1992<authorialNote class="footnote" eId="f00004" marker="4"><p><ref eId="c00006" href="http://www.legislation.gov.uk/id/ukpga/1992/7">1992 c. 7</ref></p></authorialNote>,</p></content></level><level class="para1" eId="article-2-1-b"><num>(b)</num><content><p>the Jobseekers (Northern Ireland) Order 1995<authorialNote class="footnote" eId="f00005" marker="5"><p><ref eId="c00007" href="http://www.legislation.gov.uk/id/nisi/1995/2705">S.I. 1995/2705 (N.I. 15)</ref>)</p></authorialNote> and</p></content></level><level class="para1" eId="article-2-1-c"><num>(c)</num><content><p>the subordinate legislation specified in the Schedule to this Order.</p></content></level></paragraph><paragraph eId="article-2-2"><num>(2)</num><content><p>If, for any period or periods commencing with or falling after the date on which this Order comes into operation, during which a person is participating in the Preparation for Employment Programme or the Preparation for Employment Programme for 50 plus, that person receives, or is eligible to receive, a training allowance, he is to be treated for that period or those periods and in respect of his participation as not being employed but as participating in arrangements for training under section 1 of the <abbr title="Employment and Training Act (Northern Ireland) 1950 c. 29 (N.I.)">1950 Act</abbr>; and accordingly, subject to paragraph (3), any payment made to such a person during that period or those periods in connection with his use of facilities shall be treated in the same manner as a payment of training allowance made in respect of such training.</p></content></paragraph><paragraph eId="article-2-3"><num>(3)</num><content><p>Paragraph (2) shall not apply in respect of any trading payment made to a person receiving assistance in pursuing self-employed earner’s employment, whilst Order.)</subheading><blockContainer ukl:Name="P"><p>This Order provides that, for the purposes of Part I of the Social Security Contributions and Benefits (Northern Ireland) Act 1992 and the Jobseekers (Northern Ireland) Order 1995 and of the subordinate legislation specified in the Schedule to the Order, a person using facilities provided in pursuance of the employment programme known as “the Preparation for Employment Programme” or “the Preparation for Employment Programme for 50 plus” and receiving or entitled to receive from the Department of Higher and Further Education, Training and Employment, receipt of a training allowance in connection with the use of those facilities shall be treated not as being employed but as participating in arrangements for training under section 1 of the Employment and Training Act (Northern Ireland) 1950. Any payment made to such a person in connection with his use of those facilities, other than a trading payment made to a person receiving assistance in pursuing self-employed earner’s employment, shall be treated as a payment of training allowance made in respect of such training.</p></blockContainer></blockContainer></conclusions></act></akomaNtoso>
