<Text>These Regulations may be cited as the Social Fund (Maternity and Funeral Expenses) (General) (Amendment) Regulations (Northern Ireland) 2000 and shall come into operation on 27th March 2000.</Text>

<Text>In these Regulations, “the <Abbreviation Expansion="Social Fund (Maternity and Funeral Expenses) (General) Regulations (Northern Ireland) 1987 (S.R. 1987/150)">principal Regulations</Abbreviation>” means the Social Fund (Maternity and Funeral Expenses) (General) Regulations (Northern Ireland) 1987<FootnoteRef Ref="f00003"/>.</Text>

<Title>Amendment of regulation 2 of the principal Regulations</Title>

<Text>In regulation 2 of the principal Regulations (interpretation), after the definition of “funeral payment” there shall be inserted–</Text>

<Title>Amendment of regulation 4 of the principal Regulations</Title>

<Text>Regulation 4 of the principal Regulations (entitlement to a maternity payment) shall be amended in accordance with paragraphs (2) to (4).</Text>

<Text>Subject to paragraph (2), these Regulations shall not apply in a case where a claim is made and–</Text>

<Text>in the case of a child in respect of whom an order has been granted pursuant to section 30 of the Human Fertilisation and Embryology Act 1990<FootnoteRef Ref="f00012"/> (parental orders), the date of the order,</Text>

<Text>are both before 11th June 2000.</Text>
</P2para>
</P2>

<Pnumber>2</Pnumber>

<Text>Subject to paragraph (3), where a payment has been made on the basis that the expected date of confinement is before 11th June 2000 and the date of birth of that child (including any still-born) occurs after 10th June 2000, a further payment may be made in accordance with these Regulations.</Text>

<Text>The amount payable as a consequence of paragraph (2) shall be reduced by a sum equal to the payment already made.</Text>

<Text>These Regulations further amend the Social Fund (Maternity and Funeral Expenses) (General) Regulations (Northern Ireland) 1987 (“the principal Regulations”).</Text>
</P>
<P>
<Text>Regulation 3 imposes a new condition for entitlement to a payment to meet maternity expenses. The new condition is that the claimant or claimant’s partner has received advice on health and welfare matters relating to the child, and where the claim is made before the child is born, the mother has received advice on maternal health. The amount of a maternity payment is to increase by £100 to £200.</Text>
</P>
<P>
<Text>Regulation 4 amends regulations 2, 3, 4, 5, and 8 of the principal Regulations to provide that a payment to meet maternity expenses is to be known as a Sure Start Maternity Grant.</Text>
</P>
<P>
<Text>Regulation 5 makes transitional provisions.</Text>
</P>
<P>
<Text>These Regulations make in relation to Northern Ireland only provision corresponding to provision contained in Regulations made by the Secretary of State for Social Security in relation to Great Britain and accordingly, by virtue of section 149(3) of, and paragraph 10 of Schedule 5 to, the Social Security Administration (Northern Ireland) Act <Citation URI="http://www.legislation.gov.uk/id/ukpga/1992/8" id="c00001" Class="UnitedKingdomPublicGeneralAct" Year="1992" Number="0008">1992 (c. 8)</Citation>, are not subject to the requirement of section 149(2) of that Act for prior reference to the Social Security Advisory Committee.</Text>
