ROAD TRAFFIC AND VEHICLES

To be laid before Parliament under paragraph 3(3) of Schedule 1 to the Northern Ireland Act 1974
Coming into operation
25th January 1997
1. This Order may be cited as the Motor Vehicles (International Circulation) (Amendment) Order (Northern Ireland) 1996 and shall come into operation on 25th January 1997.
2. The Interpretation Act (Northern Ireland) 1954(3) shall apply to this Order as it applies to a Measure of the Northern Ireland Assembly.
3.—(1) The Motor Vehicles (International Circulation) Order (Northern Ireland) 1990(4) shall be amended as follows:
(2) In Article 3 (visitors' driving permits)—
(a)in paragraphs (2)(i), (3)(a) and (4)(a) after the words “an EEA State,” there shall be inserted “the Isle of Man or Jersey,”;
(b)in paragraph (7)—
(i)in the definition of “Convention driving permit” after the word “issued” in each place where it occurs, and in the definition of “domestic driving permit” after the words “issued under the law of that country”, there shall be inserted “to a person who has given proof of his competence to drive”; and
(ii)in the definition of “domestic driving permit” after the words “a driving permit issued”, there shall be inserted “to such a person”.
(3) In Article 4(1) (visiting forces' driving permits) the words “other than a large goods vehicle or a passenger-carrying vehicle” shall be omitted.
(4) In Article 7(3) in sub-paragraph (i) of the definition of “Convention driving permit” after the words “in Schedule 1 issued”, and in sub-paragraphs (ii) and (iii) of that definition, after the words “the Schedule issued”, there shall be inserted “to a person who has given proof of his competence to drive.”.

This Order further amends the Motor Vehicles (International Circulation) Order (Northern Ireland) 1990 as follows—
(1) Visitors to Northern Ireland resident in the Isle of Man or Jersey who hold appropriate visitors' driving permits may drive in Northern Ireland large goods and passenger-carrying vehicles, whether or not those vehicles have been brought temporarily into Northern Ireland (Article 3(2)(a)).
(2) The definitions of Convention driving permit and domestic driving permit are amended so that foreign provisional licences do not have the same validity as full driving licences (Article 3(2)(b) and (4)).
(3) The provision allowing foreign military personnel to drive large buses and lorries is restored, having been removed by the Motor Vehicles (International Circulation) (Amendment) Order (Northern Ireland) 1991 (S.R. 1991 No. 477) (Article 3(3)).
