PENSIONS

The Pensions (1995 Order) (Commencement No. 5) Order (Northern Ireland) 1996

The Department of Health and Social Services, in exercise of the powers conferred on it by Article 1(2) of the Pensions (Northern Ireland) Order 1995(1) and of all other powers enabling it in that behalf, hereby makes the following Order:

Citation and interpretation

1.—(1) This Order may be cited as the Pensions (1995 Order) (Commencement No. 5) Order (Northern Ireland) 1996.

(2) In this Order, “the Order” means the Pensions (Northern Ireland) Order 1995.

Appointed day

2.  The day appointed for the coming into operation of the following provisions of the Order—

(a)Article 3(2) (prohibition orders), Article 74(1) and (5)(a) (discharge of liabilities by insurance, etc.), Article 161 (levies towards meeting certain expenditure) and paragraph 13 of Schedule 1 (disclosure of information to the Authority and the Compensation Board) and Article 119 in so far as it relates to that paragraph, for the purpose only of authorising the making of regulations; and

(b)Articles 115 (powers to modify Part II of the Order) and 122(2) to (4) (provisions supplementary to Article 121 of the Order) in so far as they are not already in operation,

is 19th November 1996.

Explanatory Note

(This note is not part of the Order)

This Order provides for the coming into operation of further provisions of the Pensions (Northern Ireland) Order 1995 (“ Order” 19th November 1996.

It commences provisions for the purpose only of authorising the making of regulations relating to the issue of orders by the Occupational Pensions Regulatory Authority (“the Authority”) prohibiting the appointment of trustees, the discharge of liabilities by insurance, etc., levies towards meeting certain expenditure and the disclosure of information to the Authority and the Pensions Compensation Board.

It also brings fully into operation Articles 115 and 122(2) to (4), which relate to powers to modify Part II of the Order.
