<Text>These Regulations may be cited as the Measuring Equipment (Capacity Measures) Regulations (Northern Ireland) 1998 and shall come into operation on 1st April 1998.</Text>

<Text>The Regulations specified in the first column of Schedule 1 are hereby revoked to the extent specified in the third column of that Schedule save in relation to capacity measures passed as fit for use for trade and stamped before these Regulations come into operation.</Text>

<Text>In these Regulations—</Text>

<Text>“<Abbreviation Expansion="British Standard specification for graduated glass measuring cylinders">BS 604: 1982</Abbreviation>” means the British Standard specification for graduated glass measuring cylinders<FootnoteRef Ref="f00003"/>;</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“<Abbreviation Expansion="British Standard specification for glass dispensing measures for pharmaceutical purposes">BS 1922: 1987</Abbreviation>” means the British Standard specification for glass dispensing measures for pharmaceutical purposes<FootnoteRef Ref="f00004"/>;</Text>
</Para>

<Text>“<Abbreviation Expansion="British Standard specification for sampling procedures for inspection by attributes">BS 6001: Part 1: 1991</Abbreviation>” means the British Standard specification for sampling procedures for inspection by attributes<FootnoteRef Ref="f00005"/>;</Text>
</Para>

<Para>
<Text>“<Abbreviation Expansion="British Standard specification for single sampling plans indexed by acceptable quality level (AQL) for lot-by-lot inspection">BS 6002: Part 1: 1993</Abbreviation>” means the British Standard specification for single sampling plans indexed by acceptable quality level (<Abbreviation Expansion="acceptable quality level">AQL</Abbreviation>) for lot-by-lot inspection<FootnoteRef Ref="f00006"/>;</Text>
</Para>

<Para>
<Text>“<Abbreviation Expansion="British Standard methods for use and testing of volumetric glassware">BS 6696: 1986</Abbreviation>” means the British Standard methods for use and testing of volumetric glassware<FootnoteRef Ref="f00007"/>;</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“another member State” means a member State of the European Communities other than the United Kingdom;</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“digital” means capable of assigning only certain discrete values or positions within a continuous range by a series of discontinuous steps;</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“discrimination threshold” means, in the case of weighing equipment with a digital indicator, the weight which produces a change of reading of one digit, and in the case of weighing equipment with an analogue indicator, the weight which produces a one millimetre movement of the pointer; and in this definition, “analogue” means capable of assigning any value or position within a continuous range;</Text>

<Text>“double measure” means a measure comprising two parts, each part being a capacity measure;</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“<Abbreviation Expansion="the Agreement on the European Economic Area signed at Oporto on 2nd May 1992 as adjusted by the Protocol signed at Brussels on 17th March 1993">EEA Agreement</Abbreviation>” means the Agreement on the European Economic Area signed at Oporto on 2nd May 1992<FootnoteRef Ref="f00008"/> as adjusted by the Protocol signed at Brussels on 17th March 1993<FootnoteRef Ref="f00009"/>;</Text>
</Para>

<Para>
<Text>“<Abbreviation Expansion="a State which is a Contracting Party to the EEA Agreement other than the United Kingdom">EEA State</Abbreviation>” means a State which is a Contracting Party to the EEA Agreement other than the United Kingdom;</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“graduated measure” means a measure with more than four scale marks or, in the case of a measure which is both a metric and imperial measure, in each of metric and imperial units;</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“<Abbreviation Expansion="Weights and Measures (Northern Ireland) Order 1981 (S.I. 1981/231 (N.I. 10))">the Order</Abbreviation>” means the Weights and Measures (Northern Ireland) Order 1981;</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“the prescribed limits of error” shall be construed in accordance with regulation 15;</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“the stamp” means the stamp prescribed by the Weights and Measures (Prescribed Stamp) Regulations (Northern Ireland) 1969<FootnoteRef Ref="f00010"/>;</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“subdivided measure” means a measure with four or fewer scale marks or, in the case of a measure which is both a metric and imperial measure, in each of metric and imperial units; and</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“suitable weighing machine” means a weighing machine having a discrimination threshold and a repeatability in grams not exceeding one-fifth of the appropriate limit of error expressed in millimetres relating to the standard, equipment or measure it is used to test.</Text>
</Para>
</ListItem>

<Text>In these Regulations any reference to the importation of a capacity measure into Northern Ireland from another member State or from an EEA State includes such importation through Great Britain.</Text>

<Text>Save where paragraph (4) has effect, dispensing measures for pharmaceutical purposes shall comply with the requirements of BS 604: 1982 or BS 1922: 1987.</Text>

<Text>In the case of a double measure—</Text>

<Text>the measure shall be so constructed that it is readily identifiable as a double measure;</Text>
</P3para>
</P3>

<Text>the part of the measure having the greater capacity shall have a purported value which is twice that of the part having the lesser capacity; and</Text>

<Text>Any capacity measure, instead of complying with the requirements of paragraph (1) or (2) as the case may be, may comply with—</Text>

<Text>a relevant national standard or code of practice issued by a national standards body or similar body in a member State or an EEA State;</Text>
</P3para>
</P3>

<Text>a relevant international standard officially recognised for use in a member State or an EEA State;</Text>

<Text>a relevant technical provision of mandatory application in relation to marketing or use in a member State or an EEA State; or</Text>

<Text>descriptive technical documents relating to manufacturing processes lawfully carried out in a member State or an EEA State, being documents which are sufficiently detailed to enable the measures to be evaluated (if necessary by the carrying out of tests) as capacity measures for use otherwise than as dispensing measures for pharmaceutical purposes or as such dispensing measures, as may be appropriate,</Text>
</P3para>
</P3>
<Text>being requirements which, in any case, afford in use at least equivalent standards of safety, suitability and fitness for purpose of such measures as does paragraph (1) and, in the case of dispensing measures for pharmaceutical purposes, BS 604: 1982 or BS 1922: 1987.</Text>

</P2>

<Title>Purpose and manner of use of capacity measures</Title>

<Text>A person shall not use a capacity measure—</Text>

<Text>for the measurement of goods which might affect, or be affected by, the material from which the measure is made;</Text>

<Text>Where—</Text>

<Pnumber>a</Pnumber>
<P3para>
<Text>a group of capacity measures of the same nominal capacity and the same manufacture is submitted for testing; and</Text>
</P3para>
</P3>
<P3 DocumentURI="http://www.legislation.gov.uk/nisr/1998/48/regulation/12/1/b" IdURI="http://www.legislation.gov.uk/id/nisr/1998/48/regulation/12/1/b" id="regulation-12-1-b">
<Pnumber>b</Pnumber>
<P3para>
<Text>the conditions specified in paragraph (2) are satisfied with respect to the group,</Text>
</P3para>
</P3>
<Text>the inspector may, at the request of the person submitting them (“the submitter”), confine the testing to a number of measures determined and selected as specified in paragraph (3).</Text>
</P2para>
</P2>

<Pnumber>2</Pnumber>
<P2para>
<Text>The conditions referred to in paragraph (1)(<Emphasis>b</Emphasis>) are that—</Text>

<Pnumber>a</Pnumber>

<Text>the group shall be clearly identifiable and shall comprise more than 500 but not more than 150,000 measures;</Text>
</P3para>
</P3>

<Pnumber>b</Pnumber>
<P3para>
<Text>the measures in the group shall all have been produced by the same production process; and</Text>
</P3para>
</P3>

<Pnumber>c</Pnumber>
<P3para>
<Text>the group shall be accompanied by records of the production process and of any subsequent action taken by the manufacturer which are adequate to show that the measures in the group are likely to fall within the prescribed limits of error.</Text>
</P3para>
</P3>
</P2para>
</P2>

<Pnumber>3</Pnumber>
<P2para>
<Text>The number of measures referred to in paragraph (1) shall be determined, and the measures shall be selected, by sampling plans and procedures using samples which the inspector considers to be representative; and the sample of measures shall be tested, in accordance either with paragraph (4) or, if the submitter so requests, with paragraph (5).</Text>
</P2para>
</P2>

<Pnumber>4</Pnumber>
<P2para>
<Text>The sample of measures shall be selected in accordance with BS 6001: Part 1: 1991, and tested for all the appropriate requirements of these Regulations, including limits of error on capacity conducted either volumetrically or gravimetrically as described in regulation 9(<Emphasis>c</Emphasis>) and in accordance with <Acronym Expansion="British Standard">BS</Acronym> 6002: 1993.</Text>
</P2para>
</P2>

<Pnumber>5</Pnumber>
<P2para>
<Text>The sample of measures shall be selected in accordance with BS 6001: Part 1: 1991 and—</Text>

<Pnumber>a</Pnumber>

<Text>the sample shall be tested for all the appropriate requirements of these Regulations except limits of error on capacity; and</Text>
</P3para>
</P3>

<Pnumber>b</Pnumber>

<Text>a sub-sample of the measures selected under paragraph (3) which the inspector considers to be representative, shall be tested gravimetrically as described in regulation 9(<Emphasis>c</Emphasis>) and in accordance with BS 6002: 1993.</Text>

</P3>
</P2para>
</P2>

<Pnumber>6</Pnumber>

<Text>Under each of paragraphs (4) and (5), the test shall provide an acceptable quality level equal to 1 per cent.</Text>

<Text>If the sample selected as specified in paragraph (3) satisfies the test specified in paragraph (4) or both the tests specified in paragraph (5), the other measures in the group shall be treated as having satisfied the test or tests as the case may be.</Text>

RestrictStartDate="2005-03-01"><Title>Capacity measures imported from another member State or EEA State</Title><P1 DocumentURI="http://www.legislation.gov.uk/nisr/1998/48/regulation/13" IdURI="http://www.legislation.gov.uk/id/nisr/1998/48/regulation/13" id="regulation-13"><Pnumber><CommentaryRef Ref="key-e05d243dc68b493660e06d39885b5b0f"/>13</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/nisr/1998/48/regulation/13/1" IdURI="http://www.legislation.gov.uk/id/nisr/1998/48/regulation/13/1" id="regulation-13-1"><Pnumber>1</Pnumber><P2para><Text>In relation to capacity measures imported into Northern Ireland from another member State or from an EEA State, subject to paragraph (4), an inspector shall not carry out any test in accordance with the provisions of regulations 8 to 12 if, together with the capacity measures being so imported, he is presented with the requisite documentation.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nisr/1998/48/regulation/13/2" IdURI="http://www.legislation.gov.uk/id/nisr/1998/48/regulation/13/2" id="regulation-13-2"><Pnumber>2</Pnumber><P2para><Text>In this regulation and in regulation 16 “requisite documentation” means—</Text><P3 DocumentURI="http://www.legislation.gov.uk/nisr/1998/48/regulation/13/2/a" IdURI="http://www.legislation.gov.uk/id/nisr/1998/48/regulation/13/2/a" id="regulation-13-2-a"><Pnumber>a</Pnumber><P3para><Text>the test report of an approved body that the capacity measures which are the subject of that report have been tested on the same basis as those set out in regulations 8 to 12 and stating which tests have been applied to them; <Title>Provision of material for inspector’s use</Title>

<Text>For the purposes of the performance by an inspector of his functions under the Order or these Regulations relating to inspection, testing, passing as fit for use for trade and stamping of any capacity measure, a person submitting such a measure to an inspector or who an inspector has reasonable cause to believe has possession of such a measure for use for trade shall, if requested, make available for the inspector’s use such material as the inspector may reasonably require, and any material so made available shall be returned to the person in question.</Text>

or</Text></P4para></P4></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nisr/1998/48/regulation/16/1/b" IdURI="http://www.legislation.gov.uk/id/nisr/1998/48/regulation/16/1/b" id="regulation-16-1-b"><Pnumber>b</Pnumber><P3para><Text>in the case of a measure which has not been tested, it forms part of a group of measures treated under regulation 12(7) as having satisfied the test or tests therein mentioned.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nisr/1998/48/regulation/16/2" IdURI="http://www.legislation.gov.uk/id/nisr/1998/48/regulation/16/2" id="regulation-16-2"><Pnumber>2</Pnumber><P2para><Text>In the case of capacity measures imported from another member State or from an EEA State, a capacity measure shall not be passed as fit for use for trade unless—</Text><P3 DocumentURI="http://www.legislation.gov.uk/nisr/1998/48/regulation/16/2/a" IdURI="http://www.legislation.gov.uk/id/nisr/1998/48/regulation/16/2/a" id="regulation-16-2-a"><Pnumber>a</Pnumber><P3para><Text>either</Text><P4 DocumentURI="http://www.legislation.gov.uk/nisr/1998/48/regulation/16/2/a/i" IdURI="http://www.legislation.gov.uk/id/nisr/1998/48/regulation/16/2/a/i" id="regulation-16-2-a-i"><Pnumber>i</Pnumber><P4para><Text>where the requisite documentation is presented in accordance with regulation 13, the test report recites and the test data confirm to the satisfaction of the inspector that on testing in accordance with provisions of the law of a member State or EEA State it fell within limits of error which afford in use at least an equivalent standard to the prescribed limits of error and, in the case of dispensing measures for pharmaceutical purposes, BS 604: 1982 or BS 1922: 1987; or</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/nisr/1998/48/regulation/16/2/a/ii" IdURI="http://www.legislation.gov.uk/id/nisr/1998/48/regulation/16/2/a/ii" id="regulation-16-2-a-ii"><Pnumber>ii</Pnumber><P4para><Text>in the case of a measure which has not been tested, it formed part of a group of measures treated under provisions of the law of a member State or EEA State corresponding to regulation 12(7) as having satisfied a relevant test or tests; or</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/nisr/1998/48/regulation/16/2/a/iii" IdURI="http://www.legislation.gov.uk/id/nisr/1998/48/regulation/16/2/a/iii" id="regulation-16-2-a-iii"><Pnumber>iii</Pnumber><P4para><Text>it complies with all the relevant requirements of these Regulations; and</Text></P4para></P4></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nisr/1998/48/regulation/16/2/b" IdURI="http://www.legislation.gov.uk/id/nisr/1998/48/regulation/16/2/b" id="regulation-16-2-b"><Pnumber>b</Pnumber><P3para><Text>it is constructed in a manner which does not facilitate fraudulent use and that it does not bear any decorations or designs which might cause confusion in use.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nisr/1998/48/regulation/16/3" IdURI="http://www.legislation.gov.uk/id/nisr/1998/48/regulation/16/3" id="regulation-16-3"><Pnumber>3</Pnumber><P2para><Text>A measure (not being a single measure) shall not be passed for use for trade unless it is a double measure.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nisr/1998/48/regulation/16/4" IdURI="http://www.legislation.gov.uk/id/nisr/1998/48/regulation/16/4" id="regulation-16-4"><Pnumber>4</Pnumber><P2para><Text>Where practicable, the stamp shall be placed on the outside of the measure, adjacent to the marking of the amount of nominal capacity, but in any other case shall be applied to a metal plate permanently attached to the measure.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nisr/1998/48/regulation/16/5" IdURI="http://www.legislation.gov.uk/id/nisr/1998/48/regulation/16/5" id="regulation-16-5"><Pnumber>5</Pnumber><P2para><Text>A capacity measure shall not be stamped unless—</Text><P3 DocumentURI="http://www.legislation.gov.uk/nisr/1998/48/regulation/16/5/a" IdURI="http://www.legislation.gov.uk/id/nisr/1998/48/regulation/16/5/a" id="regulation-16-5-a"><Pnumber>a</Pnumber><P3para><Text>its nominal capacity is marked on its outside surface and is so marked conspicuously, legibly and durably—</Text><P4 DocumentURI="http://www.legislation.gov.uk/nisr/1998/48/regulation/16/5/a/i" IdURI="http://www.legislation.gov.uk/id/nisr/1998/48/regulation/16/5/a/i" id="regulation-16-5-a-i"><Pnumber>i</Pnumber><P4para><Text>on the body of the measure adjacent to the brim or to the line denoting the nominal capacity or, in the case of a measure without scale marks, at approximately mid-height; or</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/nisr/1998/48/regulation/16/5/a/ii" IdURI="http://www.legislation.gov.uk/id/nisr/1998/48/regulation/16/5/a/ii" id="regulation-16-5-a-ii"><Pnumber>ii</Pnumber><P4para><Text>on a shield or plate permanently attached to the outside of the measure,</Text></P4para></P4><Text>and not on any handle, rim, edge or stem;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nisr/1998/48/regulation/16/5/b" IdURI="http://www.legislation.gov.uk/id/nisr/1998/48/regulation/16/5/b" id="regulation-16-5-b"><Pnumber>b</Pnumber><P3para><Text>in the case of a line measure, its nominal capacity is denoted by a line (which shall, in the case of a measure made of opaque material, be marked on the inside surface);</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nisr/1998/48/regulation/16/5/c" IdURI="http://www.legislation.gov.uk/id/nisr/1998/48/regulation/16/5/c" id="regulation-16-5-c"><Pnumber>c</Pnumber><P3para><Text>the scale marks are marked on the measure in the same field of view as the mark of the nominal capacity, and</Text><P4 DocumentURI="http://www.legislation.gov.uk/nisr/1998/48/regulation/16/5/c/i" IdURI="http://www.legislation.gov.uk/id/nisr/1998/48/regulation/16/5/c/i" id="regulation-16-5-c-i"><Pnumber>i</Pnumber><P4para><Text>in the case of a graduated measure, are numbered at appropriate intervals; and</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/nisr/1998/48/regulation/16/5/c/ii" IdURI="http://www.legislation.gov.uk/id/nisr/1998/48/regulation/16/5/c/ii" id="regulation-16-5-c-ii"><Pnumber>ii</Pnumber><P4para><Text>in the case of a subdivided measure, are marked with the capacity they are intended respectively to indicate; and</Text></P4para></P4></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nisr/1998/48/regulation/16/5/d" IdURI="http://www.legislation.gov.uk/id/nisr/1998/48/regulation/16/5/d" id="regulation-16-5-d"><Pnumber>d</Pnumber><P3para><Text>any name or trade mark marked on the measure—</Text><P4 DocumentURI="http://www.legislation.gov.uk/nisr/1998/48/regulation/16/5/d/i" IdURI="http://www.legislation.gov.uk/id/nisr/1998/48/regulation/16/5/d/i" id="regulation-16-5-d-i"><Pnumber>i</Pnumber><P4para><Text>is in lettering which is smaller than the marking of its nominal capacity; and</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/nisr/1998/48/regulation/16/5/d/ii" IdURI="http://www.legislation.gov.uk/id/nisr/1998/48/regulation/16/5/d/ii" id="regulation-16-5-d-ii"><Pnumber>ii</Pnumber><P4para><Text>is so marked as not to cause confusion with the marking of the nominal capacity.</Text></P4para></P4></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nisr/1998/48/regulation/16/6" IdURI="http://www.legislation.gov.uk/id/nisr/1998/48/regulation/16/6" id="regulation-16-6"><Pnumber>6</Pnumber><P2para><Text>A graduated or subdivided measure shall not be stamped unless it is made of translucent or transparent material.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nisr/1998/48/regulation/16/7" IdURI="http://www.legislation.gov.uk/id/nisr/1998/48/regulation/16/7" id="regulation-16-7"><Pnumber>7</Pnumber><P2para><Text>For the purposes of paragraph (5)(<Emphasis>a</Emphasis>), the capacity of a measure—</Text><P3 DocumentURI="http://www.legislation.gov.uk/nisr/1998/48/regulation/16/7/a" IdURI="http://www.legislation.gov.uk/id/nisr/1998/48/regulation/16/7/a" id="regulation-16-7-a"><Pnumber>a</Pnumber><P3para><Text>shall be marked in full in pints, litres, centilitres or millilitres, or by the appropriate abbreviation or symbol in accordance with regulation 2(3); <Text>“metric measure”, “imperial measure” and “metric and imperial measure” mean, respectively, a measure the nominal capacity of which is given in metric units only, in imperial units only or in both metric and imperial units.</Text>

<Title>Obliteration of stamps</Title>

<Pnumber>1</Pnumber>
<P2para>
<Text>Subject to paragraphs (2) to (4), an inspector shall obliterate the stamp on any capacity measure which—</Text>

<Pnumber>b</Pnumber>

<Text>fails to comply with any other appropriate requirement of these Regulations.</Text>

</P2>

<Pnumber>2</Pnumber>
<P2para>
<Text>Where any measure is found not to comply with the requirements of these Regulations only because it falls outside the prescribed limits of error, an inspector may, if he considers the measure can be brought within those limits, instead of immediately obliterating the stamp pursuant to paragraph (1), give to the person in possession of the measure a notice requiring him to ensure that the measure is brought within those limits before the expiry of 28 days or such shorter time as may be specified in the notice.</Text>

<Pnumber>3</Pnumber>

<Text>If a notice given under paragraph (2) is not complied with within the period specified in it, the inspector shall obliterate the stamp on the measure to which the notice relates.</Text>

<Pnumber>4</Pnumber>

<Text>Where any capacity measure has since it was last stamped, been the subject of any adjustment, alteration, addition, damage or repair which could have affected its compliance with the appropriate requirements of these Regulations, the inspector shall obliterate the stamp on that measure.</Text>

<P><Text>The Regulations prescribe, for the purposes of the Weights and Measures (Northern Ireland) Order 1981 (“the Order”) certain dry and liquid capacity measures for use for trade. The Regulations replace Parts III and IV of the Weights and Measures Regulations (Northern Ireland) 1967, (as amended) and cover all capacity measures other than—</Text>

<Pnumber>i</Pnumber>
<P4para>
<Text>those for the purposes of measuring and serving intoxicating liquor for consumption on the premises at which it is sold, to which the Capacity Serving Measures (Intoxicating Liquor) Regulations (Northern Ireland) 1993 apply, or</Text>
</P4para>
</P4>
<P4>
<Pnumber>ii</Pnumber>
<P4para>
<Text>those for use only for making up or checking packages (in accordance with Article 31(9) and (10)(<Emphasis>a</Emphasis>) of the Order) which are specified in paragraph 4 of Schedule 4 to the Weights and Measures (Packaged Goods) Regulations (Northern Ireland) 1990, or</Text>
</P4para>
</P4>
<P4>
<Pnumber>iii</Pnumber>
<P4para>
<Text>those which have previously contained a cosmetic product and are supplied by the customer for use in retail transactions in the same cosmetic product.</Text>
</P4para>
</P4>
</P>
<P>
<Text>The Regulations apply to dispensing measures for pharmaceutical purposes (formerly called apothecaries' measures).</Text>
</P>
<P><Text>The effect of prescription is to make it unlawful to use these capacity measures for trade purposes unless they have been tested, passed as fit for such use and stamped by an inspector of weights and measures. The Regulations make simplified provision about—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>the materials and principles of construction of capacity measures (regulations 4 to 6);</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>their purpose and manner of use (regulation 7);</Text>
</P3para>
</P3>
<P3>
<Pnumber>c</Pnumber>
<P3para>
<Text>their testing for conformity with the nominal capacity of the whole measure and those of its subdivisions, within certain prescribed limits of error (regulations 8 to 15); and</Text>
</P3para>
</P3>
<P3>
<Pnumber>d</Pnumber>
<P3para>
<Text>their being passed as fit for use for trade and stamped, and the obliteration of stamps (regulations 16 to 18).</Text>
</P3para>
</P3>
</P>
<P><Text>The Regulations make the following changes of substance—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>a requirement has been introduced to ensure that a buyer of intoxicating liquor, which is transferred from a capacity measure to another container, should have a clear and unobstructed view of the measurement and the transfer (regulation 7(<Emphasis>c</Emphasis>));</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>provision is made for the testing of dispensing measures for pharmaceutical purposes by means of a peristaltic pump dispenser (regulation 11(1)(<Emphasis>c</Emphasis>));</Text>
</P3para>
</P3>
<P3>
<Pnumber>c</Pnumber>
<P3para>
<Text>provision is made for testing based on the results of testing a group of measures of between 500 and 150,000 in number (regulation 12);</Text>
</P3para>
</P3>
<P3>
<Pnumber>d</Pnumber>
<P3para>
<Text>to avoid duplicate testing of capacity measures imported from other member States of the European Communities or a state of the European Economic Area, by allowing weights and measures inspectors testing the fitness of such measures for use for trade to accept test reports and results from approved bodies in those States (regulations 13 and 16);</Text>
</P3para>
</P3>
<P3>
<Pnumber>e</Pnumber>
<P3para>
<Text>dispensing measures for pharmaceutical purposes are now largely dealt with by British Standards (<Abbreviation Expansion="British Standards">BS</Abbreviation>) and the relevant BS is referred to in relation to their constructional requirements (regulation 6(2)) and limits of error (regulation 15);</Text>
</P3para>
</P3>
<P3>
<Pnumber>f</Pnumber>
<P3para>
<Text>the permissible limits of error are amended and are now in excess and in deficiency (formerly in excess only) (regulation 15 and Schedule 2); and</Text>
</P3para>
</P3>
<P3>
<Pnumber>g</Pnumber>
<P3para>
<Text>the requirements relating to the placing of the line on line measures are amended (regulation 16(5)).</Text>
</P3para>
</P3>
</P>
<P>
<Text>Contravention of regulations 2(2) and 7 is an offence under Article 13(1) of the Order. It is also an offence under Article 9(2) of the Order for a person to use for trade or have in his possession for such use any capacity measure prescribed by regulation 3 which has not been passed as fit for such use and which does not bear a stamp indicating that it has been so passed which remains undefaced otherwise than by reason of fair wear and tear. The penalty on summary conviction for all these offences is a fine not exceeding level 3 on the standard scale (currently £1,000).</Text>
</P>

<Text>In Great Britain the corresponding Regulations are the Measuring Equipment (Capacity Measures and Testing Equipment) Regulations 1995 (<Acronym Expansion="Statutory Instrument">S.I.</Acronym> <Citation URI="http://www.legislation.gov.uk/id/uksi/1995/735" id="c00011" Class="UnitedKingdomStatutoryInstrument" Year="1995" Number="0735">1995/735</Citation>). The National Weights and Measures Laboratory has prepared a compliance cost assessment in relation to those Regulations and a copy of that assessment together with the Northern Ireland Supplement, prepared by the Department of Economic Development, is held at Trading Standards Branch, Department of Economic Development, 176 Newtownbreda Road, Belfast BT8 6QS from where copies may be obtained on request.</Text>
