Regulations:</p></formula></preamble><body><hcontainer name="regulation" eId="regulation-1"><heading>Citation, commencement and interpretation</heading><num>1.</num><paragraph eId="regulation-1-1"><num>(1)</num><content><p>These Regulations may be cited as the Social Fund (Maternity and Funeral Expenses) (General) (Amendment) Regulations (Northern Ireland) 2000 and shall come into operation on 27th March 2000.</p></content></paragraph><paragraph eId="regulation-1-2"><num>(2)</num><content><p>In these Regulations, “the <abbr title="Social Fund (Maternity and Funeral Expenses) (General) Regulations (Northern Ireland) 1987 (S.R. 1987/150)">principal Regulations</abbr>” means the Social Fund (Maternity and Funeral Expenses) (General) Regulations (Northern Ireland) Ireland) 1954<authorialNote class="footnote" eId="f00004" marker="4"><p><ref eId="c00015" href="http://www.legislation.gov.uk/id/apni/1954/33">1954 c. 33 (N.I.)</ref></p></authorialNote> shall apply to these Regulations as it applies to an Act of the Assembly.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>Amendment of regulation 2 of the <abbr title="Social Fund (Maternity and Funeral Expenses) (General) Regulations (Northern Ireland) 1987 (S.R. 1987/150)">principal Regulations</abbr></heading><num>2.</num><content><p><mod>In regulation 2 of the <abbr title="Social Fund (Maternity and Funeral Expenses) (General) Regulations (Northern Ireland) 1987 (S.R. 1987/150)">principal Regulations</abbr> (interpretation), after the definition of “funeral payment” there shall be inserted–<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="nisr" ukl:TargetClass="secondary" ukl:TargetSubClass="regulation" ukl:Context="main" ukl:Format="default"><blockList class="unordered none" ukl:Name="UnorderedList" ukl:Decoration="none"><item><p>“health professional” means–</p><blockList class="ordered alpha parens" ukl:Name="OrderedList" ukl:Type="alpha" ukl:Decoration="parens"><item><num>(a)</num><p>a registered medical practitioner;</p></item><item><num>(b)</num><p>a midwife, nurse or health visitor registered as a midwife, nurse or health visitor with the United Kingdom Central Council for Nursing, Midwifery and Health Visiting under the Nurses, Midwives and Health Visitors Act 1997<authorialNote class="footnote" eId="f00005" marker="5"><p><ref eId="c00016" href="http://www.legislation.gov.uk/id/ukpga/1997/24">1997 c. 24</ref></p></authorialNote>;</p></item></blockList></item></blockList></quotedStructure><inline name="appendText">.</inline></mod></p></content></hcontainer><hcontainer name="regulation" eId="regulation-3"><heading>Amendment of regulation 4 of the <abbr title="Social Fund (Maternity and Funeral Expenses) (General) Regulations (Northern Ireland) 1987 (S.R. 1987/150)">principal Regulations</abbr></heading><num>3.</num><paragraph eId="regulation-3-1"><num>(1)</num><content><p>Regulation 4 of the <abbr title="Social Fund (Maternity and Funeral Expenses) (General) Regulations (Northern Ireland) 1987 (S.R. 1987/150)">principal Regulations</abbr> (entitlement to a maternity payment) shall be amended in accordance with paragraphs (2) to (4).</p></content></paragraph><paragraph eId="regulation-3-2"><num>(2)</num><content><p><mod>In paragraph (1), after sub-paragraph (<i>b</i>) there shall be inserted the following sub-paragraph–<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><level class="para1"><num>(bb)</num><intro><p>subject to paragraph (3)–</p></intro><level class="para2"><num>(i)</num><content><p>the claimant or partner has received advice on health and welfare matters relating to the child from a health professional, and</p></content></level><level class="para2"><num>(ii)</num><content><p>where the claim is made before the child is born, the claimant or partner has received advice on health and welfare matters relating to maternal health from a health professional, and</p></content></level></level></quotedStructure><inline name="appendText">.</inline></mod></p></content></paragraph><paragraph eId="regulation-3-3"><num>(3)</num><content><p>In paragraph (2)<authorialNote class="footnote" eId="f00006" marker="6"><p>Paragraph (2) was substituted by <ref eId="c00017" href="http://www.legislation.gov.uk/id/nisr/1992/394">S.R. 1992 No. 394</ref> and sub-paragraph (<i>d</i>) was added by <ref eId="c00018" href="http://www.legislation.gov.uk/id/nisr/1997/155">S.R. 1997 No. 155</ref></p></authorialNote>, in each place where the amount “£100” appears there shall be substituted the amount Regulations (Northern Ireland) 1987 (S.R. 1987/150)">principal Regulations</abbr>, in each place where “maternity payment” occurs, there shall be substituted “Sure Start Maternity Grant”.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-5"><heading>Transitional provisions</heading><num>5.</num><paragraph eId="regulation-5-1"><num>(1)</num><intro><p>Subject to paragraph (2), these Regulations shall not apply in a case where a claim is made and–</p></intro><level class="para1" eId="regulation-5-1-a"><num>(a)</num><content><p>the expected date of confinement;</p></content></level><level class="para1" eId="regulation-5-1-b"><num>(b)</num><content><p>the date of birth of the child (including any still-born);</p></content></level><level class="para1" eId="regulation-5-1-c"><num>(c)</num><content><p>the date of the adoption order, or</p></content></level><level class="para1" eId="regulation-5-1-d"><num>(d)</num><content><p>in the case of a child in respect of whom an order has been granted pursuant to section 30 of the Human Fertilisation and Embryology Act 1990<authorialNote class="footnote" eId="f00012" marker="12"><p><ref eId="c00032" href="http://www.legislation.gov.uk/id/ukpga/1990/37">1990 c. 37</ref></p></authorialNote> (parental orders), the date of the order,</p></content></level><wrapUp><p>are both before 11th June 2000.</p></wrapUp></paragraph><paragraph eId="regulation-5-2"><num>(2)</num><content><p>Subject to paragraph (3), where a payment has been made on the basis that the expected date of confinement is before 11th June 2000 and the date of birth of that child (including any still-born) occurs after 10th June 2000, a further payment may be made in accordance with these Regulations.</p></content></paragraph><paragraph eId="regulation-5-3"><num>(3)</num><content><p>The amount payable as a consequence of paragraph (2) shall Regulations.)</subheading><blockContainer ukl:Name="P"><p>These Regulations further amend the Social Fund (Maternity and Funeral Expenses) (General) Regulations (Northern Ireland) 1987 (“the <abbr title="Social Fund (Maternity and Funeral Expenses) (General) Regulations (Northern Ireland) 1987 (S.R. 1987/150)">principal Regulations</abbr>”).</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 3 imposes a new condition for entitlement to a payment to meet maternity expenses. The new condition is that the claimant or claimant’s partner has received advice on health and welfare matters relating to the child, and where the claim is made before the child is born, the mother has received advice on maternal health. The amount of a maternity payment is to increase by £100 to £200.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 4 amends regulations 2, 3, 4, 5, and 8 of the <abbr title="Social Fund (Maternity and Funeral Expenses) (General) Regulations (Northern Ireland) 1987 (S.R. 1987/150)">principal Regulations</abbr> to provide that a payment to meet maternity expenses is to be known as a Sure Start Maternity Grant.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 5 makes transitional provisions.</p></blockContainer><blockContainer ukl:Name="P"><p>These Regulations make in relation to Northern Ireland only provision corresponding to provision contained in Regulations made by the Secretary of State for Social Security in relation to Great Britain and accordingly, by virtue of section 149(3) of, and paragraph 10 of Schedule 5 to, the Social Security Administration (Northern Ireland) Act <ref eId="c00001" href="http://www.legislation.gov.uk/id/ukpga/1992/8">1992 (c. 8)</ref>, are not subject to the requirement of section 149(2) of that Act for prior reference to the Social Security Advisory Committee.</p></blockContainer></blockContainer></conclusions></act></akomaNtoso>
