eId="regulation-1"><heading>Citation, commencement and duration</heading><num>1.</num><paragraph eId="regulation-1-1"><num>(1)</num><intro><p>These Regulations may be cited as the Social Security (New Deal Pilot) Regulations (Northern Ireland) 2000 and shall come into operation—</p></intro><level class="para1" eId="regulation-1-1-a"><num>(a)</num><content><p>for the purposes of regulations 5(4) and (5) and 9(2), on 19th March 2001;</p></content></level><level class="para1" eId="regulation-1-1-b"><num>(b)</num><content><p>for all other purposes, on 28th November 2000 immediately following the expiry of the Social Security (New Deal Pilot) Regulations (Northern Ireland) 1999<authorialNote class="footnote" eId="f00006" marker="6"><p><ref eId="c00007" href="http://www.legislation.gov.uk/id/nisr/1999/474">S.R. 1999 No. 474</ref>; amended by <ref eId="c00008" href="http://www.legislation.gov.uk/id/nisr/2000/109">S.R. 2000 No. 109</ref></p></authorialNote>.</p></content></level></paragraph><paragraph eId="regulation-1-2"><num>(2)</num><content><p>These Regulations shall cease to have effect on 27th November 2001, unless revoked with effect from an earlier date.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>Interpretation</heading><num>2.</num><paragraph eId="regulation-2-1"><num>(1)</num><intro><p>In these Regulations—</p></intro><hcontainer name="definition"><content><p>“<abbr title="Jobseekers (Northern Ireland) Order 1995 (S.I. 1995/2705 (N.I. 15))">the Order</abbr>” means the Jobseekers (Northern Ireland) Order 1995;</p></content></hcontainer><hcontainer name="definition"><content><p>“benefit” means jobseeker’s allowance or any earnings credited to a person in accordance with regulation 8A of the Social Security (Credits) Regulations (Northern Ireland) 1975<authorialNote class="footnote" eId="f00007" marker="7"><p><ref eId="c00009" href="http://www.legislation.gov.uk/id/nisr/1975/113">S.R. 1975 No. 113</ref>; regulation 8A was inserted by regulation 2(6) of <ref eId="c00010" href="http://www.legislation.gov.uk/id/nisr/1996/430">S.R. 1996 No. 430</ref></p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><content><p>“employment officer” means a person who is at any time an employment officer for the purposes of Article 21 of <abbr title="Jobseekers (Northern Ireland) Order 1995 (S.I. 1995/2705 (N.I. 15))">the Order</abbr>;</p></content></hcontainer><hcontainer name="definition"><content><p>“employment-related course” has the same meaning as in regulation 1(2) of the <abbr title="Jobseeker’s Allowance Regulations (Northern Ireland) 1996 (S.R. 1996/198)">Jobseeker’s Allowance Regulations</abbr>;</p></content></hcontainer><hcontainer name="definition"><content><p>“full-time student” has the same meaning as in regulation 1(2) of the <abbr title="Jobseeker’s Allowance Regulations (Northern Ireland) 1996 (S.R. 1996/198)">Jobseeker’s Allowance Regulations</abbr>;</p></content></hcontainer><hcontainer name="definition"><content><p>“gateway interview” means an interview with an employment officer to identify and discuss matters that could help a person find work and matters that are preventing him from finding work;</p></content></hcontainer><hcontainer name="definition"><content><p><noteRef href="#key-6c234129dc214216ce8f80d05a73878c" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>...</p></content></hcontainer><hcontainer name="definition"><content><p>“the <abbr title="Income Support (General) Regulations (Northern Ireland) 1987 (S.R. 1987/459)">Income Support Regulations</abbr>” means the Income Support (General) Regulations (Northern Ireland) 1987<authorialNote class="footnote" eId="f00009" marker="9"><p><ref eId="c00019" href="http://www.legislation.gov.uk/id/nisr/1987/459">S.R. 1987 No. 459</ref>; relevant amending Regulations are <ref eId="c00020" href="http://www.legislation.gov.uk/id/nisr/1989/326">S.R. 1989 No. 326</ref>, <ref eId="c00021" href="http://www.legislation.gov.uk/id/nisr/1990/387">S.R. 1990 No. 387</ref>, <ref eId="c00022" href="http://www.legislation.gov.uk/id/nisr/1992/403">S.R. 1992 No. 403</ref>, <ref eId="c00023" href="http://www.legislation.gov.uk/id/nisr/1995/86">S.R. 1995 No. 86</ref>, <ref eId="c00024" pilot for 25 plus” means a programme provided in pursuance of arrangements made under section 1 of the Employment and Training Act (Northern Ireland) 1950<authorialNote class="footnote" eId="f00010" marker="10"><p><ref eId="c00027" href="http://www.legislation.gov.uk/id/apni/1950/29">1950 c. 29</ref>; section 1 was amended by Article 3 of the Employment and Training (Amendment) (Northern Ireland) Order 1988 (<ref eId="c00028" href="http://www.legislation.gov.uk/id/nisi/1988/1087">S.I. 1988/1087 (N.I. 10)</ref>) and Article 5 of the Industrial Training (Northern Ireland) Order 1990 (<ref eId="c00029" href="http://www.legislation.gov.uk/id/nisi/1990/1200">S.I. 1990/1200(N.I. 8)</ref>)</p></authorialNote> for which only persons who are aged 25 years or over may be eligible, known as the intensive activity period of the New Deal for 25 plus, and which includes for any individual, job search activity and one or more of the following, namely training, study, assistance in pursuing self-employed earner’s employment and work experience;</p></content></hcontainer><hcontainer name="definition"><content><p>“the <abbr title="Jobseeker’s Allowance Regulations (Northern Ireland) 1996 (S.R. 1996/198)">Jobseeker’s Allowance Regulations</abbr>” means the Jobseeker’s Allowance Regulations (Northern Ireland) 1996<authorialNote class="footnote" eId="f00011" marker="11"><p><ref href="http://www.legislation.gov.uk/id/nisr/2000/197">197</ref>, <ref eId="c00040" href="http://www.legislation.gov.uk/id/nisr/2000/255">255</ref> and <ref eId="c00041" href="http://www.legislation.gov.uk/id/nisr/2000/350">350</ref></p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><content><p>“the New Deal Education and Training Opportunities pilot for 25 plus” means the programme provided in pursuance of arrangements made under section 1 of the Employment and Training Act (Northern Ireland) 1950 for which only persons who are aged 25 years or over may be eligible, known as the New Deal Education and Training Opportunities for 25 plus, being a programme which consists of a qualifying course within the meaning of regulation 17A of the <abbr title="Jobseeker’s Allowance Regulations (Northern Ireland) 1996 (S.R. 1996/198)">Jobseeker’s Allowance Regulations</abbr> modified in accordance with regulation 19;</p></content></hcontainer><hcontainer name="definition"><content><p>“part-time student” has the same meaning as in regulation 1(2) of the <abbr title="Jobseeker’s Allowance Regulations (Northern Ireland) 1996 (S.R. 1996/198)">Jobseeker’s Allowance Regulations</abbr>;</p></content></hcontainer><hcontainer name="definition"><content><p>“week” means any period of 7 days.</p></content></hcontainer></paragraph><paragraph eId="regulation-2-2"><num>(2)</num><intro><p>In regulations 3 and 4, the references to receiving benefit for not less than the periods or, as the case may be, for less than the period, referred to in those regulations means receiving benefit—</p></intro><level class="para1" eId="regulation-2-2-a"><num>(a)</num><content><p>without any period of interruption;</p></content></level><level class="para1" eId="regulation-2-2-b"><num>(b)</num><content><p>with a period of interruption which did not exceed 28 days, or</p></content></level><level class="para1" eId="regulation-2-2-c"><num>(c)</num><content><p>with a number of periods of interruption, none of which exceeded 28 days,</p></content></level><wrapUp><p>and any period of interruption which did not exceed 28 days shall be taken into account in calculating the periods referred to in regulations 3 and 4.</p></wrapUp></paragraph><paragraph eId="regulation-2-3"><num>(3)</num><content><p>In respect of any period throughout which a member of a joint-claim couple is receiving a joint-claim jobseeker’s allowance, the other member of that couple shall, for the purposes of regulations 3 and 4, also be treated as receiving benefit throughout that period.</p></content></paragraph><paragraph eId="regulation-2-4"><num>(4)</num><content><p>The Interpretation Act (Northern Ireland) 1954<authorialNote class="footnote" eId="f00012" marker="12"><p><ref eId="c00042" href="http://www.legislation.gov.uk/id/apni/1954/33">1954 c. 33 (N.I.)</ref></p></authorialNote> shall apply to these Regulations as it applies to an Act of the Assembly.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-3"><heading>Application: persons aged 25 and over in receipt of benefit for 18 months</heading><num>3.</num><intro><p>This regulation shall apply to any person who—</p></intro><level class="para1" eId="regulation-3-a"><num>(a)</num><content><p>is sent a letter dated on or before 31st March 2001 inviting him to attend a New Deal pilot gateway interview at an office of the Department of Higher and Further Education, Training and Employment, and</p></content></level><level class="para1" eId="regulation-3-b"><num>(b)</num><content><p>as at the date of letter referred to in regulation 3(<i>a</i>) is aged 25 or over but under pensionable age and has been receiving benefit for a period of not less than 18 months.</p></content></level></hcontainer><hcontainer name="regulation" eId="regulation-4"><heading>Application: volunteers</heading><num>4.</num><intro><p>This regulation shall apply to any person who—</p></intro><level class="para1" eId="regulation-4-a"><num>(a)</num><content><p>on or after the date on which these Regulations come into operation and on or before 31st March 2001 attends an office of the Department of Higher and Further Education, Training and Employment pursuant to a notification under regulation 23<authorialNote class="footnote" eId="f00013" marker="13"><p>Regulation 23 was substituted by regulation 2(2) of <ref eId="c00043" href="http://www.legislation.gov.uk/id/nisr/2000/255">S.R. 2000 No. 255</ref></p></authorialNote> or 23A<authorialNote class="footnote" eId="f00014" marker="14"><p>Regulation 23A was inserted by regulation 2(5) of <ref eId="c00044" href="http://www.legislation.gov.uk/id/nisr/2000/350">S.R. 2000 No. 350</ref></p></authorialNote> of the <abbr title="Jobseeker’s Allowance Regulations (Northern Ireland) 1996 (S.R. 1996/198)">Jobseeker’s Allowance Regulations</abbr> and when he so attends volunteers to attend a gateway interview,</p></content></level><level class="para1" eId="regulation-4-b"><num>(b)</num><content><p>on the day he so attends, is aged 25 or over but under pensionable age and has been receiving benefit for a period of less than 18 months, and</p></content></level><level class="para1" eId="regulation-4-c"><num>(c)</num><content><p>in respect of whom an employment officer agrees that he may be given a gateway interview.</p></content></level></hcontainer></part><part eId="part-II"><num>Part II</num><heading>The intensive Activity Period of the New Deal Pilots for 25 Plus</heading><hcontainer name="regulation" eId="regulation-5"><heading>Sanction</heading><num>5.</num><paragraph eId="regulation-5-1"><num>(1)</num><content><p>In relation to a person to whom paragraph (2) or (4) applies, “employment programme” in Article 21 of <abbr title="Jobseekers (Northern Ireland) Order 1995 (S.I. 1995/2705 (N.I. 15))">the Order</abbr> means, in addition to the programmes listed in regulation 75(1) of the <abbr title="Jobseeker’s Allowance Regulations (Northern Ireland) 1996 (S.R. 1996/198)">Jobseeker’s Allowance Regulations</abbr><authorialNote class="footnote" eId="f00015" marker="15"><p>Regulation 75 was substituted by regulation 8 of <ref eId="c00045" href="http://www.legislation.gov.uk/id/nisr/1997/541">S.R. 1997 No. 541</ref> and amended by <ref eId="c00046" href="http://www.legislation.gov.uk/id/nisr/2000/197">S.R. 2000 No. 197</ref></p></authorialNote> (interpretation), the intensive activity period of the New Deal pilot for 25 plus.</p></content></paragraph><paragraph eId="regulation-5-2"><num>(2)</num><content><p>This paragraph applies to any person (other than a person specified in paragraph (4)) to whom regulation 3 or 4 applies and who has been given or sent a notice in writing by an employment officer advising him that if he fails to participate in the intensive activity period of the New Deal pilot for 25 plus his jobseeker’s allowance could cease to be payable or could be payable at a lower rate.</p></content></paragraph><paragraph eId="regulation-5-3"><num>(3)</num><intro><p>In relation to a person to whom paragraph (2) applies, the prescribed period for the purposes of Article 21(2) of <abbr title="Jobseekers (Northern Ireland) Order 1995 (S.I. 1995/2705 (N.I. 15))">the Order</abbr> shall begin on, and include, the first day of the week following the date on which a jobseeker’s allowance is determined not to be payable to the person and shall be—</p></intro><level class="para1" eId="regulation-5-3-a"><num>(a)</num><content><p>2 weeks in any case which does not fall within sub-paragraph (<i>b</i>);</p></content></level><level class="para1" eId="regulation-5-3-b"><num>(b)</num><content><p>4 weeks in any case in which on a previous occasion a jobseeker’s allowance was determined not to be payable to him in circumstances falling within Article 21(5) of <abbr title="Jobseekers (Northern Ireland) Order 1995 (S.I. 1995/2705 (N.I. 15))">the Order</abbr> that relate to the intensive activity period of the New Deal pilot for 25 plus and the first date on which a jobseeker’s allowance was not payable to him as a result of that determination falls within the period of 12 months preceding the date of the determination mentioned in paragraph (3).</p></content></level></paragraph><paragraph eId="regulation-5-4"><num>(4)</num><content><p>This paragraph applies to a member of a joint-claim couple to whom regulation 3 or 4 applies and who has been given or sent a notice in writing by an employment officer advising him that if he fails to participate in the intensive activity period of the New Deal Pilot for 25 plus the jobseeker’s allowance payable to the joint-claim couple of which he is a member could cease to be payable or could be payable at a lower rate.</p></content></paragraph><paragraph eId="regulation-5-5"><num>(5)</num><intro><p>In relation to a person to whom paragraph (4) applies, the prescribed period for the purposes of Article 22A(3)<authorialNote class="footnote" eId="f00016" marker="16"><p>Article 22A was inserted by paragraph 14 of Schedule 7 to the Welfare Reform and Pensions (Northern Ireland) Order 1999 (<ref eId="c00047" href="http://www.legislation.gov.uk/id/nisi/1999/3147">S.I. 1999/3147 (N.I. 11)</ref>)</p></authorialNote> of <abbr title="Jobseekers (Northern Ireland) Order 1995 (S.I. 1995/2705 (N.I. 15))">the Order</abbr> (denial or reduction of joint-claim jobseeker’s allowance) shall begin on the first day of the week following the date on which that person is determined to be subject to sanctions for the purposes of Article 22A of <abbr title="Jobseekers (Northern Ireland) Order 1995 (S.I. 1995/2705 (N.I. 15))">the Order</abbr> and shall be—</p></intro><level class="para1" eId="regulation-5-5-a"><num>(a)</num><content><p>2 weeks in any case which does not fall within sub-paragraph (<i>b</i>);</p></content></level><level class="para1" eId="regulation-5-5-b"><num>(b)</num><content><p>4 weeks in any case in which on a previous occasion a jobseeker’s allowance was determined not to be payable to him in circumstances falling within Article 21(5) of <abbr title="Jobseekers (Northern Ireland) Order 1995 (S.I. 1995/2705 (N.I. 15))">the Order</abbr> or in a case in which he was determined to be subject to sanctions in the circumstances falling within Article 22A(2)(<i>a</i>) to (<i>c</i>) of <abbr title="Jobseekers (Northern Ireland) Order 1995 (S.I. 1995/2705 (N.I. 15))">the Order</abbr> that relate to the intensive activity period of the New Deal pilot for 25 plus and the first date on which a jobseeker’s allowance was not payable to him or in respect of which he was subject to sanctions as a result of that determination falls within the period of 12 months preceding the date of the determination mentioned in paragraph (3).</p></content></level></paragraph><paragraph eId="regulation-5-6"><num>(6)</num><content><p>In this regulation, “week” has the same meaning as “benefit week” in regulation 1(2) of the <abbr title="Jobseeker’s Allowance Regulations (Northern Ireland) 1996 (S.R. 1996/198)">Jobseeker’s Allowance Regulations</abbr>.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-6"><heading>Interpretation of Articles 21 and 22A of <abbr title="Jobseekers (Northern Ireland) Order 1995 (S.I. 1995/2705 (N.I. 15))">the Order</abbr> and Part V of the <abbr title="Jobseeker’s Allowance Regulations (Northern Ireland) 1996 (S.R. 1996/198)">Jobseeker’s Allowance Regulations</abbr></heading><num>6.</num><content><p>In relation to a person to whom regulation 3 or 4 applies, “employment” in Articles 21 and 22A of <abbr title="Jobseekers (Northern Ireland) Order 1995 (S.I. 1995/2705 (N.I. 15))">the Order</abbr>, except Article 21(9), and in Part V of the <abbr title="Jobseeker’s Allowance Regulations (Northern Ireland) 1996 (S.R. 1996/198)">Jobseeker’s Allowance Regulations</abbr>, means employed earner’s employment other than employed earner’s employment in which a person is employed whilst participating in the intensive activity period of the New Deal pilot for 25 plus and “employed earner” shall be construed accordingly.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-7"><heading>Availability for employment</heading><num>7.</num><paragraph eId="regulation-7-1"><num>(1)</num><intro><p>In relation to a person to whom regulation 3 or 4 applies—</p></intro><level class="para1" eId="regulation-7-1-a"><num>(a)</num><content><p><mod>regulation 15(<i>a</i>) of the <abbr title="Jobseeker’s Allowance Regulations (Northern Ireland) 1996 (S.R. 1996/198)">Jobseeker’s Allowance Regulations</abbr> (circumstances in which a person is not to be regarded as available) shall be modified in its application to him as if the following words were added after “full-time student” where those words appear for the first time—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><p>, other than where he is a full-time student by virtue of undertaking an employment-related course as part of the intensive activity period of the New Deal pilot for 25 plus,</p></quotedStructure><inline name="appendText">, and</inline></mod></p></content></level><level class="para1" eId="regulation-7-1-b"><num>(b)</num><content><p>if in any week in which he is participating in the intensive activity period of the New Deal pilot for 25 plus he is as part of that programme undertaking as a full-time student or a part-time student an employment-related course for not less than 3 days in that week, he shall be treated as available for employment for that week.</p></content></level></paragraph><paragraph eId="regulation-7-2"><num>(2)</num><content><p>In this regulation, “week” has the same meaning as “benefit week” in regulation 1(2) of the <abbr title="Jobseeker’s Allowance Regulations (Northern Ireland) 1996 (S.R. 1996/198)">Jobseeker’s Allowance Regulations</abbr>.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-8"><heading>Good Cause</heading><num>8.</num><content><p>Without prejudice to any other circumstances in which a person may be regarded as having good cause for any act or omission for the purposes of Article 21(5)(<i>b</i>) or 22A(2)(<i>b</i>) of <abbr title="Jobseekers (Northern Ireland) Order 1995 (S.I. 1995/2705 (N.I. 15))">the Order</abbr>, and in addition to the circumstances listed in regulation 73 of the <abbr title="Jobseeker’s Allowance Regulations (Northern Ireland) 1996 (S.R. 1996/198)">Jobseeker’s Allowance Regulations</abbr><authorialNote class="footnote" eId="f00017" marker="17"><p>Regulation 73 was amended by <ref eId="c00048" href="http://www.legislation.gov.uk/id/nisr/1996/356">S.R. 1996 No. 356</ref>, <ref eId="c00049" href="http://www.legislation.gov.uk/id/nisr/1997/541">S.R. 1997 No. 541</ref> and <ref eId="c00050" href="http://www.legislation.gov.uk/id/nisr/1998/198">S.R. 1998 No. 198</ref></p></authorialNote> (good cause for the purposes of Article 21(5)(<i>b</i>) or 22A(2)(<i>b</i>) of <abbr title="Jobseekers (Northern Ireland) Order 1995 (S.I. 1995/2705 (N.I. 15))">the Order</abbr>), a person to whom regulation 3 or 4 applies is to be regarded as having good cause for an act or omission in relation to the intensive activity period of the New Deal pilot for 25 plus for the purposes of Article 21(5)(<i>b</i>) or 22A(2)(<i>b</i>) of <abbr title="Jobseekers (Northern Ireland) Order 1995 (S.I. 1995/2705 (N.I. 15))">the Order</abbr> where he has already participated in that same intensive activity period of the New Deal pilot for 25 plus for one continuous period of 13 weeks or 2 or more periods amounting in total to 13 weeks.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-9"><heading>Payability of allowance</heading><num>9.</num><paragraph eId="regulation-9-1"><num>(1)</num><intro><p>An income-based jobseeker’s allowance (other than a joint-claim jobseeker’s allowance) shall be payable to a person to whom regulation 3 or 4 applies even though Article 21 of <abbr title="Jobseekers (Northern Ireland) Order 1995 (S.I. 1995/2705 (N.I. 15))">the Order</abbr> prevents payment of a jobseeker’s allowance to him if—</p></intro><level class="para1" eId="regulation-9-1-a"><num>(a)</num><content><p>an allowance would not otherwise be payable because the circumstances in Article 21(5)(<i>c</i>) of <abbr title="Jobseekers (Northern Ireland) Order 1995 (S.I. 1995/2705 (N.I. 15))">the Order</abbr> apply in relation to the intensive activity period of the New Deal pilot for 25 plus, and</p></content></level><level class="para1" eId="regulation-9-1-b"><num>(b)</num><content><p>he has already participated in that same intensive activity period of the New Deal pilot for 25 plus for one continuous period of 13 weeks or 2 or more periods amounting in total to 13 weeks,</p></content></level><wrapUp><p>and the applicable amount in respect of a person to whom this regulation applies shall be the amount determined in accordance with regulation 83, 84, 85, 86, 145 or 148 of the <abbr title="Jobseeker’s Allowance Regulations (Northern Ireland) 1996 (S.R. 1996/198)">Jobseeker’s Allowance Regulations</abbr> (applicable amounts), as appropriate.</p></wrapUp></paragraph><paragraph eId="regulation-9-2"><num>(2)</num><intro><p>A joint-claim jobseeker’s allowance shall be payable to a joint-claim couple where regulation 3 or 4 applies to either or both members of that couple even though either or both members are subject to sanctions for the purposes of Article 22A of <abbr title="Jobseekers (Northern Ireland) Order 1995 (S.I. 1995/2705 (N.I. 15))">the Order</abbr> if—</p></intro><level class="para1" eId="regulation-9-2-a"><num>(a)</num><content><p>an allowance would not otherwise be payable because the circumstances in Article 22A(2)(<i>c</i>) of <abbr title="Jobseekers (Northern Ireland) Order 1995 (S.I. 1995/2705 (N.I. 15))">the Order</abbr> apply to that member in relation to the intensive activity period of the New Deal pilot for 25 plus, and</p></content></level><level class="para1" eId="regulation-9-2-b"><num>(b)</num><content><p>that member has already participated in that same intensive activity period of the New Deal pilot for 25 plus for one continuous period of 13 weeks or 2 or more periods amounting in total to 13 weeks,</p></content></level><wrapUp><p>and the applicable amount in respect of the couple to whom this regulation applies shall be the amount determined in accordance with regulation 86A<authorialNote class="footnote" eId="f00018" marker="18"><p>Regulation 86A to 86D were inserted by regulation 2(5) of <ref eId="c00051" href="http://www.legislation.gov.uk/id/nisr/2000/350">S.R. 2000 No. 350</ref></p></authorialNote>, 86B, 86C, 86D, 146G<authorialNote class="footnote" eId="f00019" marker="19"><p>Regulation 146G was inserted by regulation 2(3) of <ref eId="c00052" href="http://www.legislation.gov.uk/id/nisr/2000/350">S.R. 2000 No. 350</ref></p></authorialNote> or 148A<authorialNote class="footnote" eId="f00020" marker="20"><p>Regulation 148A was inserted by regulation 2(5) of <ref eId="c00053" href="http://www.legislation.gov.uk/id/nisr/2000/350">S.R. 2000 No. 350</ref></p></authorialNote> of the <abbr title="Jobseeker’s Allowance Regulations (Northern Ireland) 1996 (S.R. 1996/198)">Jobseeker’s Allowance Regulations</abbr> (applicable amounts), as appropriate.</p></wrapUp></paragraph></hcontainer></part><part eId="part-III"><num>Part III</num><heading>Consequential Provisions</heading><hcontainer name="regulation" eId="regulation-10"><heading>Scope of Part III</heading><num>10.</num><paragraph eId="regulation-10-1"><num>(1)</num><content><p>Regulations 11 and 13 to 17 shall only apply in relation to a person to whom regulation 3 or 4 applies in so far as those regulations relate to that person’s participation in the intensive activity period of the New Deal pilot for 25 plus.</p></content></paragraph><paragraph eId="regulation-10-2"><num>(2)</num><content><p>Regulation 12 shall only apply in any week in which a person to whom regulation 3 or 4 applies is participating in the intensive activity period of the New Deal pilot for 25 plus.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-11"><heading>Definition of “training allowance”</heading><num>11.</num><paragraph eId="regulation-11-1"><num>(1)</num><content><p><mod>The definition of “training allowance” in each of the regulations specified in paragraph (2) (which are interpretation provisions) shall be modified in its application to persons to whom this Part applies as if at the end there were added—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><blockList class="unordered none" ukl:Name="UnorderedList" ukl:Decoration="none"><item><p>nor does it include any top-up payment made to a person (“the participant”) pursuant to—</p><blockList class="ordered roman parens" ukl:Name="OrderedList" ukl:Type="roman" ukl:Decoration="parens"><item><num>(i)</num><p>section 1 of the Employment and Training Act (Northern Ireland) 1950 in respect of the participant’s participation in the intensive activity period of the New Deal pilot for 25 plus as defined for the purposes of the Social Security (New Deal Pilot) Regulations (Northern Ireland) 2000<authorialNote class="footnote" eId="f00021" marker="21"><p><ref eId="c00054" href="http://www.legislation.gov.uk/id/nisr/2000/369">S.R. 2000 No. 369</ref></p></authorialNote> in regulation 2(1) of those Regulations (“the intensive activity period”), or</p></item><item><num>(ii)</num><p>a written arrangement entered into between the Department of Higher and Further Education, Training and Employment and the person who has arranged for the participant’s participation in the intensive activity period and which is made in respect of the participant’s participation in that eId="regulation-12-1"><num>(1)</num><content><p><mod>Regulation 53 of the <abbr title="Jobseeker’s Allowance Regulations (Northern Ireland) 1996 (S.R. 1996/198)">Jobseeker’s Allowance Regulations</abbr> (persons treated as not engaged in remunerative work) shall be modified in its application to persons to whom this Part applies as if after paragraph (<i>h</i>) there was added the following paragraph—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><level class="para1"><num>(i)</num><content><p>he is participating in the programme known as the intensive activity period of the New Deal pilot for 25 plus as defined for the Regulations.)</subheading><blockContainer ukl:Name="P"><p>These Regulations replace with a further pilot scheme the pilot scheme set out in the Social Security (New Deal Pilot) Regulations (Northern Ireland) 1999, which were amended by the Social Security (Approved Work) Regulations (Northern Ireland) 2000. These in turn replaced the scheme established by the Social Security (New Deal Pilot) Regulations (Northern Ireland)1998.</p></blockContainer><blockContainer ukl:Name="P"><p>The schemes relate to persons who claim jobseeker’s allowance and who fulfil the criteria in regulation 3 or 4 as to age and the period over which they have been receiving benefit.</p></blockContainer><blockContainer ukl:Name="P"><p>Part II of these Regulations (regulations 5 to 9) makes provision for the pilot programme known as the intensive activity period of the New Deal for 25 plus.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 5 has the effect that if such a person without good cause refuses or fails to participate in the employment programme known as the intensive activity period of the New Deal pilot for 25 plus, or loses his place on such a programme due to misconduct, he will receive a sanction under Article 21 of the Jobseekers (Northern Ireland) Order 1995 (“<abbr title="Jobseekers (Northern Ireland) Order 1995 (S.I. 1995/2705 (N.I. 15))">the Order</abbr>”) and the <abbr title="Jobseeker’s Allowance Regulations (Northern Ireland) 1996 (S.R. 1996/198)">Jobseeker’s Allowance Regulations</abbr> (Northern Ireland)1996 ("the <abbr title="Jobseeker’s Allowance Regulations (Northern Ireland) 1996 (S.R. 1996/198)">Jobseeker’s Allowance Regulations</abbr>"). The effect of this will be a 2 week or 4 week loss or reduction in his jobseeker’s allowance.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 6 has the effect that a person participating in the intensive activity period of the New Deal pilot for 25 plus shall be liable only to the employment programme sanctions under Article 21(5) or 22A(2)(<i>a</i>) to (<i>c</i>) of <abbr title="Jobseekers (Northern Ireland) Order 1995 (S.I. 1995/2705 (N.I. 15))">the Order</abbr>, rather than the sanctions under Article 21(6) of <abbr title="Jobseekers (Northern Ireland) Order 1995 (S.I. 1995/2705 (N.I. 15))">the Order</abbr>.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 7 treats as available for employment in any week a person participating in the intensive activity period of the New Deal pilot for 25 plus and who is on an employment-related course for not less than 3 days in that week. Regulation 7 also disapplies regulation 15(<i>a</i>) of the <abbr title="Jobseeker’s Allowance Regulations (Northern Ireland) 1996 (S.R. 1996/198)">Jobseeker’s Allowance Regulations</abbr> (circumstances in which a person is not to be regarded as available) where a person is participating in such a course.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 8 adds to the list of circumstances to be regarded as good cause for any act or omission for the purposes of Article 21 of <abbr title="Jobseekers (Northern Ireland) Order 1995 (S.I. 1995/2705 (N.I. 15))">the Order</abbr>.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 9 sets out circumstances in which an income-based jobseeker’s allowance is payable to a person even though Article 21 or 22A of <abbr title="Jobseekers (Northern Ireland) Order 1995 (S.I. 1995/2705 (N.I. 15))">the Order</abbr> would normally prevent it.</p></blockContainer><blockContainer ukl:Name="P"><p>Part III of these Regulations makes various consequential amendments to the Housing Benefit (General) Regulations (Northern Ireland)1987, the Income Support (General) Regulations (Northern Ireland) 1987 and the <abbr title="Jobseeker’s Allowance Regulations (Northern Ireland) 1996 (S.R. 1996/198)">Jobseeker’s Allowance Regulations</abbr> (Northern Ireland)1996, so as to enable participants in the intensive activity period of the New Deal pilot for 25 plus to continue to claim those benefits—</p><blockContainer ukl:Name="P3" class="para1"><num>(a)</num><p>regulation 11 modifies the definition of “training allowance” which applies for the purposes of those benefits in relation to participants in the pilot scheme;</p></blockContainer><blockContainer ukl:Name="P3" class="para1"><num>(b)</num><p>regulation 12 provides that participants in the pilot scheme shall not be treated as in remunerative work;</p></blockContainer><blockContainer ukl:Name="P3" class="para1"><num>(c)</num><p>regulation 13 ensures that certain payments made to participants in the pilot scheme are not treated as either notional income or notional earnings, and regulation 14 ensures that such payments are not treated as notional capital;</p></blockContainer><blockContainer ukl:Name="P3" class="para1"><num>(d)</num><p>regulations 15 and 16 ensure that certain payments made to participants in the pilot scheme are disregarded as both income and capital;</p></blockContainer><blockContainer ukl:Name="P3" class="para1"><num>(e)</num><p>regulation 17 provides that participants in the pilot scheme who are receiving assistance in pursuing self-employed earner’s employment are subject to special rules as to the treatment of their income and capital.</p></blockContainer></blockContainer><blockContainer ukl:Name="P"><p>Part IV of these Regulations makes provision for the pilot known as the New Deal Education and Training Opportunities for 25 plus. Regulation 19 modifies regulation 17A of the <abbr title="Jobseeker’s Allowance Regulations (Northern Ireland) 1996 (S.R. 1996/198)">Jobseeker’s Allowance Regulations</abbr> to reduce, for the purpose of these Regulations, the period during which a person must be receiving benefit in order to qualify for participation in the New Deal Education and Training Opportunities pilot for 25 plus from 2 years to 18 months, and provide that any period of interruption in receiving benefit which does not exceed 28 days shall be taken into account in calculating the 18 month period referred to in regulations 3 and 4.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 20 provides that these Regulations apply to a person to whom the Social Security (New Deal Pilot) Regulations (Northern Ireland) 1999 applied immediately before they ceased to have effect.</p></blockContainer><blockContainer ukl:Name="P"><p>These Regulations do not impose a charge on business.</p></blockContainer><blockContainer ukl:Name="P"><p>In so far as these Regulations are required, for the purposes of regulations 11(1) and (2)(<i>a</i>), 12(3), 13(3), 14(2), 15(1) and (2)(<i>a</i>), 16(1) and (2)(<i>a</i>) and 17(2) and (3)(<i>a</i>) to be referred to the Social Security Advisory Committee under section 149(2) of the Social Security Administration (Northern Ireland) Act <ref eId="c00001" href="http://www.legislation.gov.uk/id/ukpga/1992/8">1992 (c. 8)</ref>, (“the <abbr title="Social Security Administration (Northern Ireland) Act 1992 c. 8">1992 Act</abbr>”), after agreement by the Social Security Advisory Committee, they have not been so referred by virtue of section 150(1)(<i>b</i>) of that Act. Otherwise they make in relation to Northern Ireland only provision corresponding to provision contained in Regulations made by the Secretary of State in relation to Great Britain and accordingly, by virtue of section 149(3) of, and paragraph 10 of Schedule 5 to, the <abbr title="Social Security Administration (Northern Ireland) Act 1992 c. 8">1992 Act</abbr>, are not subject to the requirement of section 149(2) of that Act for prior reference to the Social Security Advisory Committee.</p></blockContainer></blockContainer></conclusions></act></akomaNtoso>
