class="footnote" eId="f00002" marker="2"><p><ref eId="c00002" href="http://www.legislation.gov.uk/id/nisr/1993/278">S.R. 1993 No. 278</ref> as amended by <ref eId="c00003" href="http://www.legislation.gov.uk/id/nisr/1998/222">S.R. 1998 No. 222</ref> and <ref eId="c00004" href="http://www.legislation.gov.uk/id/nisr/1999/73">S.R. 1999 No. 73</ref></p></authorialNote> shall be amended in accordance with paragraph (2).</p></content></paragraph><paragraph eId="article-2-2"><num>(2)</num><intro><p>In Class A of Part 17—</p></intro><level class="para1" eId="article-2-2-a"><num>(a)</num><content><p>in paragraph A.1(<i>g</i>)(ii) and A.1(<i>h</i>)(i), after the words “of all the dishes”, insert “on the building, structure or mast”;</p></content></level><level class="para1" eId="article-2-2-b"><num>(b)</num><content><p>in paragraph A.1(<i>k</i>)(ii), for the word “it” substitute “the development”;</p></content></level><level class="para1" eId="article-2-2-c"><num>(c)</num><content><p>in paragraph A.1(<i>k</i>)(iii) for “2 cubic metres” substitute “2.5 cubic metres”;</p></content></level><level class="para1" eId="article-2-2-d"><num>(d)</num><intro><p>in paragraph A.2(4)—</p></intro><level class="para2" eId="article-2-2-d-i"><num>(i)</num><content><p>at the beginning insert the words “Subject to paragraph (4A)(<i>b</i>),”;</p></content></level><level class="para2" eId="article-2-2-d-ii"><num>(ii)</num><content><p>in sub-paragraph (<i>b</i>) after the word “mast” insert “on a building or structure”, and for “2 cubic metres” substitute “2.5 cubic metres”;</p></content></level><level class="para2" eId="article-2-2-d-iii"><num>(iii)</num><content><p>in the words immediately following sub-paragraph (<i>b</i>) after the word “permitted” insert “, except in the case of an emergency,”;</p></content></level><level class="para2" eId="article-2-2-d-iv"><num>(iv)</num><content><p><mod>for sub-paragraph A.2(4)(iii) substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><p>the development shall not be begun before the occurrence of one of the following—</p><level class="para3"><num>(aa)</num><content><p>the receipt by the applicant of the Department’s written notice of determination that such prior approval is not required;</p></content></level><level class="para3"><num>(bb)</num><content><p>where the Department gives the applicant written notice that such prior approval is required, the giving of that approval to the applicant in writing, within a period of 28 days beginning with the date on which the Department receives the application;</p></content></level><level class="para3"><num>(cc)</num><content><p>where the Department gives the applicant written notice that such prior approval is required, the expiry of the period of 28 days beginning with the date on which the Department receives the application, without the Department notifying the applicant, that such prior approval is given or refused;</p></content></level><level class="para3"><num>(ddc)</num><content><p>the expiry of a period of 28 days beginning with the date on which the Department receives the application, without the Department notifying the applicant, in writing, as to whether such prior approval is required;</p></content></level></quotedStructure><inline name="appendText">;</inline></mod></p></content></level></level><level class="para1" eId="article-2-2-e"><num>(e)</num><content><p><mod>after paragraph A.2(4), insert—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><paragraph><num>(4A)</num><hcontainer name="wrapper2"><intro><p>Subject to paragraph A.2(5), Class A development consisting—</p></intro><level class="para1"><num>(a)</num><content><p>of the construction, installation, alteration or replacement of a mast (other than on a building or structure); or</p></content></level><level class="para1"><num>(b)</num><content><p>such development together with any development specified in paragraph A.2(4)(<i>b</i>)</p></content></level></hcontainer><hcontainer name="wrapper2"><intro><p>is permitted subject, except in the case of emergency to the following conditions—</p></intro><level class="para2"><num>(i)</num><content><p>before beginning the development, the developer shall apply to the Department for a determination as to whether the prior approval of the Department is required to the siting and appearance of the development;</p></content></level><level class="para2"><num>(ii)</num><content><p>the application is accompanied by a written description of the development and a plan indicating its proposed location, together with any fee required to be paid;</p></content></level><level class="para2"><num>(iii)</num><intro><p>the development shall not be begun before the commencement of one of the following—</p></intro><level class="para3"><num>(aa)</num><content><p>the receipt of the Department’s written notice that such prior approval is not required;</p></content></level><level class="para3"><num>(bb)</num><content><p>where the Department gives the applicant written notice that such prior approval is required, the giving of such written approval to the applicant within 42 days following the date on which it received the application;</p></content></level><level class="para3"><num>(cc)</num><content><p>where the Department gives the applicant written notice that such prior approval is required, the expiry of the period of 42 days beginning with the date on which the Department receives the application, without the Department notifying the applicant, that such prior approval is given or refused;</p></content></level><level class="para3"><num>(dd)</num><content><p>the expiry of a period of 42 days beginning with the date on which the Department receives the application, without the Department notifying the applicant, in writing, as to whether such prior approval is required;</p></content></level></level><level class="para2"><num>(iv)</num><intro><p>the development shall, except to the extent the Department otherwise agrees in writing, be carried out—</p></intro><level class="para3"><num>(aa)</num><content><p>where prior approval has been given as mentioned in sub-paragraph (iv)(<i>bb</i>), in accordance with the details approved; and</p></content></level><level class="para3"><num>(bb)</num><content><p>in any other case, in accordance with the details submitted with the application;</p></content></level></level><level class="para2"><num>(v)</num><intro><p>the development shall be begun—</p></intro><level class="para3"><num>(aa)</num><content><p>where prior approval has been given as mentioned in sub-paragraph (iv)(<i>bb</i>), not later than the expiration of 5 years beginning with the date on which the approval was given;</p></content></level><level class="para3"><num>(bb)</num><content><p>in any other case, not later than the expiration of 5 years beginning with the date on which the Department was given the information referred to in sub-paragraph (ii).</p></content></level></level></hcontainer></paragraph></quotedStructure><inline name="appendText">;</inline></mod></p></content></level><level class="para1" eId="article-2-2-f"><num>(f)</num><content><p>in paragraph A.2(5) delete “in a conservation area, an area of outstanding
